Michigan Ave. Three Rivers, MI 49093 The City's Zoning Board of Appeals was called to order in the commission chambers at Three Rivers City Hall with the following members: PRESENT: Chuck Friese, Zoning Board of Appeals Member Dave Miller, and Zoning Board of Appeals Member Dale Hoyt EXCUSED: Zoning Board of Appeals Member Ron Hudson and Andy Goldberger CALL TO ORDER ROLL CALL APPROVAL OF THE AGENDA a) Chuck Friese made a motion to approve the agenda, as presented. Zoning Board of Appeals Member Dale Hoyt seconded the motion. Carried unanimously. APPROVAL OF MINUTES a) Minutes of the previous ZBA meeting held March 12, 2025: Chuck Friese made a motion to approve the minutes, as presented. Zoning Board of Appeals Member Dale Hoyt seconded the motion. Carried unanimously. GENERAL COMMENTS PUBLIC HEARINGS a) Variance request for an accessory structure at 508 S. Lincoln Ave. Chairman Miller opened the public hearing at 12:02 p.m. Maria Montoya of 508 S. Lincoln presented her request in detail to the board. Emily Vargas of 508 S. Lincoln shared further details of the project. The public hearing closed at 12:04 p.m. Discussion by the board followed. Chuck Friese made a motion to grant the variance request for a pavilion at 508 S. Lincoln Ave. Zoning Board of Appeals Member Dale Hoyt seconded the motion. Carried unanimously. Michigan Ave. DATE: June 11, 2025 SUMMARY: Pregnancy Helpline of Three Rivers has ownership of property located on the North side of Michigan Avenue (between Joshua Dr. and River Dr.) at the identified address with the intention of constructing a covered entrance on the front of the corresponding building. The submitted application for a variance on the placement of the covered entrance with respect to yard setbacks has been reviewed by City Staff and it has been determined that the variance under consideration meets most of the requirements under Section 30-35(D)(2)(a) of the City Code. NARRATIVE: The size and configuration of the commercial lot on which the covered entrance (porch) has been proposed is indicative of a special condition potentially worthy of consideration for variance with respect to Part 1 of Section 30-35(D)(2)(a). There is one accepted literal interpretation of city zoning ordinance stipulations, as currently written in Three Rivers City Code, that would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this Chapter, following Part 2 of said section. No known actions taken by the applicant have resulted in special circumstances with respect to Part 3 of said section. The granting of the variance on the location of the proposed covered entrance in the front yard area, with respect to Part 4 of Section 30-35(D)(2)(a), would also not likely constitute a special privilege already denied for other applicants with similar structures in the same zoning district. Further, the granting of the variance in question would be in harmony with the general purpose and intent of the City’s Zoning Ordinance (Ch. 30), and would not be injurious to the neighborhood, or otherwise detrimental to the public welfare. ATTACHMENTS: Application for Variance Request, Zoning Permit, related documentation RECOMMENDATION: It is recommended that the Board of Appeals review the submitted application for variance request and, if it meets the requirements, move to approve the plan.
