City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Tuesday, May 2, 2023 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Buildings & Grounds Superintendent Estes, Water/Wastewater Supervisor Troxel and Deputy City Clerk Anaya. Mayor Doby called the meeting to order. Councilman Deahl led the Pledge of Allegiance. Mayor Doby led the session with informational announcements on the following items: 1. Reminder to the public to be cautious and mindful of the presence of pedestrians, motorcyclists, bicyclists and skateboarders on the streets; 2. Request to the public to refrain from using their cell phones while driving; 3. Request to the public to please refrain from putting garbage in the grass bins as it renders the grass unusable for the making of compost; 4. Announcement that National Arbor Day was observed on 04-28-23; 5. Reminder to the public that May 2023 was proclaimed as Tennis Month in Torrington, Wyoming; 6. Announcement that May 7-13, 2023 is National Drinking Water Week; and 7. Announcement that May 21-27, 2023 is National Emergency Medical Services Week. Councilman Patterson moved and Councilman Kelly seconded to approve the consent agenda which includes the minutes from the 04-18-23 Council meeting as published and all actions therein be ratified. Motion carried unanimously. Mayor Doby requested approval to amend the agenda as follows: 1. Remove Ordinance 1st Reading – Annexing the Baler Addition from the Action Items List. Councilman Viktorin moved and Councilman Deahl seconded to approve the agenda as amended. Motion carried unanimously. Lisa Kilmer addressed the Mayor and Council. She expressed her concerns in regard to the home-based business, Next Level Restoration, located at 3701 Johnson Street. Ms. Kilmer stated that she resides across the street at 3702 Johnson Street and indicated that the business activity is disturbing and bothersome. Tyler Cearns, owner of Next Level Restoration, addressed the Mayor and Council. He stated that he is only operating the business out of his home on a short-term basis as he is actively searching for a commercial location that will be suitable for his needs. Councilman Patterson asked Buildings & Grounds Superintendent Estes if any City ordinances are being violated by the business as it is currently being operated. Buildings & Grounds Superintendent Estes replied that to the best of his knowledge no regulations are being violated. Mayor Doby thanked both parties for their willingness to speak before the Mayor and Council, and encouraged anyone who perceives that City ordinances are being violated to contact the Torrington Police Department and/or Buildings & Grounds Superintendent Estes so that the issue can be investigated further. Mayor Doby requested approval to change the Council meeting scheduled for Tuesday, July 4th to Wednesday, July 5, 2023 due to the holiday, Fourth of July, falling on Tuesday. Councilman Patterson moved and Councilman Kelly seconded to approve the requested meeting date change as presented. Motion carried unanimously. Councilman Deahl moved and Councilman Viktorin seconded to appoint Mayor Herb Doby as the Official Voting Delegate and Councilman Richard Patterson as the Alternate Delegate for the 2023 Wyoming Association of Municipalities Summer Convention Business Meeting to be held on 06-08-23 in Cody, Wyoming. Motion carried unanimously. Councilman Patterson moved and Councilman Deahl seconded to ratify the proclamation that was approved on 04-26-23 declaring 04-28-23 as Arbor Day in the City of Torrington. Motion carried unanimously. Attorney Eddington read a proclamation declaring May 7-13, 2023 as Drinking Water Week. It urged each citizen of the City to help protect our source waters from pollution and to practice water conservation, and stated that we are all stewards of the water infrastructure upon which current and future generations depend. Water/Wastewater Supervisor Troxel spoke in support of the proclamation. Councilman Viktorin moved and Councilman Kelly seconded to approve the proclamation as presented. Motion carried unanimously. Councilman Deahl moved and Councilman Patterson seconded to approve the proclamation declaring May 21-27, 2023 as Emergency Medical Services Week as presented. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE REPEALING PRIOR ORDINANCE #1097 DATED JULY 6, 2010 AND FILED AT BOOK 799 PAGE 149 OF THE GOSHEN COUNTY, WYOMING REAL ESTATE RECORDS. Councilman Patterson moved and Councilman Viktorin seconded to approve the ordinance on second reading as presented. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18.16.020 OF THE TORRINGTON MUNICIPAL CODE, 2023 REVISIONS, RELATING TO THE CITY OF Page | 1 TORRINGTON, WYOMING, AMENDING THE ZONING DISTRICT MAP BY ESTABLISHING “R6-A” ZONING FOR A TRACT OF LAND. Buildings & Grounds Superintendent Estes stated that the ordinance will establish the zoning for Tracts A-1 and A-2 of the Lopez Addition 3rd Filing. Councilman Viktorin moved and Councilman Kelly seconded to approve the ordinance on first reading as presented. Motion carried unanimously. Director of Public Works (DPW) Harkins presented the bid results for the FY2023 Submersible Pump and Motor Replacements Project. He stated that staff recommends awarding the bid to Sargent Drilling of Broken Bow, Nebraska in the amount of $101,908.00 with no contingency. DPW Harkins indicated that the project consists of the removal of the existing submersible pumps and motors within Well #3 and Well #15 and replacing them with new submersible pumps and motors with associated electrical wiring and piping improvements. He commented that a bid opening was held on 04-26-23 for the project, and stated that the bid from Sargent Drilling was the only bid received and it was in conformance with the bidding requirements. DPW Harkins indicated that funding for the project was established in the FY23 Budget in the amount of $94,000.00 and commented that the balance of the funding, $7,908.00, will be taken from the Power and Pump Facility O&M Budget. Councilman Viktorin moved and Councilman Deahl seconded to award the bid to Sargent Drilling of Broken Bow, Nebraska in the amount of $101,908.00 with no contingency as presented. Motion carried unanimously. Clerk/Treasurer Strecker requested that the Nepotism Policy be waived for all seasonal Dale Jones Municipal Pool employees for the 2023 season. She explained that due to the demographics of the City, it is nearly impossible for the pool to avoid hiring relatives, especially siblings. Councilman Patterson moved and Councilman Kelly seconded to approve waiving the Nepotism Policy for all seasonal Dale Jones Municipal Pool employees for the 2023 season as presented. Motion carried unanimously. The bills from 04-19-23 to 05-02-23 were presented for payment. Councilman Kelly moved and Councilman Viktorin seconded to approve the bills for payment as presented. Motion carried unanimously. Mayor Doby asked for public comments, questions or concerns. Chief of Police Johnson stated that 05-04-23 is International Firefighters’ Day. He indicated that Fire Chief Petsch and his team provide an amazing service to the community. Chief of Police Johnson commented that on a very sacrificial and volunteer basis the community receives high level, professional community safety and protection. He stated that each and every firefighter within our community deserves every bit of the thank you and appreciation that can be given to them. Fire Chief Petsch briefly updated the Mayor and Council on the calls that the Torrington Volunteer Fire Department responded to in the last couple of days.
