City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Tuesday, November 6, 2018 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Varney, Council Members Adams, Hill, Kelly and Law. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Engineer Harkins, Chief of Police Hurd, Electrical Supervisor Youtz, Golf Pro Dent and Deputy City Clerk Anaya. Mayor Varney called the meeting to order. Electrical Supervisor Youtz led the Pledge of Allegiance. Mayor Varney announced that November 2018 is National Epilepsy Awareness Month. He stated that the City of Torrington would like to invite all citizens to join the national effort in recognizing November as Epilepsy Awareness Month by wearing purple in support of all the children who fight epilepsy every day on Friday, November 9, 2018. Mayor Varney announced that the Torrington Trailblazers qualified for the Wyoming State High School Class 3A Football Championship that will be held on Friday, November 9, 2018 at 3:00 p.m. at War Memorial Stadium in Laramie, Wyoming. He publically recognized the accomplishments of the Torrington Trailblazers and their undefeated season record. Councilwoman Hill moved and Councilman Law seconded to approve the consent agenda which includes the minutes from the 10-16-18 Council meeting as published and all actions therein be ratified. Motion carried unanimously. Mayor Varney requested approval to amend the agenda as follows: 1. Add Deborah Alden Catering Permit Request to the Action Items List. Councilman Law moved and Councilman Adams seconded to approve the amendment to the agenda. Motion carried unanimously. Councilman Kelly requested approval to amend the agenda as follows: 1. Add Ordinance 1st Reading – Re-naming a City Street Pursuant to City Ordinance 12.08.060 to the Action Items List. Councilman Adams moved and Councilwoman Hill seconded to approve the agenda as amended. Motion carried unanimously. Attorney Eddington stated that The Open Barrel Brewing Company, LLC requested approval to sell other brands of keg beer at its establishment located at 1930 Main Street. He indicated that per a written request submitted on behalf of the LLC, the intent is to purchase keg beer from the following licensed wholesale malt beverage distributors for on premise consumption only: 1. Foursome, Inc. DBA Orrison Distributing, LTD. 2. Tri County Coors, Inc. DBA Tri County Coors. 3. Barbara M. Sterkel DBA T & N Distributing. Attorney Eddington commented that there is a specific provision in the statutes that allows the local licensing authority to approve the request. State Statute 12-4-412(b)(i) states that the local licensing authority, “May allow the sale of other malt beverages under a microbrewery permit for on premises consumption when obtained through licensed wholesale malt beverage distributors.” Councilman Adams inquired if the owners of the LLC had any intentions of presenting future requests specifically relating to liquor licensing to the Mayor and Council or if the current keg beer request would be the only one. Clayton Kilgore, owner of The Open Barrel Brewing Company, addressed the Mayor and Council. He stated that as he and his business partner delve further into the microbrewery industry, they are discovering what their original business plan was lacking based on actual customer feedback. They are getting requests for other beverages that their current microbrewery permit does not allow them to acquire or sell. Mr. Kilgore indicated that they have contemplated what would happen if they run out of their brew, which is why they are requesting approval to sell other brands of keg beer purchased from specific licensed wholesale malt beverage distributors. He stated that they have also received requests to cater events with beverages other than malt beverages (beer and wine coolers), therefore the LLC plans to apply for a retail liquor license in the near future in order to be able to achieve that. Mr. Kilgore commented that per State Statute 12-4-412(b)(iii)(A) the local licensing authority, “May approve the dual holding of a microbrewery permit or winery permit and one (1) of the following: (A) A retail liquor license as provided in W.S. 12-4-101…” Attorney Eddington stated that even though Wyoming State Statute allows the local licensing authority to approve the dual holding of a microbrewery permit and a retail liquor license, City ordinance prohibits it. Section 5.12.010 states, “The City of Torrington adopts by reference Title 12 of the Wyoming State Statutes together will all amendments thereto. In the event this Ordinance contains any provision that is more strict than State law, the most strict provision shall govern.” Furthermore, Section 5.12.070 states, “A person, firm or corporation owning ten percent of an existing liquor license of whatever category shall not be permitted to apply for a