MINUTES OF CHARTER REVIEW COMMISSION CITY OF TOMBALL, TEXAS Monday, November 27, 2023 6:00 PM The Charter Review Commission of the City of Tomball, Texas, conducted the meeting scheduled for November 27, 2023, 6:00 PM, at 401 Market Street, Tomball, Texas 77375, via physical attendance and video/telephone conference. A. Vice Chair G. Fagan called the meeting for the Charter Review Commission to order at 6:00 pm and asked Assistant City Secretary Sasha Luna to call the roll. PRESENT: Commissioner Browning Commissioner Clepper Commissioner Degges Commissioner Fagan Commissioner Harris Commissioner Hendrickson Commissioner Johnson Commissioner Kelley Commissioner Reidel (late) Commissioner Shannon Commissioner Whisler ABSENT: Commissioner Ross Commissioner Pye OTHERS PRESENT: Loren Smith, City Attorney Tracylynn Garcia, City Secretary Sasha Luna, Assistant City Secretary B. Public Comments and Receipt of Petitions; [At this time, anyone will be allowed to speak on any matter other than personnel matters or matters under litigation, for length of time not to exceed three minutes. C. New Business 1. Approve the minutes of the October 23, 2023, Charter Review Commission meeting. Motion made by Commissioner Harris, seconded by Commissioner Kelley. Motion carried unanimously. 2. Consideration and possible action regarding Proposed Amendatory Language for Certain Provisions in Articles VI – VIII of the City of Tomball Charter. Motion made by Commissioner Kelley, seconded by Commissioner Clepper to approve Proposed Amendatory Language for Certain Provisions in Articles VI – VIII of the City of Tomball Charter as is. Voting Yea: Commissioner Clepper, Commissioner Johnson, Commissioner Browning. Voting Nay: Commissioner Degges, Commissioner Harris, Commissioner Reidel, Commissioner Hendrickson, Commissioner Kelley, Commissioner Fagan, Commissioner Shannon, Commissioner Whisler. Motion failed 8 votes nay, 3 votes yea. Motion made by Commissioner Kelley, seconded by Commissioner Reidel to approve Proposed Amendatory Language for Certain Provisions in Articles VI – VIII of the City of Tomball Charter as is apart from section 6.02 (D). Motion carried unanimously. Motion made by Commissioner Kelley, seconded by Commissioner Degges to leave section 6.02 (D) in Article VI as is. Voting Yea: Commissioner Degges, Commissioner Harris, Commissioner Reidel, Commissioner Hendrickson, Commissioner Kelley, Commissioner Fagan, Commissioner Whisler.  Agenda Charter Review Commission November 27, 2023 Page 3 of 3 Voting Nay: Commissioner Clepper, Commissioner Johnson, Commissioner Browning, Commissioner Shannon. Motion carried 7 votes yea, 4 votes nay. 3. Consideration and possible action regarding Proposed Amendatory Language for Certain Provisions in Articles IX-XII of the City of Tomball Charter. Motion made by Commissioner Reidel, seconded by Commissioner Harris. Motion carried unanimously. 4. Consideration and possible action regarding future meetings of Tomball Charter Review Commission Motion made by Commissioner Harris, seconded by Commissioner Shannon to hold the next Charter Review Commission meeting on December 6, 2023. Motion carried unanimously. D. Adjournment Motion made by Commissioner Johnson, seconded by Commissioner Harris. Motion carried unanimously. PASSED AND APPROVED this 6th day of December 2023.
