MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, APRIL 15, 2010 6:30 P.M. 1.0 Call to Order at 6:42 p.m. The meeting was called to order by Chairman Ford. Other members present were: Board Member Tomlinson Board Member Tynes Board Member Ross Alternate Board Member Tague Alternate Board Member Hemby Alternate Board Member Chervenak Board Member Lynch – Excused Absence Others present: Director of Engineering & Planning – Mark McClure City Planner / Community Development Coordinator – Kelly Violette Engineering & Planning Senior Administrative Assistant – Brandy Pate Assistant City Planner – Rodney Schmidt City Attorney – Scott Bounds 2.0 No Public Comments were received. 3.0 No Reports or Announcements were received. 4.0 Motion was made by Board Member Tomlinson to Approve the Minutes of the Special Board of Adjustments Meeting of March 18, 2010; second by Board Member Tynes. Motion carried unanimously. 5.0 New Business 5.1 Consideration and Possible Action Regarding BOA Case P10-215: Request by Halmude Naumann Jr. for four variances from Sections 14.4(B.1), 14.4(B.3), 14.4(C), and 41.2(1) of the City of Tomball Zoning Ordinance related to the proposed conversion of two existing carports into enclosed storage structures. Variances Minutes Special Board of Adjustments Meeting April 15, 2010 Page 2 of 2 requested: 1). To allow a 30 foot 7 inch front yard setback where a minimum 60 foot front setback is required; 2). To allow a 12 foot 5 inch rear yard setback where a minimum 25 foot rear yard setback is required; 3). To allow 45% lot coverage where the maximum lot coverage permitted is 40%; and 4). To allow an accessory structure in front of the main building. The project site is an approximately 0.6322 acre lot located at 1034 Pitchford Road, Tomball, Texas, within the AG-Agricultural District. The Public Hearing regarding BOA Case P10-215 was opened at 6:44 p.m. Rodney Schmidt, Assistant City Planner provided staff report. Owner / Applicant, Halmude Naumann Jr. spoke on behalf of the request. No comments were received and the Public Hearing was closed at 7:24 p.m. Board Member Ross made a motion to DENY BOA Case P10-215; second by Board Member Tague. The vote was as follows: BOARD MEMBER ROSS AYE BOARD MEMBER TOMLINSON NAY BOARD MEMBER TAGUE AYE BOARD MEMBER TYNES AYE BOARD MEMBER FORD AYE Motion to DENY carried 4-1 6.0 Motion was made by Board Member Tague to adjourn; second by Board Member Tomlinson. Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday, April 15, 2010 at 6:30 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items.
