The City's Zoning Board of Appeals was called to order in the commission chambers at Three
Rivers City Hall with the following members:
PRESENT: Chuck Friese, Andy Goldberger, Sarah McCarthy, and Tom Lowry
EXCUSED: Dave Miller
OPENING ITEMS
A. Call to Order:
Andy Golberger called the meeting to order at 12:02 p.m.
B. Roll Call:
As shown above.
Also present: Leslie Wilson, Joe Kline, Jewel Kilian, and John Beebe.
C. Welcome New Members:
The board welcomed new members, Sarah McCarthy and Tom Lowry.
INITIAL BUSINESS
A. Election of Officers:
Board Member Chuck Friese made a motion to nominate Tom Lowry as Board
Chair and Sarah McCarthy as Vice Chair. Board Member Andy Goldberger
seconded the motion. Carried unanimously.
B. Approval of Agenda:
Board Member Sarah McCarthy made a motion to approve the agenda, as
presented. Board Member Andy Goldberger seconded the motion. Carried
unanimously.
C. Approval of Minutes:
Board Member Chuck Friese made a motion to approve the minutes of the
September 10, 2025 meeting. Board Member Sarah McCarthy seconded the
motion. Carried unanimously.

Chair Lowry opened the meeting to public comment for any item not on the
agenda. Hearing none, the public comment portion of the meeting was closed.

PUBLIC HEARINGS
A. Variance request for a smaller business lot size at 419 S. Main Street.
The public hearing was opened by Chair Tom Lowry at 12:08 p.m.
The applicant, Mr. Jim Metty, introduced himself and his business associate
(Jerry Smith), and provided a statement of their intended use/plan for the
property.
Hearing no further comments, Chair Tom Lowry closed the public hearing at
12:11 p.m.
Board Member Chuck Friese made a motion to adopt the attached Findings
of Fact pertaining to the variance request application for 419 S. Main Street.
Board Member Sarah McCarthy seconded the motion. Carried unanimously.
Board Member Andy Goldberger made a motion to approve the requested
variance for 419 S. Main St. for lot size. Board Member Sarah McCarthy
seconded the motion. Carried unanimously.
OTHER BUSINESS / DISCUSSION
Discussion was held about follow up on compliance issues and follow up
procedure.

SUBJECT: Variance request for a fence at 607 E. Hoffman St. and 723 Portage Ave.
DATE: April 8, 2026
SUMMARY: Applicants (Spencer Fox and Bill Tessin) own adjoining properties located near the
intersection of Hoffman St. and Portage Ave. with additional frontage on Water Street (south
of Hoffman). The property owners have applied together with zoning permits for a fence on
their respective properties. At the recommendation of the Zoning Official, Mr. Fox and Mr.
Tessin have submitted an application for a variance on the height of the fence that is located
around the back of the two subject properties. The variance application and related
information has been reviewed by City Staff with a determination that the variance under
consideration meets most of the requirements under Section 30-35(D)(2) of the City Code.

RECOMMENDATION: It is recommended that the Board of Appeals review the submitted
application and, if it meets the requirements, move to approve the variance requests on the
height of the fence (along Water Street) for both properties under consideration.

Note: the following text may be replaced by, or supplemented with, a Findings of Fact (TBD)
NARRATIVE: The unique location and shape of both residential lots in question on which the
fence is located are indicative of a special condition potentially worthy of consideration for
variance with respect to Part 1 of Section 30-35(D)(2)(a). There is one known interpretation
of city zoning ordinance stipulations, as currently written in Three Rivers City Code, that
would deprive the applicant of rights commonly enjoyed by other properties in the same
zoning district under the terms of this Chapter, following Part 2 of said section. Also, while
actions have taken by the applicant resulting in special circumstances with respect to Part 3
of said section, the granting of this variance would be in harmony with the general purpose
and intent of the city’s zoning ordinance in accordance with Section 30-35(D)(2)(f).
Additionally, granting a variance on the size of the fence, with respect to Part 4 of Section
30-35(D)(2)(a), would not constitute a special privilege already denied to other residents and
for similar structures in the same zoning district. Furthermore, the granting of the variance
in question would be in harmony with the general purpose and intent of the City’s Zoning
Ordinance; Ch. 30, and would not be injurious or detrimental to the neighborhood or public
welfare.

