City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Wednesday, January 2, 2019 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Former Mayor Varney, Mayor Adams, Council Members Hill, Kinney and Law. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Engineer Harkins, Chief of Police Hurd, Building Official Estes, Deputy City Treasurer Triplett and Deputy City Clerk Anaya. Former Mayor Varney called the meeting to order. Clerk/Treasurer Strecker led the Pledge of Allegiance. Paul Puebla led God Bless America. Attorney Eddington administered the Oaths of Office to newly elected officials Councilwoman Deanna Hill, Councilman Ted Kinney and Mayor Randy L. Adams. Mayor Adams acknowledged that Council Members Hill, Kinney and Law had visitors in the audience for the evening and asked them to individually introduce their guests. He then introduced the guests that were present on his behalf. Mayor Adams also recognized former Councilman Dennis Kelly in the audience and thanked him and everyone present for attending. Mayor Adams paid tribute to former Mayor Varney and indicated that he has big shoes to fill. He recognized the forty years of dedication and service to the City of Torrington of outgoing Mayor Varney by highlighting some of his major accomplishments while in office such as the acquisition of the Lincoln Community Complex building, the achievement of the Sports Complex facility, the Scenic Byways designation, the attainment of the Public Works facility which houses the Water and Wastewater Departments, the accomplishment of the Water Treatment Plant and the completion of the overpass. Mayor Adams stated that former Mayor Varney has been a mentor to Council Members and City staff and commented that he has provided calm and thoughtful interpretation as to what needed to get accomplished throughout his years of service which has greatly benefited the City. All present gave outgoing Mayor Varney a standing ovation. Mayor Adams announced that the City of Torrington is seeking to fill the vacant seat on the City Council. All interested candidates who are registered voters and reside within City limits may submit a Resume and a Letter of Interest describing why they wish to fill the vacant City Council seat to the City of Torrington on or before January 31, 2019. The governing body anticipates making a decision via a majority vote of all remaining elected officials at the February 19, 2019 City Council meeting. Councilwoman Hill moved and Councilman Kinney seconded to approve the consent agenda which includes the minutes from the 12-18-18 Council meeting as published and all actions therein be ratified. Motion carried unanimously. Councilman Law moved and Councilwoman Hill seconded to approve the agenda as presented. Motion carried unanimously. Mayor Adams indicated that the resolution designates a representative and alternate representative to the Municipal Energy Agency of Nebraska (MEAN) Management Committee. Electrical Supervisor Dana Youtz and Mayor Randy L. Adams were appointed as representative and alternate representative respectively. Councilwoman Hill moved and Councilman Law seconded to approve Resolution No. 2019-1 as presented. Motion carried unanimously. Attorney Eddington read Resolution No. 2019-2. Mayor Adams stated that the resolution designates a representative and alternate representative to the Nebraska Municipal Power Pool (NMPP) Members’ Council. Clerk/Treasurer Strecker commented that the resolution approves the institutions as bank depositories and/or security broker/dealers for the City of Torrington during calendar year 2019. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTIONS 13.16.007. AND 13.16.050. C. OF THE TORRINGTON MUNICIPAL CODE, 2019 REVISIONS, RELATING TO DEFINITIONS AND PROHIBITED SEWER CONNECTIONS. Councilman Kinney inquired if the ordinance would allow any particular City user to be grandfathered in. Attorney Eddington replied no, the ordinance will be in full force and effect for all City users after its passage and approval and publication as required by law. Councilman Kinney moved and Councilwoman Hill seconded to approve Ordinance No. 1207 as presented on third reading. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE CREATING AND ENACTING SECTIONS 13.16.140., 13.16.150. AND 13.16.160. OF THE TORRINGTON MUNICIPAL CODE, 2019 REVISIONS, RELATING TO BEST MANAGEMENT PRACTICES (BMPs), COST RECOVERY, AND ENFORCEMENT, VIOLATIONS AND PENALTIES. Councilwoman Hill moved and Councilman Kinney seconded to approve Ordinance No. 1208 as presented on third reading. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18.04.060 OF THE TORRINGTON MUNICIPAL CODE, 2019 REVISIONS, RELATING TO THE CITY OF TORRINGTON, WYOMING, AMENDING THE ZONING DISTRICT MAP BY ESTABLISHING “R-3” ZONING FOR A TRACT OF LAND. Building Official Estes stated staff recommends approval and he has received no public comment. Councilwoman Hill moved and Councilman Law seconded to approve the ordinance on second reading as presented. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTIONS 5.12.070. A. AND B. OF THE TORRINGTON MUNICIPAL CODE, 2019 REVISIONS, RELATING TO LIQUOR LICENSES. He indicated that the ordinance adopts specifically by reference Wyoming Statute 12-4- 412(b)(iii) in its entirety and stated that the adoption of the statute by reference allows the dual holding of a microbrewery permit and a retail liquor license as requested by The Open Barrel Brewing Company, LLC at the 12-18-18 Council meeting. Councilman Law moved and Councilwoman Hill seconded to approve the ordinance on first reading as presented. Motion carried unanimously. Engineer Harkins presented for approval the Wyoming Platte Alliance Water Supply Joint Powers Agreement. He stated that the purpose of the agreement is to secure and plan for the management of a potable water source from the surface water, stream flow, and storage reservoirs of the North Platte River. Water from the North Platte River will be stored and treated at one common source (in and around the Guernsey, Wyoming area) and then distributed to the members of the joint agreement for their municipal water supply. Engineer Harkins indicated that the water being proposed to be used is lower in concentrations of arsenic, uranium and nitrates which will result in a cost-effective treatment approach. The water supply will be available to members of the joint powers agreement along the distribution route of Guernsey, Wyoming to Bridgeport, Nebraska as a primary source of water or an alternate source of water. Engineer Harkins commented that the City of Torrington would utilize the source of water as an alternate since the City is currently undergoing a Level I Study which will evaluate the current water system, identify needs, recommend improvements, develop conceptual designs, develop estimated costs and plan for future developments. He stated that the benefit of becoming a member of the joint powers agreement is the difference in elevation from Guernsey to Torrington. There will be no pumping of water required to distribute the water to the City’s storage tanks due to the gravity feed and that will save in pumping and treatment costs. Mayor Adams indicated that the primary reason that the joint powers agreement was drafted was due to the fact that several communities along the proposed route have experienced and anticipate experiencing poor water quality in their sources of potable water. He commented that the City resolved its poor water quality issues Page | 2 several years ago with the installation of Reverse Osmosis (RO) Units, but that the North Platte River is the most appropriated water stream in the State, therefore the City has to anticipate and plan for the future to ensure that a supply of water is always readily available. Mayor Adams stated that becoming a member of the joint powers agreement will give the City the opportunity to participate in the planning phase of the project. No financial commitment will be required of the City for becoming a member of the joint powers agreement and future costs generated from the advancement of the project will be divided among all members of the agreement. Mayor Adams indicated that any member may voluntarily terminate their participation in the agreement via written notice at any time, therefore the approval of the agreement is not legally binding. Councilman Law moved and Councilman Kinney seconded to approve the Wyoming Platte Alliance Water Supply Joint Powers Agreement as presented. Motion carried unanimously. The bills from 12-19-18 to 01-02-19 were presented for payment. Councilwoman Hill moved and Councilman Kinney seconded to approve the bills for payment as presented. Motion carried unanimously. Mayor Adams asked for public comments, questions or concerns. None were heard.
