INDIAN HILL PLANNING COMMISSION
October 16, 2024
The regular meeting of the Indian Hill Planning Commission was held on October 16,
2024, at 7:00 p.m. in Council Chambers of the Village Administration building.

Item Number 1: Minutes and findings from the September 18, 2024, Indian Hill
Planning Commission meeting: Mr. Rhodenbaugh made a motion to approve the
September 18, 2024, minutes and findings. Mr. McGraw seconded, and the motion was
approved by a unanimous voice vote.
Chairman Wiggers asks for anyone planning to speak this evening to please stand,
raise their right hand, and be sworn in prior to presentation of the cases.
Item Number 2: Case #24-013: Timberland Custom Homes, LLC is requesting
authorization to permit construction of a new single-family residence on a non-
conforming lot of record per Section 81. Lot of Record of the Zoning Ordinance. The
subject property is located at 5240 Miami Road.
Mr. Jeff England with Timberland Custom Homes comes before the Commission and
states that they would like to build a spec home on the lot, they have provided drawings
of the home, which is not sold at this time. He also stated that he and his wife may
decide to live in the home, otherwise it will be placed on the market after drywall is
installed.
Staff Report: Mr. West states that the Indian Hill Zoning Ordinance, Section 81. Lot of
Record states:
On any lot of official record, as defined in Section 3 of this ordinance, at the time
of the enactment of this ordinance, even though a smaller area and/or frontage
than required by this chapter in the district in which it is located, a one-family

dwelling with its customary accessory structures may be authorized by the
Planning Commission provided that the owner of the lot does not own any
adjacent land and provided that all structures are so designed and located as to
conform as closely as possible to the yard and distance from lot line
requirements of this ordinance for the district in which the lot is located.
The subject property is located in District “C” one acre minimum and is a non-
conforming lot of record. The lot frontage is 109’, and the required minimum frontage
for District “C” is 150’. The gross lot area is 1.609 acres, and the required lot area is 1.0
acre. This is a vacant lot, the prior non-conforming home was built prior to 1945 and
was razed in 2018. The new home will be tied in to the sanitary sewer.
The proposed one-story dwelling will be located 200’ form the Miami Road right-of-way
line, where 75’ minimum is required; 20.5’ from the right south side yard lot line, 23.28’
from the left north side yard lot line where 20’ minimum is required; and 313.48’ from the
rear lot line where 75’ minimum is required.
Staff finds that per Section 81 of the Indian Hill Zoning Ordinance:
1. The lot is an official lot of record. The applicant submitted title work back to
March 28, 1945, showing this property existed in the same form since prior to the
adoption of the zoning ordinance on June 5, 1945;
2. The owner of the lot does not own any adjacent land; and
3. All structures are so designed and located as to conform as closely as possible
to the yard and distance from lot line requirements of the zoning ordinance for
District “C”. The proposed improvements meet all requirements of the zoning
ordinance.
Staff properly notified the adjacent property owners and was contacted by Mr. Schloss
at 5180 Miami Road. Mr. Schloss had concerns about how the water runs off the
subject property onto his property and the builder has agreed to work with him to find a
solution.
After brief discussion, Mr. Manning made a motion to approve the request. Mr.
Rhodenbaugh seconded, and the motion was approved by a unanimous roll call vote
with all in favor of approval.
There being no further business to come before the Commission, Mr. Rhodenbaugh
made a motion to adjourn. Mr. Manning seconded, and the motion was approved by a
unanimous voice vote.
