1.0 Meeting was called to order at by Mayor Fagan. Other members present:

5.0 The following presentations were made:
Al Gerhardt, Tomball Lions Club presented a $1,000.00 donation each to the City
of Tomball Fire and Police Departments for their annual Christmas Programs
Mayor Fagan presented proclamations – October 2019 is “National Chiropractic
Health Month” to Tomball practitioners.
6.0 Reports and Announcements:
• November 8, 2019 – Bicycle Rodeo – Heritage Plaza, 400 Market Street – 9:00 a.m.
• November 9, 2019 – “Depot Day” – 10:00 a.m.-5:00 p.m., a National Model
Railroad Month Celebration at the Depot - Tomball
• November 22, 2019 – Christmas Tree Lighting at the Depot – 7:00 p.m.
• November 23, 2019 – Tomball Holiday Parade
• November 28-29, 2019 – Thanksgiving Holiday – City offices closed
• December 7, 2019 – “Deck the Depot” – a 2nd Saturday at the Depot Event,
10:00 a.m.-3:00 p.m.
• December 13-15, 2019 – Tomball German Christmas Market
• December 24-25, 2019 – Christmas Holidays – City offices closed
• January 1, 2020 – New Year’s Day Holiday – City offices closed

7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the
Minutes of the October 7, 2019 Regular Tomball City Council Meeting.
Motion carried unanimously.
8.0 Old Business Consent Agenda:
8.1 Adopt, on Second Reading, Ordinance No. 2019-23, an Ordinance Amending the
Code of Ordinances of the City Council of the City of Tomball, Texas, by
Repealing Chapter 36 – Solid Waste, in Its Entirety and Adopting a New Chapter
36 – Solid Waste; Providing for Severability; and Making Other Provisions and
Findings Related Thereto
8.2 Adopt, on Second Reading, Ordinance No. 2019-24, an Ordinance of the City of
Tomball, Texas, Adopting Impact Fees for Water and Wastewater Facilities;
Defining Certain Terms; Providing for the Assessment and Collection of Such
Impact Fees; Containing Other Provisions Relating to the Subject; and Providing
for Severability
8.3 Adopt, on Second Reading, Ordinance No. 2019-25, an Ordinance of the City

Council of Tomball, Texas, Approving the Service and Assessment Plan for the
City of Tomball Public Improvement District Number Seven (TPID 7 – Grand
Junction Subdivision)
8.4 Adopt, on Second Reading, Ordinance No. 2019-26, an Ordinance of the City
Council of Tomball, Texas, Levying an Assessment Against Section One
Properties within the City of Tomball Public Improvement District Number Seven
(TPID 7 – Grand Junction Subdivision); and Making Certain Findings Related
Thereto
Following the reading of the caption of each Ordinance, motion was made by
Councilman Townsend, second by Councilman Stoll, to adopt Ordinances No.
2019-23, 2019-24, 2019-25, and 2019-26 on second reading. Vote was as
follows:

9.0 New Business:
9.1 Motion was made by Councilman Townsend, second by Councilman Klein
Quinn, to approve Tomball Sister City Organization’s Request for Support,
Funding, and Road Closures, in the Amount of $160,000.00 for the 2019 Tomball
German Christmas Market, to be Held December 13-15, 2019, and the 2020
Tomball German Heritage Festival, to be Held March 27-29, 2020.
Motion carried unanimously.
9.2 Consideration to Approve Zoning Case P19-120: Request by Turnstone Texas
Group LP, to amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by
rezoning approximately 9.5 acres of land legally described as Tract 1M Abstract
305C Goodrich, within the City of Tomball, Harris County, Texas, generally
located on the south side of North Humble Lake Road at SH 249 from the
Agricultural District to the Light Industrial District.
• Conduct Public Hearing on Zoning Case P19-120
Mayor Fagan opened the Public Hearing at 6:20 p.m.

Receiving no public comments, Mayor Fagan closed the Public Hearing at
6:20 p.m.
• Motion was made by Councilman Townsend, second by Councilman
Stoll, to read Ordinance No. 2019-27 by caption only on First Reading.
Motion carried unanimously.
Motion was made by Councilman Townsend, second by Councilman
Stoll, to adopt, on First Reading, Ordinance No. 2019-27, an Ordinance of
the City of Tomball, Texas, Amending Chapter 50 (Zoning) of the Tomball
Code of Ordinances by Changing the Zoning District Classification of
Approximately 9.5 Acres of Land, Legally Described as Tract 1M Abstract
305C Goodrich, within the City of Tomball, Harris County, Texas, from the
Agricultural District to the Light Industrial District; Said Property being
generally located on the South Side of North Humble Lake Road at SH 249;
Providing for the Amendment of the Official Zoning Map of the City;
Providing for Severability; Providing for a Penalty of an Amount Not to
Exceed $2,000 for Each Day of Violation of Any Provision Hereof, Making
Findings of Fact; and Providing for Other Related Matters. Vote was as
follows:

9.3 Motion was made by Councilman Townsend, second by Councilman Stoll, to
approve Award Contract for Project No. 2019-08, Janitorial Services, to ABM
Texas General Services
Motion carried unanimously.
9.4 Motion was made by Councilman Ford, second by Councilman Townsend, to
approve an Agreement for Professional Services with Costello, Inc. for E&P
Project 2019-1001, Lizzie Lane and South Persimmon Drainage Improvements, in

the Amount of $284,198.00, and Authorize City Manager to Execute the
Agreement.
Motion carried unanimously.
9.5 Motion was made by Councilman Townsend, second by Councilman Klein
Quinn, to award Contract for Project No. 2019-04, M121W & M121E Channel
Improvements, to Rebel Contractors, Inc., in the Amount of $3,999,605.64.
Motion carried unanimously.
9.6 Motion was made by Councilman Townsend, second by Councilman Ford, to
approve Resolution No. 2019-44, a Resolution of the City of Tomball, Texas,
Amending the Impact Fees, per City of Tomball Ordinance No. 2019-24, in the
Master Fee Schedule for Fiscal Year 2019-2020.
Motion carried unanimously.
10.0 Motion was made by Councilman Stoll, second by Councilman Townsend, to adjourn.
Motion carried unanimously.
