NOTICE OF SPECIAL CITY COUNCIL MEETING CITY OF TOMBALL, TEXAS TUESDAY, July 26, 2016 5:00 P.M. Notice is hereby given of a Special meeting of the Tomball City Council, to be held on TUESDAY, July 26, 2016 at 5:00 p.m., at Tomball City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action. The Tomball City Council reserves the right to meet in a closed session for consultation with attorney on any agenda item should the need arise and if applicable pursuant to authorization by Title 5, Chapter 551, of the Texas Government Code. 1.0 Call to Order 2.0 Public Comments and Receipt of Petitions: [At this time, anyone will be allowed to speak on any matter other than personnel matters or matters under litigation, for length of time not to exceed three minutes. No Council/Board discussion or action may take place on a matter until such matter has been placed on an agenda and posted in accordance with law.] 3.0 New Business: 3.1 Adopt, on First Reading, Ordinance No. 2016-09, an Ordinance of the City of Tomball, Texas, Extending the City Limits of Said City to Include All of the Territory within Certain Limits and Boun daries and Annexing to the City of Tomball All of the Territory within Such Limits and Boundaries; Approving a Service Plan for All of the Area within Such Limits and Boundaries; Containing other Provisions relating to the Subject; and Providing a Savings and Severability Clause (Tract One: 4.847 Acres of Land, Being a Portion of FM 2920 Right-of-Way and a Portion of Telge Road Right-of-Way, Tomball, Texas; and Tract Two: 14.461 Acres of Land Located at 15945 FM 2920, 21706 Telge Road, and 21718 Telge Road, Tomball, Texas) 3.2 Award Contract for Project No. 2016-24 for the 2016 Asphalt Street Improvements and North Waste Water Treatment Plant Driveway Rehabilitation 3.3 Consideration to approve Comprehensive Plan Case P16-0092: Request by John Linton to amend the City’s Comprehensive Plan by designating the Future Land Use of approximately 14.427 acres of land as Commercial. The property is legally described as 14.427 acre tract of land located in the Chancey Goodrich Survey, Abstract Number 311, within the City of Tomball’s Extra Territorial Jurisdiction and proposed City Limits, Harris County, Texas, generally located at the southeast corner of FM 2920 and Telge Road Harris County, Texas. Agenda Special City Council Meeting July 26, 2016 Page 2 of 4  Conduct Public Hearing on COMPREHENSIVE PLAN CASE P16-0092  Adopt, on First Reading, Ordinance No. 2016-14, an Ordinance Of The City Of Tomball, Texas, Amending Its Comprehensive Plan By Designating The Future Land Use Classification Of Approximately 14.427 Acres Of Land, Legally Described As A 14.427 Acre Tract Of Land Located In The Chancey Goodrich Survey, Abstract Number 311, Within The City Of Tomball, Harris County, Texas, As Commercial; Said Property Being Generally Located At The Southeast Corner Of FM 2920 And Telge Road; Providing For The Amendment Of The Comprehensive Plan Of The City; Providing For Severability; Providing For A Penalty Of An Amount Not To Exceed $2,000 For Each Day Of Violation Of Any Provision Hereof, Making Findings Of Fact; And Providing For Other Related Matters 3.4 Consideration to approve Zoning Case P16-0080: Request by John Linton to amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by rezoning approximately 14.427 acres of land, legally described as 14.427 acre tract of land located in the Chancey Goodrich Survey, Abstract Number 311, within the City of Tomball’s Extraterritorial Jurisdiction and proposed City Limits, Harris County, Texas, generally located at the southeast corner of FM 2920 and Telge Road, from the Agricultural District to the Commercial District. • Conduct Public Hearing on ZONING CASE P16-0080 • Adopt, on First Reading, Ordinance No. 2016-15, an Ordinance Of The City Of Tomball, Texas, Amending Chapter 50 (Zoning) Of The Tomball Code Of Ordinances By Changing The Zoning District Classification Of Approximately 14.427 Acres Of Land, Legally Described As 14.427 Acre Tract Of Land Located In The Chancey Goodrich Survey, Abstract Number 311, Within The City Of Tomball, Harris County, Texas, From The Agricultural District To The Commercial District; Said Property Being Generally Located At The Southeast Corner Of FM 2920 And Telge Road; Providing For The Amendment Of The Official Zoning Map Of The City; Providing For Severability; Providing For A Penalty Of An Amount Not To Exceed $2,000 For Each Day Of Violation Of Any Provision Hereof, Making Findings Of Fact; And Providing For Other Related Matters 3.5 Consideration to approve Zoning Case P16-0077: Request by Zack Burghli, on behalf of Royal Oak Enterprises, LLC to amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by rezoning approximately 10.4 acres of land, legally described as a portion of Lots 3 and 4 and all of Lots 5 and 6 of Tomball Estates Subdivision as recorded in Volume 366, Page 113 of the Map Records of Harris County and situated in the J. House Survey, Abstract Number 34, within the City of Tomball, Harris County, Texas, generally located on the north side of Hicks Street, between Quinn Road and Liberty Ln, from the Single-family 20 District to the Single-Family 9 District. House Survey, Abstract Number 34, within the City of Tomball, Harris County, Texas, from the Single Family 20 Estate District to the Single Family 9 District; Said Property being generally located on the North Side of Hicks Street, between Quinn Road and Liberty Lane; Providing for the Amendment of the Official Zoning Map of the City; Providing for Severability; Providing for a Penalty of an Amount Not to Exceed $2,000 for Each Day of Violation of Any Provision Hereof, Making Findings of Fact; and Providing for Other Related Matters 3.6 Consideration to approve Zoning Case P16-0083: Request by Dorothy J. Chestnut Street, from the Single-Family 6 District to the Old Town and Mixed Use District. • Conduct Public Hearing on ZONING CASE P16-0083 • Adopt, on First Reading, Ordinance No. 2016-13, an Ordinance of the City of Tomball, Texas, Amending Chapter 50 (Zoning) of the Tomball Code of Ordinances by Changing the Zoning District Classification of Approximately .32 Acres of Land, Legally Described as Lots 14, 15, 16 & 17 Block 70 Tomball, within the City of Tomball, Harris County, Texas, from the Single Family 6 District to the Old Town and Mixed Use District; Said Property being generally located at the Northwest Corner of Mechanic Street and S.
