City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Tuesday, May 4, 2021 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Adams, Council Members Kelly, Kinney, Patterson and Steinbock. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Building Official Estes, Fire Chief Petsch and Deputy City Treasurer Haas. Mayor Adams called the meeting to order. Mayor Adams announced that it was National Firefighter Day. He recognized Fire Chief Petch and firefighter Dennis Estes and thanked them for their service. Council Member Kinney led the Pledge of Allegiance. Mayor Adams led the session with informational announcements on the following items: 1. CDC restrictions relaxed for Covid-19 and Goshen County mask mandate has been lifted; 2. COVID-19 vaccine clinic has been moved to Pony Express Room effective Thursday, May 6th; 3. Sink hole has been observed on 11th Avenue by Olson Tire and Fresh Foods; 4. Retail liquor license appeal update; 5. Ridge Road final repairs awaiting application for emergency MRG funding; 6. City FY22 Budget process update; 7. Wyoming Community Gas contribution received for 2020 Choice Gas period totaling $14,586.97; 8. Announcement that the City of Torrington was designated the second safest City in Wyoming for 2021 by SafeWise; 9. Reminder that the baler site is open on Saturdays from 7:00 a.m. to 3:00 p.m. to receive grass, limbs, and general yard waste - Reminder that garbage and trash bags should not be placed in grass dumpsters; 10. Park bathrooms are now open; 11. The Torrington Swimming Pool will open May 28th, passes are available at City Hall or the pool; 12. City Hall will be closed Thursday May 6th , from 9:30 a.m. to 11:30 a.m. to attend a funeral service. Mayor Adams asked for the approval of the consent agenda calling attention to the amendment in yellow, clarifying wording of the Cares Act funding. Councilwoman Steinbock moved and Councilman Kinney seconded to approve the consent agenda. Councilman Kinney pointed out an editorial error in the spelling of Councilwoman Steinbock’s name on the first page of the minutes. The consent agenda was approved as amended and all actions therein be ratified. Motion carried unanimously. Mayor Adams requested approval to amend the agenda as follows: 1. Add Resolution 2021-4 regarding the authorization to apply for Emergency Mineral Royalty Grant funding for water main replacement on Ridge Road. Councilman Patterson moved and Councilman Kelly seconded to approve the agenda as amended. Motion carried unanimously. Attorney Eddington read Resolution 2021-4 authorizing submission of a Federal Mineral Royalty Capital Construction Account Grant application to the State Loan and Investment Board for the purpose of emergency water main replacement located on Ridge Road in the amount of $437,931. Councilman Kelly inquired about the extent of the repairs that will be included with the project. DPW Harkins explained that the project included 600 feet of water line replacement and street reconstruction. Councilman Patterson inquired as to the amount of damage to the resident’s property. DPW Harkins reported that there was minor damage to the yards with sand and debris, but everything had been cleaned-up. Councilman Kelly moved and Councilman Kinney seconded to approve Resolution 2021-4. Motion carried unanimously. Mayor Adams opened the public hearing regarding a request for a new retail liquor license from Kroenmark, LLC DBA LTD Edition at 2007 Main Street. Deborah Alden addressed the Mayor and Council explaining her plan to open a home goods/general store in the old D&B furniture store. Her store will be marketing Wyoming branded products including Wyoming liquors. The store would be package liquor only and there will be no consumption on premise. Ms. Alden explained that she will not be selling beer as she will not have refrigeration. Her plan is to secure the liquor section in her store in a separate room or kiosk within the building that can be closed off when needed. Chief Johnson spoke in support of the small, low volume retail environment. Attorney Eddington did not have any issues with the license, but recommended reviewing the building and kiosk where the liquor will be displayed before issuing the final license. Building Inspector Estes reported that he had met with Ms. Alden and does not have any issues. The liquor license would not be issued until November 1st after the renovations are completed. The Mayor asked for comments for or against the renewal of the Retail Liquor License, none were heard. The public hearing was closed. Further comments from Councilman Kinney who spoke in favor of the business taking up the space that has been empty for years and displaying Wyoming products. Mayor Adams also commented on his support for the store and the positive impact it would have