NOTICE OF REGULAR CITY COUNCIL MEETING CITY OF TOMBALL, TEXAS MONDAY, SEPTEMBER 20, 2010 7:00 P.M. Notice is hereby given of a Regular meeting of the Tomball City Council, to be held on Monday, September 20, 2010 at 7:00 p.m., City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action. The Tomball City Council reserves the right to meet in a closed session for consultation with attorney on any agenda item should the need arise and if applicable pursuant to authorization by Title 5, Chapter 551, of the Texas Government Code. 1.0 Call to Order 2.0 Invocation ● Led by Chaplain Steve Allison, VFW Post 2427 3.0 Pledges to U. (Every Saturday at 8:00 a.m. at the Depot) ● Reports by City staff and members of Council about items of community interest on which no action will be taken ◦ The City of Tomball’s Comprehensive Plan – Vision 2030 has been awarded the 2010 Comprehensive Planning Award by the Texas Chapter of the American Planning Association (APA). Texas APA planning awards recognize individuals, organizations and communities for outstanding contributions to planning in Texas. Tomball’s Comprehensive Plan was adopted in December 2009 after a year-long community involvement process that included more than 1,700 citizens, stakeholders, business owners, elected/appointed officials, consultants and City staff. The award will formally be presented to the City at the 2010 APA Texas Chapter Annual Conference on October 8, 2010 in San Antonio. ◦ Report on School Zone Flasher Project – David Kauffman and Robert Hauck ◦ Railroad Commission of Texas – Pipeline Safety Evaluation 7.0 Approve the Minutes of the September 7, 2010 Regular City Council Meeting 8.0 New Business: 8.1 Approve the Tomball Economic Development Corporation (TEDC) 2010-2011 Fiscal Year Budget 8.2 Approve Request from the Tomball Sister City for Support, Funding, and Road Closures for the 3rd Annual Tomball German Christmas Market and 2nd Saturday, to be held December 10-12, 2010 8.3 Approve Resolution No. 2010-19, a Resolution of the City Council of the City of Tomball, Texas for the Designation of Representative and Alternate for the Houston-Galveston Area Council 2010 General Assembly 8.4 Approve Resolution No. 2010-20, a Resolution of the City of Tomball, Texas, Adopting the City of Tomball’s Investment Policy, as Set Out in City of Tomball Administrative Policy No. 13, Entitled “Investment Policy” 8.5 Presentation of the 2010 Effective Tax Rate to the City Council 8.6 Ratify the FY 2011 Budget and Find that the proposed Tax Rate of $.251455/$100 Generates Less Property Tax Revenue than the FY 2010 Budget 8.7 Adopt $0.140000 as the Portion of the Tax Rate for the Interest and Sinking (Debt Service) Fund for FY 2010 8.8 Adopt $0.111455 as the Portion of the Tax Rate to Fund Maintenance and Operations (M&O) for FY 2011 Revised - Agenda Regular City Council Meeting September 20, 2010 Page 3 of 4 8.9 Adopt, on First Reading, Ordinance No. 2010-20, An Ordinance of the City of Tomball, Texas, Setting the Tax Levy of $0.251455/$100 Value Assessed for the Year 2010 on All Taxable Real and Personal Property Located in the City of Tomball, Texas; Allowing for Homestead Exemptions for Property Owners Sixty-Five Years of Age and Over, and for Property Owners Who Qualify for Disability Benefits Under the Federal Old Age, Survivors, and Disability Insurance Program; Providing for Penalty, Interest, and Additional Penalty on Taxes Not Timely Paid; and Providing Other Matters Relating to the Subject. 8.10 Adopt, on First Reading, Ordinance Number 2010-16, an Ordinance amending the Code of Ordinances of the City of Tomball, Texas, by Deleting all of Chapter 38 Thereof and Substituting Therefore a New Chapter 38; Providing Rules and Regulations Designed to Prevent Damage to Property and Injury to Persons Resulting from Flooding; Providing a Penalty in an Amount not to exceed $2,000 for Each Day of Violation of any Provision Hereof; and Providing for Severability 8.11 Authorize Substitute Position Authorities to Cover Vacancies created by Unfilled Police Officer Positions and Long-term Absence of Tomball Police Officer, Paul Overcast 8.12 Award Contract for Janitorial Services for City of Tomball Facilities for the 2010-2011 Fiscal Year to Low Bidder, Phillips Cleaning Services, LLC 8.13 Approve Amendment to Administrative Policy #24, Entitled "Tennis Court Reservation Policy" 8.14 Receive the Capital Improvements Plan Advisory Committee (CIPAC) Recommendation for the Mayor to Issue the Certificate of Compliance Letter to the Texas Attorney General Regarding Compliance with Chapter 395 of the Texas Local Government Code 8.15 Authorize the Mayor to Issue the Certificate of Compliance Letter to the Texas Attorney General Regarding Compliance with Chapter 395 of the Texas Local Government Code 8.16 Approve Change Orders No. 1 and No. 2 for $59,320.00 and $29,030.00 Representing a Total Contract Increase of $88,350.00 for the Quinn Road Sidewalks and Utilities Project, Engineering and Planning Project No. 2007-10005, Project Bid No. 2010-01 8.17 Executive Session: The City Council will meet in Executive Session as Authorized by Title 5, Chapter 551, Government Code, the Texas Open Meetings Act, for the Following Purpose: • Sec. 551.072 – Deliberations Regarding Real Property 9.0 Adjournment Revised - Agenda Regular City Council Meeting September 20, 2010 Page 4 of 4 CERTIFICATION I hereby certify that the above notice of meeting was posted on the bulletin board of City Hall, City of Tomball, Texas, a place readily accessible to the general public at all times, on the 17th day of September 2010 by 5:00 p.m., and remained posted for at least 72 continuous hours preceding the scheduled time of said meeting.
