MINUTES OF REGULAR CITY COUNCIL MEETING
CITY OF TOMBALL, TEXAS
MONDAY, JULY 5, 2011
6:00 P.M.
1.0 Call to Order
The Council meeting was called to order by Mayor Gretchen Fagan. Other members present
were:

Wayne Gloyer - Requested Council consideration for a variance to the
1010 West Main, 77375 sign ordinance to accommodate an LED sign.
5.0 Presentations:
● Mayor Fagan presented a Proclamation in honor of Employee Appreciation Week,
July 11-15, 2011
6.0 Reports and Announcements:

○ Mike Baxter presented a Marketing Update regarding increased
recognition for the City.
7.0 Motion was made by Councilman Dodson, second by Councilman Brown, to approve the
Minutes of the June 20, 2011 Regular City Council Meeting.
Motion carried unanimously.
8.0 Old Business:
8.1 Lori Lakatos presented an overview of the changes of the proposed Ordinance. Motion
was made by Councilman Townsend, second by Councilman Stoll, to approve, on
Second Reading, Ordinance No. 2011-10, an Ordinance of the City Council of the City of
Tomball, Texas, Amending Chapter 70, Plats and the Subdivision of Land, of the Code of
Ordinances of the City of Tomball, Texas, by Amending Subsection (d) of Section 70-3
of Article I to Allow Joinder of Lots Under Common Ownership without Requiring a Plat
Provided that the Joinder of Lots does not Require the Dedication or Removal of any

Public Rights-of-Way, Public Easements or Public Improvements; Providing a Penalty in
an Amount of not more than $2,000 for Violation of any Provision Hereof; Providing for

Findings related Thereto. Vote was as follows:

Motion carried unanimously.
9.0 New Business:
9.1 Shawn Cox presented an overview of the proposed Resolution. Motion was made by
Councilman Stoll, second by Councilman Hudgens, to approve Resolution 2011-11, a
Resolution of the City Council of the City of Tomball, Texas, Approving Request by
Iglesia de Dios Taller Del Alfarero (Church of God the Potter's House) to Conduct a
March/Walk on FM 2920/Main Street on Saturday, July 23, 2011. Amendments to the
Resolution were requested by Council. Motion was made by Councilman Townsend,
second by Councilman Stoll, to approve Resolution 2011-11, as amended.
Motion, as amended, carried unanimously.
9.2 Shawn Cox presented an overview of the proposed Grant Request. Motion was made by
Councilman Townsend, second by Councilman Stoll, to approve the HOT Funds Grant
request submitted by the Spring Creek Historical Association (Tomball Museum Center)
in the Amount of $16,975. Vote was as follows:

Motion carried, 4 votes Aye, 1 vote Nay.
9.3 Lori Lakatos presented an overview of the proposed Workshop information. Staff will
bring a proposed ordinance regarding LED signs for the July 18, 2011 meeting. A
workshop will be held on August 15, 2011 to consider revisions to Chapter 60. Signs.

9.4 Motion was made by Councilman Townsend, second by Councilman Brown, to set
August 1, 2011 as the date for the Submission of the Proposed FY2011-2012 Budget by
the City Manager to Council and for the Public Hearing on the Proposed FY2011-2012
Budget.
Motion carried unanimously.
9.5 George Shackelford led a discussion regarding Council attendance and participation in
the September 2011 Telgte, Germany Market. The consensus of Council is to support
sending up to two Councilmembers and the City Manager, as a City of Tomball
delegation, to the September 2011 Telgte, Germany Market.
9.6 The City Council recessed at 7:23 p.m. to meet in Executive Session as authorized by
Title 5, Chapter 551, Government Code, the Texas Open Meetings Act, for the Following
Purposes:
• Sec. 551.071 – Consultation with Attorney regarding Potential Litigation
• Sec. 551.072 – Deliberations Regarding Real Property
Upon reconvening into regular session at 8:24 p.m., no action was taken.
10.0 Motion was made by Councilman Townsend, second by Councilman Hudgens, to
adjourn.
Motion carried unanimously.

Notice is hereby given of a Regular meeting of the Tomball City Council, to be held on Tuesday,
July 5, 2011 at 6:00 p.m., City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of

Council reserves the right to meet in a closed session for consultation with attorney on any agenda
