MINUTES OF CHARTER REVIEW COMMISSION MEETING CITY OF TOMBALL, TEXAS WEDNESDAY, SEPTEMBER 20, 2023 6:00 P.M. The City Council of the City of Tomball, Texas, conducted the meeting scheduled for September 20, 2023, 6:00 PM, at 401 Market Street, Tomball, Texas 77375, via physical attendance and video/telephone conference. 1.0 Chair T. Ross called the meeting for the Charter Review Commission to order at 6:00 p.m. 1.1 Roll Call and Introductions PRESENT: Commissioner Browning Commissioner Clepper Commissioner Degges Commissioner Fagan Commissioner Harris Commissioner Hendrickson Commissioner Johnson Commissioner Kelley Commissioner Pye Commissioner Reidel (via zoom) Commissioner Shannon ABSENT: Commissioner Harvey OTHERS PRESENT: Loren Smith, City Attorney Tracylynn Garcia, City Secretary Sasha Luna, Assistant City Secretary 1.2 Administer Oaths of Office to Commission Members was done by Assistant City Secretary S. Luna. 1.3 City Attorney L. Smith provided comments and Charge of the City Council to the Charter Review Commission Minutes Charter Review Commission Meeting September 20, 2023 Page 2 of 3 1.4 Election of Vice-Chair Motion made by Commissioner Kelley to appoint Commissioner G. Fagan as Vice Chair, seconded by Commissioner Harris. Motion made by Commissioner Clepper to appoint Commissioner A. Johnson as Vice Chair, seconded by Commissioner Kelley. Voting to appoint Commissioner Fagan carried 9 votes yay, 3 votes nay; no further action was taken. 2.0 New Business: 2.1 Commissioners received recommended changes to the Tomball Charter from the City Secretary’s Office in their binders. 2.2 Adopt Rules of Procedure for the Work of the Commission: a. Quorum Requirement; b. Affirmative Vote Required to Tentatively Approve Amendatory Language to the Charter; c. Affirmative Vote Required to Approve the Final Report to the City Council 2.3 Approve Schedule of Future Meetings by Which to Complete the Work of the Commission and Determine the Time for Such Meetings. Motion to approve the schedule with the recommended new date for the September 27, 2023, meeting was made by Commissioner Fagan, seconded by Commissioner Clepper. Motion carried unanimously. 3.0 Public Comments and Receipt of Petitions (At this time, anyone will be allowed to speak on any matter other than personnel matters or matters under litigation, for length of time not to exceed three minutes. No Council/Board discussion or action may take place on a matter until such matter has been placed on an agenda and posted in accordance with law.) No public comments were received. 4.0 Motion to Adjourn was made by Commissioner Harris, seconded by Commissioner Shannon. Motion carried unanimously. Notice is hereby given of a meeting of the City of Tomball Charter Review Committee, to be held on Wednesday, September 20, 2023 at 6:00 p.m., City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action. The City of Tomball Charter Review Committee reserves the right to meet in a closed session for consultation with attorney on any agenda item should the need arise and if applicable pursuant to authorization by Title 5, Chapter 551, of the Texas Government Code.
