RECORDS OF PROCEEDINGS Village of Timberlake Council Regular Meeting Held at the Village of Timberlake Hall at 6:30 PM May 17, 2022 Mayor John Marra presiding. Roll Call of Council Members Present: Ryan Konrad, Nancy Marra, Dr. Sharma, Kevin Thompson; Cynthia Hardwick was absent (excused). Personnel in Attendance: James O’Leary Solicitor John H. Roskos Fiscal Officer (Absent, excused) Sue Scofield Chief, Police Department Gary Gray Zoning Opening of Meeting 6:30 PM Meeting began at 6:30 PM with the pledge of allegiance, and the Mayor’s opening prayer. Public Comment, Good & Welfare: Comments from the public: Jane Shaveyco (14 East Shore)- Read letter written by by Gregg Transky of 57 East Shore Blvd; letter provided history of resident Mrs. Van Dusen, and the many contributions she made to the life of the Village, and talked about the tree planted in her honor on the grass island in front of Parcel A. Suggested another tree should be planted to replace it. Also spoke of parking issues caused by Village Hall rentals. He is against paving over the grass island for additional parking. Debbie Shaveyco (12 East Shore)- Spoke against paving over the grass island, as well. Hollie Goddard (10 East Shore)- Read a letter from residents inquiring about April 19 Council Meeting, and Resolution 2022-23 and why it was considered an emergency measure. Also, inquired of purpose of paving over grass island, and what issues would necessitate that; asked how many spaces would be gained et cetera. Gave suggestions for alternative use of funds. Debbie King (43 East Shore)- Agrees with previous comments about parking over grass island. Thinks that center strips should be mowed by residents again (along with taking care of weeds); would help lower Service Department costs. Reading & Disposition of the Minutes: a. Regular Council Meeting 4/19/2022- a motion was made by Mr. Konrad to approve the April 19, 2022 minutes; seconded by Dr. Sharma. Roll call; all members of Council present voted in favor. Legislation: nd a.) Ordinance No. 5-2022 (2 Reading) An ordinance addressing the provisions of Amended Substitute HB 172 concerning the right of municipalities to retain the regulations and prohibitions on the discharge, ignition, and exploding of fireworks that existed prior to the enactment of Amended Substitute HB 172 and declaring an emergency. Ordinance No. 5-2022 was presented for Second Reading. b.) Ordinance No. 6-2022 (1st Reading) An ordinance authorizing the creation of the rank of Detective Sergeant within the Timberlake Police Department, and declaring an emergency. Ordinance No. 6-2022 was presented for First Reading. c.) Resolution No. 2022-25 (Rules Suspended) A resolution authorizing the Mayor to promote certain Police Officers of the Police Department, and declaring an emergency. A motion was made by Mrs. Marra to suspend the three reading rule; seconded by Mr. Thompson; all were in favor of suspending the rules. A motion was made by Mrs. Marra to approve Resolution No. 2022-25; seconded by Mr. Thompson. Mr. Thompson inquired as to the purpose, and whether this is ongoing or just for certain police officers at present time; this is only a particular instance per the Mayor. Mr. Konrad spoke about having promotions being an administrative duty only, and asked who is being promoted (Sgt. Brown to Lt. Brown). Roll call: all were in favor of the Ordinance. Department Reports: a. Mayor: Has been difficult to mow due to the rain; does like Mrs. King’s idea to ask residents to mow center strips. Mayor said it is difficult to get everyone onboard, however; he did ask for volunteers to spray weed killer if possible (later rescinded idea after additional discussion). Mr. Thompson inquired as to whether this had been done previously. Mayor indicated that Jerry Fox used to spray. Mr. Thompson expressed concerns about residents walking animals near toxins. Mayor spoke about issues with parking on the median. b. Solicitor: Nothing to report; will be out of town a few days next week, however. c. Council Members: Cynthia Hardwick (absent)- See Mrs. Marra’s report Ryan Konrad- Nothing to report; sewers have been doing their job, in spite of heavy rainfall. Did get quotes for grates; other than that, everything copacetic. Does appreciate feedback, and camaraderie of the community; thinks having residents cut the median is also a good idea. Talked about issues with weeds. Nancy Marra- Hall is booked, and busy. There have been a couple issues with people trying to rent the Hall that are not residents; residents must be present for event. Also spoke about grass island, and parking issues at Hall; same problem has existed since Hall was built. Talked about ideas from residents of monitoring people coming to Beach. (Note from Fiscal Officer- some of audio was inaudible and could not be transcribed). Dr. Ritu Sharma- Thanked the Chief, and Mr. Konrad for sharing information about grants. Had a meeting with Pete Formica about OPWC grants, preliminary application and the scoring system. Last year asked for $90,200; half would have been paid by Village. 