(A) permit Reouired. No fence subjecl to the provisions ot this Chapter shall be constructed or erected without first
making an application for and securing a bnce permit.
(B) Locations. All bnces shall be located antirely upon the property of the person const ucling, or causing the
construction of a fence, unless the owner of the adlbining property agrees, in writing, that the fence may be adjoined
on the division line of the respective properties.'The Zoning Administrator may require any applicant ior a.fence
permit to establish the boundary lines of his or her property by a survey ofthe property made by a registered land
surveyor; and in lhe case ol a comer lot, both yards abutting a street shall be considered a front yard.
(c) Construction and Maintenance. Every fence shall be construcled in workmanlike manner and of substantial material
reasonably suited for the purpose for which the bnce is proposed to be used. Every fence shall be maintained in a
condition of reasonable repair and shall not be allowed to become and remain in a condition ofdisrepair, or to
constitute a nuisance. Any fence which is dangerous to the public safety, health or rrvellare is a public nuisance, and
the Zoning Administrator shall commenc€ proper proceedings br the abatement of the nuisance. Link iences in
residentialzones shall be construc{ed in a manner so that no barbed ends are at the top. Electric and baded wire
fences are prohibited in allzoning districts, except as specifically authorized under this Chapter.
(D) Enclosure ot Swimm inq Pool. F encing for swimming pools shsll be subject to the Building Code adopted by the City
(E) Residential Disbict F€nces.
(1) Boundary Line Fences. ln all parts of the City zoned Esidential, no boundary line feoce shall beBreded or
maintained mole than three (3') bet in height except that
(a) Fences on all corner lots erec{sd within thirty (30') feet of the intersecting property line shall be
subjec{ to Seclion 30-168 regarding traffic visibility.
(b) Subject to other restrictions contained wilhin this Seclion, fences may be constructed to a height of
six (6') feet on or along the side yard property line ftom the rear lot line to the fiont building line of
the principal struc{ure.
(c) Fences along any rear property line which is also the rear property line of an abutting lot or alley
may be construcled to a height of six (6') bet.
(d) Fences along a rear property line which constitutes the side lot lines of an abutting lot shall not
exceed six (6') feet in height fur a distance as calculated in (E)(l)(b) above and shall not exceed
three (3') feet in height when abuttiog a front yard line.
(e) ln lhose instances where a boundary line fence eiists as an enclosure which restricts accass ftom
the property, a gate, identifiable mllapsible section, or other such means of recogn2able ingress
shall be provided for emergency vehicles. Such ingress points shall be unobstruc{ed and a
minimum of ten (10') feet in width. The location ofsuch ingress points shall be positioned at any
point paralleling the front lot line bet$/een lhe side lot property line and the principal structure.
(2) lnterior Yard Fences.
(a) Any fence erected within any portion ol lhaID front yard shatt not exceed four (4') teet in
height. All other types of bnces within any portion of the required front year shall not exceed three
(3') feet in height. All fences shall conform to Section 3G169) regarding traffic vrsibility.
(b) \Afthan a side or rear yard, a fence up to six (6') feet an height may be erecled as a lotalenclGsure.
(c) Chain link fences (without slat screens) used for the enclosure of tennis courts or other such
rec.eational puposes shall not exceed ten (10 ) feet in height and shall be located in a rear yard
only.

(B) ln general, any roofing material may be used that is generalty acceptable materaal il applied in a
manner consistent \ /ith other dwellings in the vicinity.
(C) The dwelling shall have a roof overhang of not less than six (6") inches on all sides, or alternatively,
window sills or roof drainage systems concentrating roof drainage at collection points along the
sides of the dwelling.
(D) The dwelling shall have not less than two (2) exterior doors, one (1) of which shall be at the rear or
side of the dwelling. Steps to exterior doors shall be provided where a difference in elevation exists
between the bottom of the door and the ground.
(E) Any materials that are generally acceptable as determined by dwelling units in the vicinity may be
used ior exterior finish if applied in such a manner as to be similar in appearance provided,
howeYer, that reflection from such exterior shall not be greater than from siding coated with clean,
white, gloss, exterior enamel.
(F) The compatibility of design and appearance shall be determined in the first instance by the Zoning
Adminislrator upon review of the plans submitted for a particular dwelling. Plans which do not
conform to the standards of this Chapter shall be submitted for sile plan review and approval in
accordance with kion 30-36.
(G) Any determination of compatjbility shall be based upon the standards set forth in this definition of
"Dwelling Single Family" as well as the character, design and appearance of one (1) or more
residential dwellings located outside of mobile home communities and within twethousand (2,000')
feet ot the subject dwelling where the area is developed with dwellings to the extent of not less than
twenty (20%) percent of the lots situated within the area; or, where the area is not so developed, by
the character, design and appearance of one ( 1) or more residential dwellings located outside of
mobile home communities throughout the City. The foregoing shall not be construed to prohibit
innovative design mncepts involving such matters as solar energy, view, unique land contour, or
relief from the common or standard designed home.
(8l The dwelling contains no additions or rooms or other areas which are nol constructed with similar quality
workmanship as the original struclure, including permanent attachment to the principal structure and
construction of a foundation as required by this Chapter.
(9) The dwelling complies with all applicable building and fire codes. ln the case of a mobile home, all
construclion and allplumbing, electrical apparatus and insulation within and connected to the mobile home
shall be on a type and quality conforming to the "Mobile Home Construction and Safety Standards" as
promulgated by the United States Department of Housing and Urban Development, being 24 CFR 3280, and
as those standards may be amended from time to time. All dwellings shall meet or exceed all applicable
roof snow load and slrength requirements.
(10) The foregoing standards shall not apply to a mobile home located in a licensed mobile home community
except to the eltent required by State or Federal law or otherwise specifically required in this Chapter.
(11) All construction required herein shall be commenced only after a building permit has been obtained in
accordance with applicable City building code provisions and requirements.
Dwelling - Two Family means a building containing not more than two (2) separate dwelling units designed for
residential use and conforming in all other respeds 10 the standards set forth in the defnition for "Owelling Single
Family".
Dwelling Unit means a residenlial building or portion thereof intended for occupancy by a family, but not including
bed and breakfasts, hotels, motels, nursing homes, seasonal cabins, boarding or roorning houses, tourist homes' or
trailers.
Efticiency Apartment means a dwelling unit consisting of one (1) principal room exclusive of bathroom, hall\'Yay,
closets, or dining alcove.
Essential Services means the erectjon, construction, alteration, or maintenance of underground or overhead gas,
electrical, steam, or water transmission or distribution systems, collection. communication, supply or disposal
systems by public utilities, municipal or other govemmental agencies, but not including buildings. Communication
Towers are not defined as an essential service.
Family means a person living alone, or two (2) or more persons customarily living together as a single housekeeping
unit in a dwelling unit as distinquished from a group occupying a hotel, club, rehgious or instilutional bulldrng,
boarding or lodging house, or fraternity or sorority house.
Fence means any portion structure, wall or gate erected as a dividing marker, banier, or enclosure.