second retail liquor license other than a malt beverage or caterer’s license.” Attorney Eddington concluded by stating that in order to even consider an application on behalf of The Open Barrel Brewing Company, LLC for a retail liquor license, the Mayor and Council would first have to repeal and/or amend the existing ordinance Page | 1 relating to liquor regulations. Councilman Adams inquired if the request presented for approval in regards to the selling of other malt beverages purchased from specific licensed wholesale malt beverage distributors was prohibited by City ordinance. Attorney Eddington replied no, there is not a specific provision in City ordinances that forbids the approval of that request. Councilwoman Hill moved and Councilman Kelly seconded to approve the sale of other malt beverages under the microbrewery permit issued to The Open Barrel Brewing Company, LLC to only be obtained from Foursome, Inc., Tri County Coors, Inc. and Barbara M. Sterkel as presented. Motion carried unanimously. Patrick Zimmerer with Table Mountain Vineyards, LLC requested approval of a catering permit for a Goshen County Chamber of Commerce/Economic Development Third Thursday Event to be held at 2042 Main Street (21st & Main) on November 15, 2018 from 4:00 p.m. to 8:00 p.m. Councilman Law moved and Councilman Kelly seconded to approve the catering permit as presented. Motion carried unanimously. Deborah Alden with J&B Liquor requested approval of a catering permit for a Third Thursday Event to be held at 1933 Main Street Unit A. on November 15, 2018 from 4:30 p.m. to 8:00 p.m. Councilwoman Hill moved and Councilman Law seconded to approve the catering permit as presented. Motion carried unanimously. Mayor Pro-Tem Adams stated that since the next item up for discussion directly involved Mayor Varney, he would need to be excused so that the Council could consider the approval of an ordinance on first reading relating to re-naming a City street pursuant to City ordinance 12.08.060. Attorney Eddington read by title AN ORDINANCE RE-NAMING A CITY STREET PURSUANT TO CITY ORDINANCE 12.08.060. He indicated that the ordinance re-names “Industrial Park Avenue” to now be known as “Varney Boulevard” in honor and recognition of Mayor Michael E. Varney’s dedication and commitment to the City of Torrington. Councilman Law moved and Councilman Kelly seconded to approve the ordinance on first reading as presented. Motion carried unanimously. Attorney Eddington read a proclamation declaring November 12-16, 2018 as Torrington Apprenticeship Week. Electrical Supervisor Youtz introduced his two apprentices: Wyatt Miller and Michael Schuler. He commented that the City of Torrington’s Apprenticeship Program has been registered with the U.S. Department of Labor for several years and stated that it has been extremely successful in training several City employees to master the skill sets required of the job. Councilman Adams asked Electrical Supervisor Youtz for a brief outline as to what is required of an apprentice. Electrical Supervisor Youtz replied that an apprentice is required to complete four (4) years of the Merchant Training Program in addition to attaining 8,000 categorized hours of on the job training. Once those two requirements are fulfilled, an apprentice is then promoted to a journeyman. Councilman Adams moved and Councilwoman Hill seconded to approve the proclamation as presented. Motion carried unanimously. Attorney Eddington read a proclamation declaring November 2018 as Epilepsy Awareness Month. It urges all citizens of the City of Torrington, Wyoming, government agencies, public and private institutions, businesses and schools to recommit our community to increasing awareness and understanding of epilepsy through education while ensuring that all individuals with epilepsy lead a full and productive life. Holly Sanchez and Brenda McCranie addressed the Mayor and Council. Ms. Sanchez indicated that she has a child that was diagnosed with epilepsy and that the intent of the proclamation is to raise awareness with families, professionals, and the general public to better understand the lifelong disorder. She stated that she has presented the national movement to the schools, district wide, and is now working on getting the proper training for teachers and staff. Ms. McCranie commented that she too has a child that was diagnosed with epilepsy and that as parents they want to spread awareness to ensure the safety of their children. Councilman Law moved and Councilman Kelly seconded to approve the proclamation as presented. Motion carried unanimously. Ashley Harpstreith with Goshen County Economic Development and the Goshen County Chamber of Commerce requested approval of a special event permit for the annual Safety Treat & Trunk or Treat Night that was held on October 31, 2018 from 4:30 p.m. to 6:00 p.m. Mayor Varney stated that the individuals coordinating the event inadvertently missed the deadline for the 10-16-18 Council meeting and that the requested approval is a formality to ratify the special event permit that was approved by the Police Department on 10-26-18. He indicated that he recommends waiving the special event permit fee due to the request being a community event that was originated by the Torrington Police Department. Councilman Adams moved and Councilman Kelly seconded to approve the special event permit that was approved by the Police Department on 10-26-18 and to waive the special event permit fee as presented. