Agenda Item 6.1 Case VR 24-04 Zoning Board of Adjustment Public Hearing: October 28, 2024 Owner/Applicant: Michael B. Chitty Location: 723 Griffith Ave, City of Terrell, Kaufman County, Texas Request: Variances to Zoning Ordinance Section 16.4.B.2 Current Zoning: SF-16 Background: The applicant is requesting a variance to Section 16.4- B.2. The section pertains to the minimum lot width. The combining of the two twenty-five foot lots requires a replat to be one lot, once replatted into one lot, the ordinance calls for a minimum lot width of 65 feet. Section 16.4 – B. Size of Yards: 1. Minimum Front Yard- Thirty (30’) feet. 2. Minimum Side Yard- Ten feet (10’) for interior side yard; Twenty feet (20’) for a non-key corner lot; Thirty feet (30’) for a key corner lot on a street. 3. Minimum Rear Yard- Twenty-five feet (25’) for the main building and any accessory building(s). The applicant currently owns the property known as 723 Griffith Ave Terrell, Texas. He wants to construct a new carport in the west side yard of the property. The chosen location to build the new carport would encroach into the side yard setback eight feet (8’), leaving only two feet (2’) of side yard to the property line. The applicant is requesting a variance allow the interior side yard to be reduced to two feet (2’) to allow him to build the new carport in the chosen location; this request is eight feet (8’) less than the ten feet (10”) required by ordinance. Staff recommends the granting of a variance to the side yard width to allow a new carport to be built on this property. Note: The Zoning Ordinance states that in granting a variance, the ZBA must come to a finding of hardship based on the facts of the application and the following criteria: 1. “That literal enforcement of the ordinance will create an unnecessary hardship in the development of the property. 2. “That the situation causing the hardship or difficulty is neither financial in nature, self-imposed nor generally affecting all or most properties in the same zoning district; and 3. “That the relief sought will not injure the permitted use of adjacent conforming property; and 4. “That the granting of a variance will be in harmony with the spirit and purpose of (the zoning) regulations.” Notification: 21Notices were sent to property owners within two hundred feet (200’) of the request as required by State Law. Vacancies shall be filled with a new term for any member whose place becomes vacant for any cause, in the manner as the original appointment was made. Each case before the Board of Adjustment must be heard by at least four (4) of the members . Term Limitations - No person shall serve more than three (3) consecutive terms as a member of the Board of Adjustment. Absences ­ An excused absence must be noted by the Chair of the Conunission or acting Chair at the meeting or at the following meeting by stating the Member and the justification. The only acceptable instances of excused absences shall be major personal or family health events and required travel for employment. The Chair or acting Chair must receive documentation of such prior to stating for the record that the absence shall be considered excused. Members with two (2) consecutive unexcused absences or three (3) consecutive unexcused total absences per rolling 12 month period from regular or posted meetings shall automatically forfeit the unexpired portion of their term .and shall not be eligible for reinstatement to any City Board or Conunission for a two (2) year period .. Members with extenuating circumstances may request City Council act to suspend their service for a designated period of time with a temporary replacement. Page 17 of 18 ITEM 7.1. ", 16-111: Authority of the Board The concurring vote of four (4) of the members of the Board is necessary to: (1.) reverse an order, requirement, decision, or determination of an administrative official; (2.) decide in favor of an applicant on a matter on which the Board is required to pass under a zoning ordinance; or (3.) authorize a variation from the terms of a zoning ordinance. Section II. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section III. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections to this Ordinance, since the same would have been enacted by the city council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. Section IV. This Ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.
