City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Tuesday, August 17, 2021 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Adams, Council Members Kelly, Kinney, Patterson and Steinbock. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Building Official Estes, Water/Wastewater Supervisor Troxel and Deputy City Clerk Anaya. Mayor Adams called the meeting to order. Director of Public Works Harkins led the Pledge of Allegiance. Mayor Adams led the session with informational announcements on the following items: 1. Reminder that school begins in Goshen County on 08-24-21; 2. Announcement that due to a shortage of lifeguards, the Dale Jones Municipal Pool will be open only for afternoon swim sessions and scheduled evening pool parties through the rest of the season; 3. High temperature warning and suggested precautions; 4. Reminder to the public that property owners are responsible for their property from the middle of the road to the middle of the alley; 5. Reminder to the public that the baler site is open Monday through Friday from 7:00 a.m. to 4:00 p.m. and on Saturday from 7:00 a.m. to 3:00 p.m. to receive grass, limbs and general yard waste; 6. Request to the public to renew their emphasis on keeping the weeds and trash under control during the upcoming months heading into the Fall; 7. Air quality advisory updates and suggested precautions; 8. COVID-19 vaccine updates; 9. COVID-19 updates and recommendations; 10. Progress on projects within the City; 11. Reminder to the public that the Farmers Market will continue at City Park every Thursday evening going into the Fall; 12. Announcement that the final Third Thursday event will be held on 08-19-21 from 4:00 p.m. to 6:00 p.m. on Main Street; 13. Announcement that the City of Torrington will be closed on 09-06-21 in observance of the Labor Day Holiday; and 14. Update on the proposed one percent (1%) specific purpose excise tax in Goshen County for the November 2022 ballot. Councilman Kelly moved and Councilman Kinney seconded to approve the consent agenda which includes the minutes from the 08-03-21 Council meeting as published and all actions therein be ratified. Motion carried unanimously. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the agenda as presented. Motion carried unanimously. Attorney Eddington read a proclamation declaring September 2021 as Hunger Action Month. It states that hunger and poverty are issues of vital concern in Goshen County where 13% of people struggle with hunger, and indicates that more than 775 residents of Goshen County rely, annually, on food provided by the Wyoming Food Bank of the Rockies and their local partners. Councilman Kinney moved and Councilwoman Steinbock seconded to approve the proclamation as presented. Motion carried unanimously. Jennifer Tollefson with Maverik, Inc. requested approval to install the adult chiller (alcohol slushee) machines that were approved by the Mayor and Council for placement in the licensed building located at 500 East Valley Road in 2019. She stated that since the initial approval in 2019 was so long ago, Maverik is seeking formal approval by the Mayor and Council to install the machines that were purchased for counter placement at Maverik Store #293. Ms. Tollefson indicated that the machines will be mounted on the segment of the counter that is within the enclosed alcohol sales area of the store with employee access only; they will not be a self-serve type of product. She explained that the alcoholic beverage will be dispensed into the cup by a Maverik employee and will be clearly labeled as an alcoholic beverage. A plastic seal will then be placed around the top of the cup and the edges will be secured with the use of a heat gun. Lastly, the sealed cup will be placed in a plastic bag with an Innoseal tape closure. Mayor Adams asked Chief of Police Johnson if he had any concerns with the request. Chief of Police Johnson responded that in discussions with the Wyoming Liquor Division and in reviewing Wyoming State Statutes, the procedure that Maverik is proposing for the sale of the alcohol slushee is compliant with what the state has outlined for this particular type of product. He stated that the statute defines sealed to mean in a plastic bag and heat sealed closed and indicated that Maverik is complying with that requirement. Chief of Police Johnson commented that the proposed sealing procedure also meets the requirements that the Torrington Police Department has for any other type of alcoholic beverage in order to identify and address any open container issues. Councilman Patterson moved and Councilman Kelly seconded to approve the installation of adult chiller (alcohol slushee) machines in the licensed building located at 500 East Valley Road as presented. Motion carried unanimously. Cody Dyer with Lifeway Church requested