NOTICE IS HEREBY GIVEN that the Terrell City Council will conduct a Special City Council
Meeting and Workshop at 6:00 p.m. on Tuesday, September 28, 2021, at Terrell City Hall located
at 201 East Nash Street. The meeting is open to the public with limited seating in the Council
Chambers. Recommendations of the CDC regarding social distancing will be practiced during
the course of the public meeting to slow the spread of the Coronavirus (COVID-19).
If you choose not to attend in person and you wish to submit public comments, email
support@cityofterrell.org and title the email ”Public Comment”. All public comments submitted
by 12:00 pm on Tuesday, September 28, 2021 will be provided to the City Council members and

imposed by the funding agency, the Texas Department of Agriculture (TDA), is for the City to complete
the vehicle and equipment procurement process prior to TDA issuing the formal grant agreement.
The City opened sealed bids for one (1) Brush Truck on September 21, 2021. The City received three (3)
bids.

the vehicle and equipment procurement process prior to TDA issuing the formal grant agreement.
The City opened sealed bids for two (2) Cardiac Monitors on September 21, 2021. The City received one
bid.
Vendor Bid Amount Delivery Schedule
Zoll Medical Corporation $75,935.74 120-150 days
Of this amount, TDA may consider approximately $2,280 as disallowed costs as being “disposables.”
These items include paper, electrodes, and tubing. The City should pay these costs with additional local
funds.
Zoll is the only responsive bidder and is not excluded from federal or state contracts.
It is recommended the City of Terrell award the two (2) cardiac monitors to Zoll Medical
Corporation for $75,935.74, contingent upon TDA approval.
Following the vote to award, the City will provide the meeting minutes and complete procurement record

on September 21, 2021. The City received three (3) bids.

RESOLUTION NO. 1063
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS,
APPROVING AND AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION
TO THE STATE OF TEXAS, OFFICE OF THE GOVERNOR, PUBLIC SAFETY OFFICE,
CRIMINAL JUSTICE DIVISION, BODY-WORN CAMERA GRANT FY-2022 FOR THE
PURCHASE OF EQUIPMENT FOR THE TERRELL POLICE DEPARTMENT
WHEREAS, the City of Terrell will use Criminal Justice Division funds to purchase equipment
for the Terrell Police Department; and
WHEREAS, the City of Terrell will not use funds for any of the specifically prohibited uses; and
WHEREAS, the City of Terrell is eligible to participate in this program as a unit of local
government; and
WHEREAS, the City of Terrell is eligible for an award amount up to $48,295.00; and
WHEREAS, the City of Terrell is required to provide a local match of twenty-five (25%) percent
of approximately $12,073.00; and
WHEREAS, the City of Terrell will forward the proposed application to the State of Texas, Office
of the Governor, Public Safely Office, Criminal Justice Division, for review and consideration as
per the requirements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TERRELL, TEXAS:
SECTION 1. That a grant application is hereby authorized to be filed on behalf of the City of
Terrell with the State of Texas, Office of the Governor, Public Safety Office, Criminal Justice
Division, for the Body-Worn Camera Grant Program FY 2022.
SECTION 2. That the grant application shall be in an amount not to exceed $49,295.00 with a
twenty-five (25%) percent local match by the City of Terrell of approximately $12,073.00.
SECTION 3. That the grant, if awarded, by the State of Texas, Office of the Governor, Public
Safety Office, Criminal Justice Division Body-Worn Camera Grant FY2022, will be accepted by
the City of Terrell.

BACKGROUND INFORMATION:
The dam at New Terrell City Lake (Flood Retarding Structure 87A) was determined to be out of
compliance with current flood protection requirements. City staff applied for a federal grant through
the Natural Resource Conservation Services (NRCS), which was awarded in 2013. Subsequently, a
grant at the state level was applied for and approved through the Texas State Soil and Water
Conservation Board (TSSWCB).
Freese & Nichols, Inc. (FNI) was awarded the design contract through the NRCS, preparing plans
and specifications as well as assisting us through the US Army Corp of Engineers permitting process
and flood easement acquisition.
Bids were received on August 25, 2021. At total of seven (7) bids were received. Upon review of the
apparent low bidder, Thalle Construction, Inc., NRCS and FNI have provided letters of
recommendation to award the contract in an amount not to exceed $14,330,000.00. The grants
obtained from NRCS and TSSWCB will cover 98.25% of the project costs. The City will be
responsible for the remaining 1.75% ($268,905.00)
A presentation will be provided at the Council meeting to summarize the work. Letters of
recommendation, a bid tab, and contract are included in the agenda packet.

