MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, APRIL 21, 2011 6:30 P.M. 1.0 Call to Order at 6:31 p.m. The meeting was called to order by Chairman Ford. Other members present were: Board Member Ross Board Member Tomlinson Board Member Tynes Alternate Board Member Chervenak Excused Absence: Board Member Lynch Others present: Assistant City Planner – Rodney Schmidt Assistant City Engineer – Lori Lakatos City Attorney – Loren Smith Engineering & Planning Senior Administrative Assistant – Brandy Pate 2.0 No Public Comments were received. 3.0 Motion was made by Board Member Tynes to Approve the Minutes of the Special Board of Adjustments Meeting of December 16, 2010; second by Board Member Tomlinson. Motion carried unanimously. 4.0 New Business 4.1 Consideration and Possible Action Regarding BOA Case P11-310: Request by Greg Beirsdorfer for a variance and a special exception to the City of Tomball Comprehensive Zoning Ordinance: 1) a variance for a reduction in the off-street parking requirements established in Section 38.2 to allow 3 parking stalls where the Zoning Ordinance requires 10 parking stalls for a proposed use as “Contractor’s Office/Sales, No Outside Storage including Vehicles” facility and 2) a special exception to not require concrete curbing along the perimeter of the parking lots and driveways as required in Section 39.3.F. The project site is located at 219 North Sycamore Street, Tomball, Texas, 77375, legally described as Reserve 1, Block 1 as Minutes Special Board of Adjustments Meeting April 21, 2011 Page 2 of 3 shown on the “Sycamore Street” replat, generally located on the southerly side of Houston Street, easterly of North Sycamore Street in the OT & MU – Old Town and Mixed Use District. The Public Hearing regarding BOA Case P11-310 was opened at 6:34 p.m. Rodney Schmidt, Assistant City Planner provided a staff report. Applicant, Greg Beirsdorfer, spoke on behalf of the request. The Public Hearing was closed at 6:40 p.m. Board Member Ross made a motion to Approve the Variance for BOA Case P11- 310; with the following condition: 1. Property owner shall not park more than two work vehicles at the subject site at any given time. Second by Board Member Tynes. The vote was as follows: BOARD MEMBER ROSS AYE BOARD MEMBER TOMLINSON AYE BOARD MEMBER FORD AYE ALT. BOARD MEMBER CHERVENAK AYE BOARD MEMBER TYNES AYE Motion to Approve carried 5-0 Board Member Tomlinson made a motion to Approve the Special Exception for BOA Case P11-310; with the following condition: 1. The property owner shall provide 8 additional trees on site per Section 40 “Landscape Requirements” of the Zoning Ordinance. Second by Board Member Ross. BOARD MEMBER CHERVENAK AYE BOARD MEMBER TYNES AYE Motion to Approve carried 5-0 Minutes Special Board of Adjustments Meeting April 21, 2011 Page 3 of 3 6.0 Motion was made by Board Member Ross to adjourn; second by Board Member Tomlinson. Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday, April 21, 2011 at 6:30 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action. The Board of Adjustments reserve the right to meet in a closed session for consultation with attorney on any agenda item should the need arise and if applicable pursuant to authorization by Title 5, Chapter 551, of the Texas Government Code. 1.0 Call to Order 2.0 Public Comments and Receipt of Petitions (At this time, anyone will be allowed to speak on any matter other than personnel matters or matters under litigation, for length of time not to exceed three minutes.