approval to extend the conditional use permit that was approved on 05-17-16 for the parking lots located at 1341 East M Street. He stated that he was unaware of the 5 year time limitation that was allotted for the church to comply with the City’s paving requirements as he was not the Pastor when the extension was originally granted in 2016. Mr. Dyer indicated that the church has made several improvements to the front parking lot since 2016. He commented that the parking lot has been scraped, covered with crushed concrete and rolled. Mr. Dyer Page | 1 stated that the 05-17-16 Council meeting minutes state that “…the Planning Commission approved the request not to pave the parking lots until such a time that the surrounding streets are paved…”. He inquired if the City had a timeline as to when the paving of the surrounding streets would take place. Building Official Estes indicated that the plans for the paving of the surrounding streets are ready, the City is simply waiting to acquire the appropriate funding to get those paving projects completed. He commented that without the surrounding streets being paved, the church is going to struggle to get the right elevations in order to pave appropriately. Mr. Dyer stated that they cannot afford to pave the parking lots all at once due to the current financial situation of the church, but indicated that a more feasible solution would be if the church were to be allowed to phase the project and complete the paving of the parking lots in stages. He commented that another option would be for the church to wait until the City begins to pave the surrounding streets and utilize the same contractor. Mr. Dyer stated that their parking lot project is too small of a project, therefore they are not receiving very favorable quotes. Building Official Estes suggested that the Mayor and Council extend the conditional use permit another 5 years. Councilman Patterson moved and Councilman Kinney seconded to extend the conditional use permit for the parking lots located at 1341 East M Street for an additional 5 years as presented. Motion carried unanimously. Director of Public Works (DPW) Harkins presented for ratification a Memorandum of Understanding (MOU) between the Wyoming Department of Corrections (WDOC) and the City of Torrington that was signed on 08-10-21. He stated that the MOU outlines the responsibilities of both parties during the undetermined length of time that it will take to complete the remediation work on the elevated water storage tank maintained by the WDOC on the premises of the Wyoming Medium Correctional Institution (WMCI). DPW Harkins indicated that the responsibilities of the City include ensuring that WMCI receives water from the designated High Zone pressure system when the WDOC takes the elevated water storage tank offline, and being on call to manually switch the water services to the airport booster station should a major fire event be reported at WMCI. Water/Wastewater Supervisor Troxel addressed the Mayor and Council. He commented that a safety factor was built into the High Zone pressure system to allow the City the means to provide the WMCI water in the event that their elevated water storage tank needed to be taken offline. Councilwoman Steinbock moved and Councilman Kelly seconded to ratify the Memorandum of Understanding (MOU) between the Wyoming Department of Corrections (WDOC) and the City of Torrington that was signed on 08-10-21 as presented. Motion carried unanimously. Attorney Eddington read Resolution No. 2021-08. Mayor Adams stated that the resolution supports the proposition for the one percent (1%) specific purpose excise tax in Goshen County. He indicated that the City of Torrington has a specific need for the replacement of the 50-year-old facility known as the Dale Jones Municipal Swimming Pool. Councilman Kinney moved and Councilman Kelly seconded to approve Resolution No. 2021-08 as presented. Motion carried unanimously. The bills from 08-04-21 to 08-17-21 were presented for payment. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the bills for payment as presented. Motion carried unanimously. Mayor Adams asked for public comments, questions or concerns. Councilman Kinney commended the Streets Department on the work that they completed with the painting and striping of parking lots. He also recognized the efforts that Communications Supervisor Geller put into organizing National Night Out. Councilman Patterson praised the Torrington Police Department for their quick response times. Fire Chief Petsch urged the public to be aware of the smoke in the area and to take the appropriate precautions when necessary. Councilman Kinney moved and Councilwoman Steinbock seconded that there being no further business to come before the Mayor and Council to adjourn at 7:52 p.m. Motion carried unanimously.