2021 Storm Sewer Basin Grant- missed by 3 points; Village received 62 points- we needed 65 points. Will pursue Catch Basin grant again. OPWC grant deadline is May 27. Sidewalk Grant would be 40% for planning, 60% for construction; deadline is September 15. Also spoke with the Chief about the Body Camera Grant; police department will pursue. Kevin Thompson- Observed some cracks, and divots in roadway; gave list to Mayor. Our engineer will take a look at, and put together a plan to address. d. Fiscal Officer (absent): Monthly Financials (presented by Mayor Marra)- General Fund- ending balance through April 30 is $276,652.25, after accounting for committed or encumbered expenses. Month to date revenue was $57,198.01 vs expenditures of $46,442.04, a net difference of $10,755.97. There were no significant expenditures in our remaining funds ($582 was paid out of our 9901 Hall Rental Security Deposit Refund FUND- one was a partial refund for $82.00). General Fund Revenue through April 30, 2022 is up $48,981.21 versus last year, primarily due to increased income, and property tax collection. Estimated end of year surplus based on current expenditure rates will be approximately $39,000; this would not include transfers to the Village Hall, and Police Cruiser Capital Fund of $20,000 each. With those transfers, the Village would be looking at a deficit of approximately $1,000 for the year. e. Police Chief: For the month of April- 1 911 call, 1 accident complaint, 4 administrative referrals, 1 alarm call, 3 animal complaints, 4 assistance calls, 37 community policing events (beach checks, playground checks), 1 disturbance, 1 hazard  complaint, 158 house checks, 11 investigations, 1 phone complaint, 1 prowler complaint, 2 suspicious circumstances, 1 suspicious person, 1 threat complaint, 1 traffic citation, 1 traffic complaint, 1 vandalism complaint, and 1 welfare check; a total of 233 calls. e. Zoning/Property Maintenance- Mr. Gray- 3 driveway, 1 siding, 1 window permit this month. Purchases & Approvals: a. A motion to approve the April, 2022 Financial Reports. Dr. Sharma made a motion to approve the April Financial Reports. Mrs. Marra seconded the motion. Roll call: all members present voted in favor. Public Comment and Questions (may be directed at the Mayor or Council members only; reserved for follow-up questions on topics discussed at today’s meeting): Jane Shaveyco (14 East Shore)- Complimented the Service Department for cleaning up the hill by the Beach, enabling better visibility for residents. Spoke about Parcel A, and how it should be for only park and beach. Believes we should replace the tree that was taken down. According to her, many residents are in favor of this. In order to spread fertilizer on public land, you need to have someone with a license complete the work. Later asked if sign on the other side of the fence can be removed; discussion followed; also spoke near end of meeting about Hall Rentals, plowing, parking, ruts, drainage et cetera (additional discussion followed). Debbie King (43 East Shore)- Heard a rumor about people climbing over fence, or breaking lock at the Beach; is this true? (Someone is trying to open the gate now; Chief is investigating). Mayor says residents need to call Central Dispatch if they see someone attempting to trespass; this creates a record, so it can be addressed. Mayor has received complaints after the fact about people climbing the fence, but nothing can be done unless it is reported immediately (If you see something, say something). Further input from the Mayor, residents, and Council about this issue occurred; Mr. Konrad indicated the new gate is already bent. Hollie Goddard (10 East Shore)- Inquired again about why Resolutions in April were listed as emergency measures. Why was Renewal Levy Measure considered an emergency? Mayor indicates that it needs to be placed on the ballot. Mr. O’Leary indicated that the Resolution undergoes scrutiny by the Board of Elections; did not want to be in a situation, where we would not have enough time to make changes, if it was required. She is concerned about use of emergency clause. Mayor reviewed Resolution regarding bids for paving the grass island. Was not for any other reason; would still need a committee meeting to discuss. Mrs. Goddard made additional related comments; Mayor indicated that bids were too high, and project will not go forward. There was additional discussion (See also above under Jane Shaveyco). Adjournment Mr. Konrad made a motion to adjourn the meeting; Dr. Sharma seconded the motion.
