MINUTES OF SPECIAL BOARD OF ADJUSTMENTS MEETING CITY OF TOMBALL, TEXAS THURSDAY, SEPTEMBER 14, 2017 6:00 P.M. 1.0 The meeting was called to order by Chairman Brett Tynes at 6:00 p.m. Other members present were: Board Member April Gray Board Member Tina Roquemore Board Member Jarmon Wolfe Board Member Billy Hemby Others present: Community Development Director – Craig Meyers City Attorney – Loren Smith Planner – Amelia Lindley Assistant City Engineer/Board Secretary – Wesley Stolz 2.0 No Public Comments were received. 3.0 Amelia Lindley, Planner, announced the following: • The next BOA meeting will be held on October 12th, 2017. • There are still two alternative board member positions vacant. 4.0 Motion was made by Board Member Roquemore, second by Board Member Gray, to approve the Minutes of Special Board of Adjustments Meeting of July 13, 2017. Motion carried unanimously. 5.0 New Business: 5.1 Consideration to approve BOA Case P17-0103: Request by Richard Tomlinson for a variance from Section 50-70(d)(1) (Area regulations) to allow a lot to have a minimum of 75 feet in lot depth where 100 feet in lot depth is required and a variance from Section 50-70 (d)(2) (Size of yards) to allow a 10 foot rear yard setback where a 15 foot setback is required. The project site is approximately 0.38 acres, legally described as Lots 102A & 102B Tomlinson Tract, Tomball, Harris County, Texas, generally located on the south side of Turner Vine Lane, and is zoned Single-Family 9 District.  Minutes Special Board of Adjustments Meeting September 14, 2017 Page 2 of 3 The Public Hearing was opened by Chairman Tynes at 6:03 p.m. Amelia Lindley, Planner, presented the staff report and recommendation of approval. Richard Tomlinson, applicant, (32143 River Park Drive, Magnolia Texas 77355) spoke on behalf of the request. Hearing no comments, The Public Hearing was closed at 6:08 p.m. Motion was made by Board Member Hemby, second by Board Member Wolfe, to approve BOA Case P17-0103. Vote was as follows: Chairman Brett Tynes Aye Board Member April Gray Aye Board Member Tina Roquemore Aye Board Member Jarmon Wolfe Aye Alternate Board Member Robert Maxwell Aye Motion carried unanimously. 5.2 Consideration to approve BOA Case P17-0104: Request by Maricsa Villasenor for a variance from Section 50-71 (d)(2) (Size of yards) to allow a 2.5 foot side setback on each side where a 5 foot setback is required. The project site is approximately 0.080 acres, legally described as Lot 29 Block 90 Tomball, Harris County, Texas, generally located on the north side of Foster Street, east of Willow Street and is zoned Single- Family 6 District. The Public Hearing was opened by Chairman Tynes at 6:10 p.m. Amelia Lindley, Planner, presented the staff report with the inability to recommend approval. Maricsa Villasenor, Applicant, (12518 Lacey Crest Drive, Houston Texas 77070) spoke on behalf of the request. Pablo Varza, on behalf of the applicant, (9100 Mills Road, Houston, Texas 77070) spoke on behalf of the request. Hearing no comments, The Public Hearing was closed at 6:15 p.m. Motion was made by Board Member Roquemore, second by Board Member Hemby, to approve BOA Case P17-0104.