Dear Mr. Mikeska:
We are in receipt of the bid recommendation provided by the Natural Resources Conservation Service
(NRCS) Texas office. These documents are attached and include the Recommendation of Contractor cover
letter, the Bid Tabulation, and the tabulated analysis of the bids relative to the Independent Government
Cost Estimate (IGCE) of $14,980,525.00.
A total of seven bid proposals were received at the Project bid opening on August 25, 2021, and the
apparent low bidder is Thalle Construction Co. with a bid of $14,180,000.00 for the base bid items plus
$150,000.00 for the alternate bid item. Our review of their bid package indicates that Thalle
Construction Co. has satisfactory capabilities, equipment, and experience on similar project types. Based
on this review, Freese and Nichols agrees with the NRCS findings and recommends that City of Terrell
award the construction contract to Thalle Construction Co. in the amount of $14,330,000.00, which is
inclusive of the base bid items and additive alternate bid item.

Cedar Creek Site 87A Rehabilitation

Thalle Construction Company, INC was apparent low bidder for the remedial repair of the Cedar
Creek Site 87A Rehabilitation project. Review of their bid and submitted references was
performed and is summarized below.
Review of References
Thalle Construction has previously performed repair work on several large dam rehabilitation
projects with the USACE and local municipalities. The submitted references show similar type
of projects in scope and scale as required by this project. It appears that Thalle Construction
has the appropriate equipment, manpower, and the general construction knowledge to complete
this project on time and within budget.
Review of Bid Tabulation
Review of the total bid, $14,330,000.00, shows to be slightly lower than the independent
government cost estimate (IGCE) of $14,980,525.00; 4.34% lower or ($650,525.00). The
average of all 7 bids is 21.46% higher than the IGCE.
The overall bid does not appear to be overly materially unbalanced. Two (2) of the contract
items (CINs); CIN 19, Diversions and CIN 49, Gate Valve, were substantially higher than the
IGCE at 7,400% and 400%; respectively but are considered minor components to the overall
project and represent 6.7% of the overall bid. In addition, there are twenty-four (24) of the fifty-
one (51) CINs that are greater than the IGCE by a range of 4% - 171%. Likewise, there are
twenty-four (24) of the CINs that are lower than the IGCE by a range of -10% to -80%. One (1)
of the CINs are equal to that of the IGCE. All the CINs of the remaining six (6) bids are greater
than the IGCE by a range of 27.5% to 1,446.7% with thirty-six (36) CINs being 100% or greater
over the IGCE. A full comparison with the IGCE is included as an attachment.
The higher unit prices and overall bids compared to the IGCE are consistent with bids received
on recent projects over the last several months. Independent market research also confirms
rapidly increasing material prices. In the current market it is unlikely that lower bid prices could
be obtained if this project was resolicited. Therefore, the received bid from Thalle Construction
is considered reasonable and of fair value to the Government and the Sponsor.
Recommendation
Based on past-experience of the contractors work and the review of the bid costs, I recommend
award of this contract to Thalle Construction Company, INC. I also conclude that this
Contractor represents the best value and results in the lowest overall cost alternative to meet
the Government's and Sponsor’s needs.

Agreements – Recommendation of Contractor
Cedar Creek Site 87A Rehabilitation

Thalle Construction Company, INC was apparent low bidder for the remedial repair of the Cedar
Creek Site 87A Rehabilitation project. Review of their bid and submitted references was
performed and is summarized below.
Review of References
Thalle Construction has previously performed repair work on several large dam rehabilitation
projects with the USACE and local municipalities. The submitted references show similar type
of projects in scope and scale as required by this project. It appears that Thalle Construction
has the appropriate equipment, manpower, and the general construction knowledge to complete
this project on time and within budget.
Review of Bid Tabulation
Review of the total bid, $14,330,000.00, shows to be slightly lower than the independent
government cost estimate (IGCE) of $14,980,525.00; 4.34% lower or ($650,525.00). The
average of all 7 bids is 21.46% higher than the IGCE.
The overall bid does not appear to be overly materially unbalanced. Two (2) of the contract
items (CINs); CIN 19, Diversions and CIN 49, Gate Valve, were substantially higher than the
IGCE at 7,400% and 400%; respectively but are considered minor components to the overall
project and represent 6.7% of the overall bid. In addition, there are twenty-four (24) of the fifty-
one (51) CINs that are greater than the IGCE by a range of 4% - 171%. Likewise, there are
twenty-four (24) of the CINs that are lower than the IGCE by a range of -10% to -80%. One (1)
of the CINs are equal to that of the IGCE. All the CINs of the remaining six (6) bids are greater
than the IGCE by a range of 27.5% to 1,446.7% with thirty-six (36) CINs being 100% or greater
over the IGCE. A full comparison with the IGCE is included as an attachment.
The higher unit prices and overall bids compared to the IGCE are consistent with bids received
on recent projects over the last several months. Independent market research also confirms
rapidly increasing material prices. In the current market it is unlikely that lower bid prices could
be obtained if this project was resolicited. Therefore, the received bid from Thalle Construction
is considered reasonable and of fair value to the Government and the Sponsor.
Recommendation
Based on past-experience of the contractors work and the review of the bid costs, I recommend
award of this contract to Thalle Construction Company, INC. I also conclude that this
Contractor represents the best value and results in the lowest overall cost alternative to meet
the Government's and Sponsor’s needs.