on our community, but wanted to caution that the liquor products should be sold as presented here tonight. Councilman Patterson moved and Councilman Kinney seconded to approve the retail liquor license as presented. Motion carried unanimously. Attorney Eddington read a proclamation declaring May 16 – 22, 2021 as Emergency Medical Services Week. It recognized EMS as a vital public service and recognized the value and the Page | 1 accomplishments of EMS providers. With the theme, Ready Today. Preparing for Tomorrow. The proclamation encourages the community to support EMS providers. Councilman Kinney moved and Councilman Kelly seconded to approve the proclamation as presented. Motion carried unanimously. Attorney Eddington read a proclamation declaring May 15, 2021 as Kids to Parks Day in the City of Torrington. It encourages kids and families to get outdoors and visit local parks, public lands and waters. Councilwoman Steinbock moved and Councilman Patterson seconded to approve the proclamation as presented. Motion carried unanimously. Jeremy Huhman, Vyve Regional Director of Operations spoke to the Mayor and Council about the infrastructure upgrades they have made and are planning to make in the future. Huhman requested a 3-year extension to the cable TV franchise. He presented that these upgrades will take more than one year to complete. Councilman Kinney questioned why they would need a multi-year agreement when they have been renewing year to year for a long-time, requesting things to be fixed. Huhman commented that most franchise agreements are for 10 to 15 years and Vyve wants to invest millions of dollars into this system. Mayor Adams commented that he has seen improvements in the service in both internet and cable service. He also commented that City staff in the electric and building department do not recommend more than a one-year extension due to repairs that have been reported and have not been corrected. Huhman responded that they are still working on repairs and now that he knows about it he will make sure it gets fixed. Councilman Kelly shared that he feels a multi-year contract would remove the incentive to repair the system. Mr. Huhman said he will give his personal cell phone number to anyone in town who has a problem that needs addressed. Mayor Adams suggested that a three-year extension with an annual review of the franchise may be possible. Councilman Patterson moved and Councilwoman Steinbock seconded the motion to approve a three- year extension with an annual review of the franchise. Voting aye Adams, Kelly, Patterson, and Steinbock. Voting nay Kinney. Motion carries. Sandy Hoehn, Community Development Director of Goshen County Economic Development presented for approval a special event permit for Third Thursday events to be held on June 17, July 15 and August 19 from 4 to 6 p.m. She explained that the event will encompass 3 days out of the 90-day summer. The only change in the event from last year is that the Farmer’s Market will not be held on Main Street this year. Councilman Kinney moved to approve the event permit with the $200 fee and Councilwoman Steinbock seconded the motion. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING CHAPTER 5.50 OF THE TORRINGTON MUNICPAL CODE, 2021 REVISIONS, RELATING TO TELECOMMUNICATIONS FRANCHISE. Clerk/Treasurer Strecker stated that the termination language requested from Councilman Kelly at second reading of the ordinance was added to Section 5.50.130. Councilman Kinney moved and Councilman Patterson seconded to approve the ordinance on third and final reading as presented. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING CHAPTER 18.56 OF THE TORRINGTON MUNICPAL CODE, 2021 REVISIONS, RELATING TO M-P MOBILE HOME PARKS, SUBDIVISIONS, AND TRAILER PARK DISTRICTS. Building Official Estes stated that there have been no comments or concerns from the public. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the ordinance on second reading as presented. Motion carried unanimously. The bills from 04-21-21 to 05-04-21 were presented for payment. Councilman Kelly questioned the Max Master’s billing for GIS mapping in the water and sewer fund. DPW explained that Max trains employees to perform GIS mapping as well as actual mapping. Councilman Kelly also asked about the towing bills from Butler’s Salvage. Clerk/Treasurer Strecker explained that the bill in question was for the homicide investigation. Councilwoman Steinbock moved and Councilman Patterson seconded to approve the bills for payment as presented. Motion carried unanimously. Mayor Adams asked for public comments, questions or concerns. None were heard. Councilman Kinney moved and Councilman Kelly seconded that there being no further business to come before the Mayor and Council to adjourn at 8:16 p.m. Motion carried unanimously.
