MONDAY, DECEMBER 5, 2016

1.0 Call to Order
The Council meeting was called to order at 6:00 p.m. by Mayor Fagan. Other members
present:

5.0 Presentations:
Mayor Fagan presented a Proclamation to Dr. Hayne Sheffield, declaring
December 5, 2016 as “Dr. Hayne Sheffield Day”
6.0 Reports and Announcements:
December 9-11, 2016 – Tomball German Christmas Market
December 10, 2016 – “Christmas on Commerce” – a 2nd Saturday at the Depot
Event
December 23 and 26, 2016 – Christmas Holidays – City offices closed
January 2, 2017 – New Year’s Day Holiday – City offices closed
Reports by City staff and members of Council about items of community
interest on which no action will be taken:
◦ Glenn Windsor – City of Tomball Finance Department has received the
Texas Comptrollers’ Transparency Star for Traditional Finances and
the Debt Obligation Star for Financial Transparency.
7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the
Minutes of the November 21, 2016 Special Joint Meeting of the Tomball City Council
and Tomball Regional Health Foundation and the November 21, 2016 Regular Tomball
City Council Meeting.
Motion carried unanimously.
8.0 Old Business:
8.1 Motion was made by Councilman Townsend, second by Councilman Degges, to
approve, on Second Reading, Resolution No. 2016-26-TEDC, a Resolution of the
City Council of the City of Tomball, Texas, authorizing and approving the
Tomball Economic Development Corporation’s Project to Expend Funds in
accordance with an Economic Development Performance Agreement by and
between the Corporation and Brandt Construction LLC, to make direct incentives
to, or expenditures for, assistance with infrastructure costs for the promotion of
new or expanded business enterprise related to the construction of a new
commercial facility to be located on a 2.3291-acre tract of land at 22110
Hufsmith-Kohrville Road, Tomball, TX 77375. The estimated amount of
expenditures for such Project $65,694.00. Vote was as follows:

9.0 New Business:
9.1 Motion was made by Councilman Townsend, second by Councilman Stoll, to
approve Request for City Support of the Spring/Woodlands-based Rumble Cats
Classic Car Club for the Use of the Depot Festival Area for Its Annual “Rally in the
Alley” Car Show, to be Held on March 4, 2017, from 9 a.m. to 5 p.m.
Motion carried unanimously.
9.2 Motion was made by Councilman Stoll, second by Councilman Townsend, to
approve Harris County's Offer to Purchase a Portion of the City of Tomball's Utility
Easements Along Phase II of the Tomball Tollway and Authorize the City Manager
to Execute the Release of Easement Rights Documents.
Motion carried unanimously.
9.3 Consideration to Approve Zoning Case P16-0156: Request by Earl Williams, to
amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by rezoning
approximately 7.34 acres of land, legally described as Tracts 189A, 189B, 189C,
193A-1 & 193B-1 Tomball Outlots, within the City of Tomball, Harris County,
Texas, generally located on the east side of S. Cherry Street, north of Theis Lane at
1623 S. Cherry Street, from the Single-Family 20 Estate District to the Commercial
District.
• Mayor Fagan opened the Public Hearing on ZONING CASE P16-0156 at
6:40 p.m.
• Receiving no public comments, Mayor Fagan closed the Public Hearing at
6:40 p.m.
• Motion was made by Councilman Townsend, second by Councilman Stoll, to
read Ordinance No. 2016-30 by caption only on first reading.
• Motion carried unanimously.
• Motion was made by Councilman Townsend, second by Councilman
Hudgens, to adopt, on First Reading, Ordinance No. 2016-30, an
Ordinance of the City of Tomball, Texas, Amending Chapter 50 (Zoning)
of the Tomball Code of Ordinances by Changing the Zoning District
Classification of Approximately 7.34 Acres of Land, Legally Described as
Tracts 189A, 189B, 189C, 193A-1 & 193B-1 Tomball Outlots, within the

City of Tomball, Harris County, Texas, from the Single-Family 20 Estate
District to the Commercial District; Said Property Being Generally
Located on the East Side of South Cherry Street, North of Theis Lane at

Penalty of an Amount Not to Exceed $2,000 for Each Day of Violation of
Any Provision Hereof, Making Findings of Fact; and Providing for Other
Related Matters. Vote was as follows:
