MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, FEBRUARY 18, 2010 6:30 P.M. 1.0 Call to Order at 6:38 p.m. The meeting was called to order by Chairman Ford. Other members present were: Board Member Ross Board Member Tomlinson Board Member Tynes Alternate Board Member Tague Board Member Shannon – Excused Absence Others present: City Planner / Community Development Coordinator – Kelly Violette Engineering & Planning Senior Administrative Assistant – Brandy Pate Assistant City Planner – Rodney Schmidt 2.0 No Public Comments were received. 3.0 Reports & Announcements Kelly Violette, City Planner / Community Development Coordinator announced the following: • March 18, 2010 at 6:30 p.m. – Special Board of Adjustments Meeting • Results of February 15, 2010 City Council Meeting. • Chairman / Vice Chairman Elections to be held on March 18, 2010 Meeting • Final Comp Plan Document Distributed Chairman Ford announced Board Member Latrell Shannon’s last meeting as a member of the Board of Adjustments and wished to present her with a Certificate of Appreciation for her time and service on the Board. 4.0 Motion was made by Board Member Ross to Approve the Minutes of the Special Board of Adjustments Meeting of November 19, 2009 and November 23, 2009; second by Board Minutes Special Board of Adjustments Meeting February 18, 2010 Page 2 of 3 Member Tynes. Motion carried unanimously. 5.0 New Business 5.1 Kelly Violette, City Planner provided presentation of the Board of Adjustments 2009 Annual Report. 5.2 Consideration and Possible Action Regarding BOA Case P10-189: Request by Minh Nguyen for a variance from Section 42.4 (C) of the City of Tomball Comprehensive Zoning Ordinance, to allow a gate designed for vehicular access to be set back from the property line fifteen (15) feet, where a minimum of twenty-five (25) feet is required. The project site is an approximately 0.205 acre lot located at 31223 Polaris Boulevard, Tomball, TX, 77375. The Public Hearing regarding BOA Case P09-189 was opened at 6:48 p.m. Kelly Violette, City Planner provided staff report. Donald Tram, representative for owner, Minh Nguyen spoke on behalf of the request. The following residents spoke and stated no objection to the request: Billy Hemby - 14127 Polix Court Marge Harris - 14215 Orion The Public Hearing was closed at 7:02 p.m. Board Member Tynes made a motion to Approve BOA Case P09-189; second by Board Member Tague. The vote was as follows: BOARD MEMBER ROSS AYE BOARD MEMBER TOMLINSON AYE BOARD MEMBER SHANNON AYE BOARD MEMBER TYNES AYE BOARD MEMBER FORD AYE Motion carried unanimously. 6.0 Motion was made by Board Member Tomlinson to adjourn; second by Board Member Tague. Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday, February 18, 2010 at 6:30 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items.
