MINUTES CITY OF TAUNTON ZONING BOARD OF APPEALS January 16, 2020 at 6:00 PM (held at Maxham School, 141 Oak St, Taunton, Ma.) Members Present: Dennis Ackerman, Wayne Berube, George Moniz, Steve Vieira Michael Staples, Craig Faria, and Scott Rodrigues. A moment of silence for Jason Buffington, City Solicitor who passed away on January 1, 2020. Meeting opens at 6:01 PM Chairman Ackerman disclosed that he contacted the State Ethics Commission and stated there is no conflict for him being on two boards (ZBA & P.B.) Election of Officer: Chairman and Clerk George nominated Dennis Ackerman as Chairman, seconded by Steve. 6 members in favor. Dennis abstains from voting. Dennis nominated Steve Vieira for Clerk, seconded by George. 6 members in favor. Steve abstains from voting. Chairman Ackerman explains the ZBA process. A presentation is made by the Petitioner then they hear from opposed/ and in favor. Then the petitioner is allowed to answer questions and the Board votes. There is no going back and forth. You need 4 votes to pass. Case# 3529 Alegi Woodward’s Lane 55-480 For: A Variance from Section 440 Attachment #3 of the Zoning Ordinance for the construction of a single family home having a 19 foot front setback (instead of 25’) and a 10 foot rear setback (instead of 20’) on premises situated on the northwesterly side of Woodwards Lane, Taunton, Ma. known as parcel 55-480. For the Petitioner: Atty. Edmund Brennan, One Church Green, Taunton, Ma. In favor: None Opposed: None Atty. Brennan stated the petitioner was approved by the Board in 2017 and the footprint of house was approved. He now has a buyer for the property and they wish to put a rear deck and front steps on the house which required zoning approval. He presented the Board with plans stamped by a Land Surveyor. Chairman Ackerman asked if there were 1 any conditions on the original variance? Atty. Brenan answered the Board restricted to single family and upon improvements to the roadway as presented. Atty. Brennan stated the P.B. approved a Roadway Improvement Plan. Chairman Ackerman suggested putting all the conditions of the previous variance and roadway improvement plan conditions. Chairman Ackerman read dept. comments from City Planner, Conservation. Commission, DPW, Engineer, and B.O.H. into the record. Wayne stated there is no substantial change than last time and he thinks it will be an asset to the neighborhood. Motion made and seconded to Grant as Presented with the following conditions: 1. Single family home only. 2. Improvements to roadway and emergency turnaround to be approved by the City Engineer. 3. The emergency turnaround shall be maintained by the homeowner and noted as such in all subsequent deeds. 4. The area at the end of emergency turnaround within the street layout shall be left vacant for snow storages purposes and shall also be indicated in all subsequent deeds. 5. The bottom of swale shall be widen and flatten to perform the function while not creating an impediment to walking or maintenance. 6. Provide a 10 foot wide easement along the swale and include in all subsequent deeds that it must remain. 7. The lot shall be serviced by Municipal Sewer. 8. These improvements shall be deemed appropriate for 1 added lot only. Ackerman, Berube,Vieira, Moniz, Faria . ……YES Petition granted Other Business: The Settlement – Reduction of Surety - cont’d.
