MINUTES OF
SPECIAL BOARD OF ADJUSTMENTS MEETING
CITY OF TOMBALL, TEXAS
THURSDAY, SEPTEMBER 13, 2018
6:00 P.M.
1.0 The meeting was called to order by Vice Chairman Billy Hemby at 6:02 p.m. Other members
present were:
Board Member Jarmon Wolfe
Board Member April Gray
Alternate Board Member Cindy Phillips
Others present:
Community Development Director – Craig Meyers
City Attorney – Loren Smith
Planner – Amelia Lindley
Assistant City Engineer – Wesley Stolz
Board Secretary – Elizabeth Jones
2.0 No Public Comments were received.
3.0 Craig Meyers, Community Development Director, announced the following:
• There will not be a Board of Adjustment meeting in October.
4.0 Motion was made by Board Member Phillips, second by Board Member Gray, to approve the
Minutes of Special Board of Adjustments Meeting of August 9, 2018.
Motion carried unanimously.
5.0 New Business:
5.1 Consideration to approve BOA Case P18-126: Request by Industrial Reserve LLC
for a variance from Section 50-77 (d)(2) (Size of yards) to allow a 10 foot side
setback where a 60 foot setback is required. The project site is approximately 1.852
acres, legally described as Tracts 196B-2, 196C-2, 196D-2, 196E-2 & 200A-2
Tomball Outlots, generally located at the northwest corner of Theis Road and South
Cherry Street and is zoned Commercial District.
The Public Hearing was opened by Vice Chairman Hemby at 6:04 p.m.
Amelia Lindley, Planner, presented the staff report with a recommendation of denial

for the area variance request.
Brant Landry, Applicant (6329 Pimberton, Dallas, Texas) spoke on behalf of the
request.
Rob Hauck, local property owner (1820 S. Cherry, Tomball, Texas 77375) spoke in
support of the request.
Hearing no additional comments, The Public Hearing was closed at 6:13 p.m.
Motion was made by Board Member Wolfe, second by Board Member Phillips, to
approve BOA Case P18-126. Vote was as follows:

Board Member April Gray Aye
Alternate Board Member Cindy Phillips Aye
Motion carried unanimously.
6.0 Motion was made by Board Member Phillips, second by Board Member Gray, to adjourn.
Motion carried unanimously.
The meeting was adjourned at 6:17 p.m.

Notice is hereby given of a meeting of the Board of Adjustments, to be held on Thursday,
September 13, 2018 at 6:00 p.m., at City Hall, 401 Market Street, Tomball, Texas 77375, for the
purpose of considering the following agenda items. All agenda items are subject to action. The
Board of Adjustments reserve the right to meet in a closed session for consultation with
attorney on any agenda item should the need arise and if applicable pursuant to authorization
by Title 5, Chapter 551, of the Texas Government Code.
1.0 Call to Order
2.0 Public Comments and Receipt of Petitions (At this time, anyone will be allowed to speak on
any matter other than personnel matters or matters under litigation, for length of time not to
exceed three minutes. No Board discussion or action may take place on a matter until such
matter has been placed on an agenda and posted in accordance with law.)
