1.0 Call to Order
The Council meeting was called to order at 6:00 p.m. by Mayor Fagan. Other members

November 20, 2015 – Lamp Post Decorating Contest and "Lamp Post Stroll"

Reports by City staff and members of Council about items of community interest
on which no action will be taken:
o Lisa Coe reported on the success of the 3rd Annual “Sherine’s Stride” 5K
Run and 1-Mile Kids Run for Breast Cancer Awareness and presented a
check in the amount of $7,588.58 to Judy Deyo, Rick Brown, and Robert
Hauck, representing TOMAGWA.
o Doris Speer reported that the City Secretary’s Office has received the
Exemplary 5 Star Service Award from the Vital Statistics Unit, Texas
Department of State Health Services for the Fifth Year.
6.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve
the Minutes of the October 19, 2015 Regular City Council Meeting.
Motion carried unanimously.
7.0 Old Business:
7.1 Motion was made by Councilman Degges, second by Councilman Stoll, to
adopt, on Second Reading, Ordinance No. 2015-21, an Ordinance of the City of
Tomball, Texas, Amending Its Chapter 50 (Zoning) of the Tomball Code of
Ordinances by Changing the Zoning District Classification of Approximately 7
Acres of Land, Legally Described as C.N. Pillot Survey, A-632, within the City
of Tomball, Harris County, Texas, from the Agricultural District to the Light
Industrial District; Said Property being Generally Located on the South Side of
Theis Ln., West of Commercial Park Rd.; Providing for the Amendment of the
Official Zoning Map of the City; Providing for Severability; Providing for a
Penalty of an Amount Not To Exceed $2,000 for Each Day of Violation of any
Provision Hereof, Making Findings of Fact; and Providing for Other Related
Matters. Vote was as follows:

7.2 Motion was made by Councilman Townsend, second by Councilman Stoll, to
adopt, on Second Reading, Ordinance No. 2015-22, an Ordinance of the City of
Tomball, Texas, Amending Its Chapter 50 (Zoning) of the Tomball Code of
Ordinances by Changing the Zoning District Classification of Approximately 10
Acres of Land, Legally Described as Tract 1, a 2.691 Acre Tract, H.C.C.F No.
S551075; Tract 2, a 3.072 Acre Tract, H.C.C.R. No. S551078; Tract 3, a 2.684
Acre Tract, H.C.C.R. No. S551077; and, Tract 4, a 1.852 Acre Tract, H.C.C.R.
No. S551076 Located in the Jesse Pruitt Survey, A-629, within the City of
Tomball, Harris County, Texas, from the Agricultural District to the
Commercial District; Said Property being Generally Located at the Northwest
Corner of Cherry Street and Theis Ln.; Providing for the Amendment of the
Official Zoning Map of the City; Providing for Severability; Providing for a
Penalty of an Amount Not To Exceed $2,000 for Each Day of Violation of any
Provision Hereof, Making Findings of Fact; and Providing for Other Related
Matters. Vote was as follows:

8.0 New Business:
8.1 Motion was made by Councilman Townsend, second by Councilman Hudgens, to
approve the request from Woodforest Bank for City Support of the 7th Annual 5K
Tomball Dash, a Certified Run, to be held in Tomball on Saturday, November 14,
2015, through In-Kind Services Provided by the City of Tomball.
Motion to AMEND was made by Councilman Townsend, second by Councilman
Hudgens, to approve the request from Woodforest Bank for City Support of the
7th Annual 5K Tomball Dash, a Certified Run, to be held in Tomball on Saturday,
November 14, 2015, through In-Kind Services Provided by the City of Tomball

by removing NWEMS services from the requested in-kind services to be provided
by the City.
Motion, as AMENDED, carried unanimously.
8.2 Motion was made by Councilman Townsend, second by Councilman Klein
Quinn, to appoint Dane Dunagin to fill the unexpired term on the Planning and
Zoning Commission vacated by Evelyn Torres, for Term Expiring June 1, 2018.
Motion carried unanimously.
8.3 Motion was made by Councilman Townsend, second by Councilman Klein
Quinn, to approve Spring Creek County Historical Association's request for
$30,000 Grant from the City of Tomball's 2015-2016 Fiscal Budget for Annual
Operations.
Motion carried unanimously.
8.4 Motion was made by Councilman Townsend, second by Councilman Degges, to
accept Councilman Townsend’s Resignation as a Member of the Northwest
Emergency Services Board of Directors and to make no appointment of a
replacement member.
Motion carried unanimously.
8.5 Motion was made by Councilman Stoll, second by Councilman Townsend, to
approve the Assignment of Development Agreement regarding the Assignment of
Annual Assessment Collections for PID No. 2, Raleigh Creek, to Amegy Bank
National Association.
Motion carried unanimously.
8.6 Motion was made by Councilman Townsend, second by Councilman Stoll,
to read Ordinance No. 2015-23 by caption only on first reading.
Motion carried unanimously.
Motion was made by Councilman Stoll, second by Councilman Townsend, to
adopt, on First Reading, Ordinance No. 2015-23, an Ordinance of the City of
Tomball, Texas Consenting to the Annexation of a 5.112-Acre Tract of Land by
Harris County Municipal Utility District No. 273; and Making Findings Related
Thereto (River of Praise Tract). Vote was as follows:

8.7 Motion was made by Councilman Townsend, second by Councilman Degges, to
approve Resolution No. 2015-25, a Resolution of the City Council of the City of
Tomball, Texas, Designating the City Secretary of the City of Tomball as the
Public Information Coordinator and Delegating Responsibility for Public
Information Training Requirements under Texas Government Code Section
552.012; Finding Compliance with the Open Meetings Law; and Providing an
Effective Date Hereof.
Motion carried unanimously.
8.8 Motion was made by Councilman Hudgens, second by Councilman Klein
Quinn, to approve Resolution No. 2015-26, a Resolution of the City Council of
the City of Tomball, Texas, Casting Its Ballot for the Election of a Person to the
Board of Directors of the Harris County Appraisal District and to select James
P. Avioli on the Ballot. Vote was as follows:

8.9 Motion was made by Councilman Stoll, second by Councilman Townsend, to
approve Tomball City Council’s Vote by Proxy Supporting the Proposed
Amendments to the Harris County Mayors’ & Councils’ Association’s Rules and
Bylaws.
Motion carried unanimously.
8.10 Motion was made by Councilman Townsend, second by Councilman Hudgens, to
approve the realignment of several key positions and hiring of an additional
Dispatcher position within the Tomball Police Department.
