MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, JANUARY 24, 2013 6:30 P.M. 1.0 Call to Order at 6:30 p.m. The meeting was called to order by Chairman Ford. Other members present were: Board Member Tynes Board Member Ross Board Member Hemby Board Member Lynch Alternate Board Member Wolfe Alternate Board Member Roquemore Others present: City Manager – George Shackelford Acting City Engineer – Lori Lakatos City Planner – Rebeca Guerra Assistant City Planner – Rodney Schmidt City Attorney – Loren Smith Engineering & Planning Senior Administrative Assistant – Brandy Pate 2.0 No Public Comments were received. 3.0 Reports and Announcements:  Rodney Schmidt presented the Board of Adjustments 2012 Annual Report 4.0 Motion was made by Board Member Tynes to Approve the Minutes of the Special Board of Adjustments Meeting of December 13, 2012; second by Board Member Hemby. Motion carried unanimously. 5.0 New Business: 5.1 Consideration to approve BOA Case P12-536: Request by Livengood Feeds, Inc., on behalf of E.L. Chapman, for a variance from Section 27.4.E of the City of Tomball Comprehensive Zoning Ordinance to allow an outside storage area to be 38% of the total lot area where a maximum of 5% is allowed in the General Retail District. The Minutes Special Board of Adjustments Meeting January 24, 2013 Page 2 of 2 project site is approximately 0.71 acres, generally located on the easterly side of State Highway 249 Expressway, northerly of Hirschfield Road at 13918 Hirschfield Road, and is legally described as Tract 4, Block 3, Hirschfield Farms Section 1 (Unrecorded). The Public Hearing regarding BOA Case P12-536 was opened at 6:33 p.m. Rebeca Guerra, City Planner, provided a staff report. Applicant, E.L. Chapman spoke on behalf of the request. No Public Comments were received. The Public Hearing was closed at 6:36 p.m. Board Member Tynes made a motion to approve BOA Case P12-536; second by Board Member Ford Board Member Tynes amended his motion to include a condition that the use shall be limited to Feed and Grain / Farm Supply Store; second by Board Member Ford. The vote was as follows: BOARD MEMBER ROSS AYE BOARD MEMBER HEMBY AYE BOARD MEMBER LYNCH AYE BOARD MEMBER TYNES AYE BOARD MEMBER FORD AYE Motion to Deny carried, 5-0. 6.0 Motion was made by Board Member Lynch to adjourn; second by Board Member Tynes. Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday, January 24, 2013 at 6:30 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action.
