BOARD OF ALDERMEN CITY OF TOWN AND COUNTRY SEPTEMBER 14, 2015 WORK SESSION The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:15 PM on Monday, September 14, 2015. Present were: Aldermen Anderson, Crawford, Frautschi, Mange, Meyland-Smith and Rallo. Alderman Wright was absent. Alderman Benigas arrived at 6:50 PM. Mayor Dalton presided. City Attorney Steve Garrett represented the City. 1. Discussion-Regular meeting agenda items No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Monday, September 14, 2015 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE Joe Stieven, Ward 2 resident, led the Pledge of Allegiance. ROLL CALL The 7:07 PM roll call indicated Aldermen Anderson, Benigas, Crawford, Frautschi, Mange, Meyland-Smith and Rallo to be present. Alderman Wright was absent. Mayor Dalton presided. City Attorney Steve Garrett represented the City. MINUTES – 08/24/15 Alderman Crawford moved for approval, seconded by Alderman Frautschi. Mayor Dalton called for any corrections or amendments. Hearing none, the minutes of 08/24/15 were unanimously approved by voice vote. HEARING FROM CITIZENS Mariette Palmer, 604 Greenwich Green Lane, spoke in reference to the City’s 0% property tax rate since 1997-98. She stated that the City should have a small tax for business and commercial properties. PUBLIC HEARING(S)  A public hearing on the application of Perficient, tenant, on behalf of 555 Maryville LLC, owner, for variances from Chapter 420, the Sign Regulations of the Municipal Code, for a wall business identification sign for Perficient located at 555 Maryville Centre Drive, in the Planned Office Park (POP) Zoning District. A court reporter with Midwest Litigation was present to record the hearing. Hearing none, the hearing was closed.  A public hearing on the application of a Conditional Use Permit for a pavilion on a 33.9 acre lot located at 46 Sellenriek Road in the Suburban Estate (SE) Zoning District. The applicant is John H. Berra Jr., owner. A court reporter with Midwest Litigation was present to record the hearing. Mayor Dalton opened the public hearing. The City Clerk entered the following exhibits: 1. Affidavit of Publication of Notice of Hearing published in the St. Louis Countian on August 28, 2015. 2. Bill No. 15-59 Mike Bozich, Bozich Construction, was present on behalf of the request. Alderman Meyland-Smith confirmed with Mr. Bozich for the record that the pavilion would be less than 1,000 square feet on approximately 34 acres. Mayor Dalton called for public comments. Hearing none, the hearing was closed. Mayor Dalton recused himself and left the dais due to a perceived conflict of interest. Acting President Benigas presided over the following public hearing.  A public hearing to consider an application to amend an existing Conditional Use Permit for a private club on a site of approximately 9.85 acres at 1777 Des Peres Road, in the Estate (E) Zoning District. Missouri Athletic Club, owner / applicant, is proposing a building addition with a new patio. A court reporter with Midwest Litigation was present to record the hearing. Acting President Benigas opened the public hearing. The City Clerk entered the following exhibits: 1. Bill No. 15-57 Steven Burns, dadoworks, was present on behalf of the request. Utilizing a PowerPoint presentation, Mr. Burns displayed and described the building addition and new patio that would be used for a more formal bar/lounge. He provided details regarding the planned demolition, landscaping and materials for the proposal, while displaying the renderings and site plan. He explained that a decline in membership has prompted the request in order to attract new people. He concluded by mentioning that the neighboring churches have provided letters of support. Alderman Meyland-Smith pointed out that the addition and patio accounts for less than a 1% change in greenspace calculations. He also reported that the Board of Adjustment have approved three variances in relation to this project. In response to Alderman Frautschi, Mr. Burns explained that underground collection and the addition of pervious paving will help with storm water issues with the parking lot. Mr. Burns stated that there is a concrete wall and woodland buffer between the MAC and their residential neighbors. He added that patio use would be restricted by hours of operation, gas lighting and no DJs for events. Acting President Benigas called for public comments. Hearing none, the hearing was closed. Mayor Dalton returned to the dais.  A public hearing to allow citizens to be heard on the property tax rates proposed to be set by the City of Town and Country, a political subdivision. 