1.0 Call to Order at 6:30 p.m.
The meeting was called to order by Chairman Ford. Other members present were:

Board Member Tomlinson
Board Member Ross
Alternate Board Member Gray
Excused Absence:

1.1 Election of Chairman and Vice Chairman
Board Member Tomlinson made a motion to nominate John Ford as Chairman;
second by Board Member Tynes.
Motion carried unanimously.
Board Member Tomlinson made a motion to nominate Brett Tynes as Vice Chairman;
second by Alternate Board Member Gray.
Motion carried unanimously.
2.0 No Public Comments were received.
3.0 Motion was made by Board Member Tynes to Approve the Minutes of the Special Board of
Adjustments Meeting of April 12, 2012; second by Alternate Board Member Gray.
Motion carried unanimously.

4.0 New Business
4.1 Consideration and Possible Action Regarding BOA CASE P12-420: Request by
Emil Haddad, on behalf of Ralph Shepherd for a variance from Section 30.4.A.3
(“Minimum Lot Depth”) of the City of Tomball Comprehensive Zoning Ordinance to
create a new lot being a minimum of approximately 69.95 feet in depth where 100
feet in lot depth is required in the Commercial District. The project site is
approximately 0.29 acres, legally described as Tracts 25E-3A, 25E-3B, and 25E-4A,
Abstract 34, Joseph House Survey, within the City of Tomball, Harris County, Texas,
generally located southerly of Keefer Street, westerly of Buvinghausen Street.
The Public Hearing regarding BOA Case P12-420 was opened at 6:34 p.m.
Rodney Schmidt, Assistant City Planner, provided a staff report.
Emil Haddad of E.I.C. Surveying spoke on behalf of the request.
Applicant, Ralph Shepherd, spoke on behalf of the request.
The Public Hearing was closed at 6:44 p.m.
Board Member Tynes made a motion to approve BOA Case P12-420; second by
Board Member Ross.
The vote was as follows:

Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday, April
12, 2012 at 6:30 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of
considering the following agenda items. All agenda items are subject to action. The Board of
Adjustments reserve the right to meet in a closed session for consultation with attorney on any
agenda item should the need arise and if applicable pursuant to authorization by Title 5,
Chapter 551, of the Texas Government Code.
1.0 Call to Order

2.0 Public Comments and Receipt of Petitions (At this time, anyone will be allowed to speak on
any matter other than personnel matters or matters under litigation, for length of time not to
exceed three minutes. No Board discussion or action may take place on a matter until such
matter has been placed on an agenda and posted in accordance with law.)
3.0 Approval of the Minutes of Special Board of Adjustments Meeting of July 21, 2011.