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 3.04.040 F. OF THE TORRINGTON MUNICIPAL CODE, 2018 REVISIONS, RELATING TO WATER FEES. Clerk/Treasurer Strecker stated that there has been some confusion in regards to the sub-customer unit fee. The amendment defines the fee and clearly designates it as a per unit charge. The verbiage was unintentionally omitted only from the water ordinance when both water and sewer ordinances were amended earlier this year as it was included in the sewer ordinance. Councilman Adams suggested that the portion of the ordinance that states, “…the number of sub-customer units multiplied by the fee per Page | 2 unit listed above should be added to the base/minimum charge of the metered account,” be revised from “should be added” to “will be added.” Councilman Adams moved and Councilman Law seconded to amend the ordinance to replace the specific verbiage “should be added” with “will be added.” Councilwoman Hill inquired if any other changes were made to the ordinance. Clerk/Treasurer Strecker confirmed no. Motion carried unanimously. Councilman Adams moved and Councilwoman Hill seconded to approve the ordinance on first reading as amended. Motion carried unanimously. Golf Pro Dent presented for approval adjustments to the 2019 Golf Rates and Fees. Modifications presented for approval were: Daily Fee 9 Holes Resident/Non-Resident - $17.00, and Locker Fees (Annual Fee) - $50.00. Councilman Adams moved and Councilman Law seconded to approve the adjustments to the 2019 Golf Rates and Fees as presented. Motion carried unanimously. Clerk/Treasurer Strecker presented for approval a proposal for an electric cost of service study. She indicated that this particular subject was discussed during the FY 2019 budget process as the last electric cost of service study that the City is operating under presently, was completed in 2008. Clerk/Treasurer Strecker stated that there are several items that have changed that need to be addressed. One of those items being that the City’s wholesaler provider no longer charges a seasonal rate. She commented that staff has approached the Public Service Commission (PSC) in regards to doing away with seasonal rates within the rate structure and that the PSC advised that a full cost of service study would need to be conducted prior to that being approved. Clerk/Treasurer Strecker stated that the proposal itself is from C.H. Guernsey & Company, Inc., the firm that is assisting City staff with Power Cost Adjustment (PCA) evaluations. She commented that based on project objectives, C.H. Guernsey is estimating that the cost of service study will amount to $35,000.00 - $40,000.00 and indicated that the City budgeted $55,000.00 for the service therefore the proposal is within budget range. Councilwoman Hill moved and Councilman Adams seconded to approve the electric cost of service study proposal submitted on behalf of C.H. Guernsey & Company, Inc. with the understanding that the expenditure will not exceed $40,000.00 as presented. Motion carried unanimously. Attorney Eddington read Resolution No. 2018-14. Clerk/Treasurer Strecker stated that the resolution will amend the FY 2019 Budget for expenditures in excess of the budgeted amount. The amended amount will account for the following: Ambulance Department – New Ambulance. She indicated as a reminder that per Mayor and Council approval, the ambulance was added to the Lease Purchase FY19 Package awarded to Platte Valley Bank of Torrington, Wyoming. The resolution will account for the purchase of the ambulance to be funded 50% by a Federal Mineral Royalty Capital Construction Account grant from the State Loan and Investment Board (SLIB) and 50% City cash match, and for the lease payment of the ambulance. Clerk/Treasurer Strecker commented that the total amount of the amendment is $146,350.00. Councilwoman Hill moved and Councilman Kelly seconded to approve Resolution No. 2018-14 to amend the FY 2019 Budget in the amount of $146,350.00 as presented. Motion carried unanimously. The bills from 10-17-18 to 11-06-18 were presented for payment. Councilman Adams moved and Councilman Law seconded to approve the bills for payment as presented. Motion carried unanimously.