1. Affidavit of Publication of Notice of Hearing published in the St. Louis Countian on August 26, 2015 3. Bill No.15-58 Betty Cotner, Finance Director, was present for questions of the Board. Mayor Dalton called for public comments. Hearing none, the hearing was closed. APPOINTMENTS Board of Adjustment-David Adam Alderman Mange moved to change Mr. Adam’s membership from alternate to regular member. Alderman Crawford seconded the motion and a voice vote carried. Board of Aldermen Page 4 of 11 September 14, 2015 Board of Adjustment-Carolynne Huether Alderman Frautschi moved for approval, seconded by Alderman Crawford. Ms. Huether introduced herself and was interviewed by the Board of Aldermen. A voice vote was taken on the motion to appoint Ms. Huether as an alternate member and carried unanimously. COMMUNICATIONS AND REPORTS Alderman Frautschi Alderman Frautschi announced that the Public Works & Stormwater and Finance Commissions will be having a joint meeting at 6:00 PM on Tuesday, September 22, at the Municipal Center. She also reported that the second Ward 2 Resident Forum was held earlier in the day at Longview Farm House and was well-attended. She added that next month’s topic will be the budget process. Alderman Anderson Alderman Anderson stated that the Police Commission would be meeting at 7:00 PM on Tuesday, September 15, at the Municipal Center. Alderman Mange Alderman Mange announced that the Conservation Commission will be meeting at 6:30 PM on Monday, October 5, at the Longview Farm House, to continue discussion on backyard chickens and a beautification grant. He also reported that the Town Square Task Force and Neighborhood Representative Subcommittee would be meeting jointly at 7:00 PM on September 24 at the Longview Farm House to review the design concepts that are due on Friday, September 18. He added that another joint meeting would be held at 7:00 PM on September 29 at the Longview Farm House to finalize the recommendation to be brought before the Board of Aldermen. Alderman Crawford Alderman Crawford stated that the Fall Festival will be held at the Town Square property on October 3 with fireworks starting at 7:00 PM. She reported that the parade committee has received many exciting entries. She also announced that Clayton Road would be closed for approximately an hour between Mari De Villa and Longview Park for the parade. Anne Nixon, Parks & Recreation Director Ms. Nixon apprised the Board of Aldermen that Ann Barron and Jan Boehm, long time members of the Town & Country Garden Club, had a tree dedicated in honor of their years of service at Drace Park. Alderman Benigas stated that while Westminster is a great institution, he is not in favor of constituents being negatively impacted. He added that all of the standard aren’t met by Westminster. Alderman Mange explained that after a great deal of thought, he will vote in opposition because the standards for approving a CUP are strict. He described the three problems he anticipated as a result of the proposal to be: 1. the project would adversely affect the general welfare of the community 2. the project would be developed and operated in a manner that is physically/visually incompatible with the surrounding area 3. the project will create a nuisance. Alderman Rallo stated that she was concerned with the proposal causing a nuisance because crowd noise can’t be controlled. She added that consideration was needed for the quality of life of the residents of Delmar Gardens. Alderman Meyland-Smith quoted a statement by Jeff Rivas that the proposal is “not about the mission or core values”. He added that it is not about college visits, academics, or the character of the students, but holding athletic competitions at night. He explained that four, eight-story structures with 50-70 square feet would be a visible intrusion into the right of homeowners, in addition to the noise and light glare disturbance. He pointed out that the annual number of nights the lighting and sound system would essentially be an interruption of peace one night a week for seven months out of the year. He concluded that there are eight standards to be met in order to grant a CUP and Westminster has failed on three of them as stated by Alderman Mange. Alderman Frautschi stated that the job of an Alderman is to remove the emotional aspect of a request and focus on facts. She added that after reviewing all of the information and exhibits, several of the eight standards have not been met and that is what the decision must be based upon. Board of Aldermen Page 6 of 11 September 14, 2015 Alderman Anderson stated for the record that she did listen to the four and a half hour public hearing relating to the CUP request. She referenced Municipal Code Section 405.190.A. regarding the standard for approving CUPs. She added that after careful consideration and research, this proposal does not meet all of the standards required by Code. Alderman Crawford remarked that she has both a professional and personal background in sports and sporting events. She further stated that in reviewing the required standards, this request fails to meet three of them. The roll call vote was as follows: AYE, none; NAY, Aldermen Anderson, Benigas, Crawford, Frautschi, Mange, Meyland-Smith and Rallo; ABSTAIN, none; ABSENT, Wright. The motion to approve failed. Mayor Dalton stated that he interpreted the action as a denial and called on the City Attorney to draft findings of fact for the next meeting. A brief recess was held. The meeting reconvened at 8:49 PM with all members present. BILL 15-48, AN ORDINANCE AMENDING CHAPTER 600 OF TITLE VI OF THE MUNICIPAL CODE OF THE CITY OF TOWN AND COUNTRY, MISSOURI, SPECIFICALLY REVISING SECTION 600.100, SECTION 600.220 AND SECTION 600.300 AND ENACTING SECTION 600.240 RELATING TO LIQUOR LICENSES (sponsored by Aldermen Crawford & Meyland-Smith) Mayor Dalton called for a second reading, without objection.
