MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, NOVEMBER 13, 2014 6:00 P.M. 1.0 The meeting was called to order by Chairman Ford at 6:07 p.m. Other members present were: Board Member Wolfe Board Member Hemby Board Member Tynes Board Member Gray Others present: Community Development Director – Craig Meyers City Engineer – Lori Lakatos City Planner – Harold Ellis City Attorney – Loren Smith Community Development Coordinator – Amelia Vasquez 2.0 No Public Comments were received. 3.0 No Reports and Announcements were received. 4.0 Motion was made by Board Member Tynes, second by Board Member Hemby, to approve the Minutes of Special Board of Adjustments Meeting of October 9, 2014. Motion carried unanimously. 5.0 New Business: 5.1 Consideration to approve BOA Case P14-219: Request by R.G. Donley for a variance from Section 50-69(d)(2)(b) of the City of Tomball Code of Ordinances to allow a structure to be 10-feet from the side property line where Section 50- 69(d)(2)(b) of the Code of Ordinances requires a 25-foot side building setback in the Single-Family Estate Residential-20 (SF-20) District. The project site is approximately 5 acres, generally located southerly of Zion Road, easterly of Rudolph Street, at 1442 Rudolph Road, is zoned SF-20 District, and is legally described as Lot 26, Tomball Outlots. Harold Ellis, City Planner, presented the staff report and recommendations. Minutes Special Board of Adjustments Meeting November 13, 2014 Page 2 of 2 Applicant and owner R.G. Donley (1442 Rudolph Rd., Tomball, TX 77375) spoke on behalf of the request. The Public Hearing was opened by Chairman Ford at 6:15 p.m. Ruben DeLeon (1450 Rudolph Rd., Tomball, TX 77375) spoke in favor of the request. N. Breaux (1502 Rudolph Rd., Tomball, TX 77375) did not wish to speak but was in support of the case. Hearing no additional comments, the Public Hearing was closed at 6:17 p.m. Motion was made by Board Member Tynes to approve BOA Case P14-219; second by Board Member Hemby. Vote was as follows: Chairman Ford Aye Board Member Wolfe Aye Board Member Hemby Aye Board Member Tynes Aye Board Member Gray Aye Motion carried; 5 votes Aye, 0 votes Nay. 6.0 Motion was made by Board Member Hemby, second by Board Member Gray to adjourn.
