BOARD OF ALDERMEN CITY OF TOWN AND COUNTRY JULY 25, 2016 WORK SESSION The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:30 PM on Monday, July 25, 2016. Present were: Aldermen Benigas, Butler, Crawford, Mange and Wright. Aldermen Frautschi and Meyland-Smith were absent. Alderman Rallo arrived at 6:45 PM. Mayor Dalton presided. In City Attorney Steve Garrett’s absence, Attorney Ed Sluys represented the City. 1. Discussion-Regular meeting agenda items No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Monday, July 25, 2016 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE Jenn Dieken-Bucheck, Mason Ridge Elementary Principal, led the Pledge of Allegiance. ROLL CALL The 7:00 PM roll call indicated Aldermen Benigas, Butler, Crawford, Mange, Rallo and Wright. Aldermen Frautschi and Meyland-Smith were absent. Mayor Dalton presided. In City Attorney Steve Garrett’s absence, Attorney Ed Sluys represented the City. MINUTES – 07/11/16 Alderman Mange moved for approval, seconded by Alderman Rallo. Mayor Dalton called for any corrections or amendments. Hearing none, the minutes of 07/11/16 were unanimously approved by voice vote. HEARING FROM CITIZENS PUBLIC HEARING(S) APPOINTMENTS COMMUNICATIONS AND REPORTS Alderman Butler Alderman Butler stated that the Environment, Horticulture & Wildlife Commission will be meeting at 6:30 PM on Monday, August 1, at Longview Farm Park. Alderman Mange Alderman Mange stated that the Public Art Commission will be meeting at 6:00 PM on Thursday, July 28, at Longview Farm Park. Board of Aldermen Page 2 of 4 July 25, 2016 Alderman Crawford Alderman Crawford reported that the Police, Fire & EMS Commission had a very productive meeting and would be bringing two items forward at the next Board of Aldermen meeting, one regarding golf carts and the other in relation to speed limits. UNFINISHED BUSINESS RESOLUTION NO. R08-2016, A RESOLUTION APPROVING A SIGN CODE VARIANCE FOR MASON RIDGE ELEMENTARY SCHOOL Alderman Mange moved for approval, seconded by Alderman Wright. Alderman Mange moved to accept Substitute Resolution No. R08-2016 for consideration and detailed the changes to include the addition of award years to the sign, as well as its overall size. Alderman Wright seconded the motion and a voice vote carried. A voice vote was held on the Resolution, as substituted, and carried. RESOLUTION NO. R10-2016, A RESOLUTION AUTHORIZING THE DIRECTOR OF PARKS & RECREATION TO APPLY FOR A MUNICIPAL PARK GRANT FOR CONSTRUCTION OF THE MASON ROAD LINEAR PARK, PHASE I Alderman Mange moved to continue the Resolution to the August 8, 2016 meeting. Karen McKnight, 1617 Foxleigh Court, spoke in support of the Mason Trail Project. She explained that the Parks & Trails Commission has communicated their support for continued connectivity loud and clear. She added that the commission members would benefit from some discussion and explanation from those who oppose the project. Mayor Dalton thanks Mrs. McKnight for her service and urged her and several Aldermen to get together to discuss the project and any related issues. Alderman Crawford seconded the motion to continue and a voice vote carried. BILL NO. 16-42, AN ORDINANCE APPROVING AN AMENDED FINAL SITE DEVELOPMENT PLAN FOR DAYSPRING BAPTIST CHURCH, CITY OF TOWN AND COUNTRY, MISSOURI, WITH CONDITIONS TO BE COMPLIED WITH AND AUTHORIZING CERTIFICATION OF THE AMENDED FINAL SITE DEVELOPMENT PLAN (sponsored by Aldermen Mange & Wright) (1st reading 07/11/16) Mayor Dalton called for a second reading, without objection. Without objection, Bill No. 16- 42 was read for the second time and placed upon its final passage. Alderman Mange moved for approval, seconded by Alderman Wright. The roll call vote was as follows: AYE, Aldermen Benigas, Butler, Crawford, Mange, Rallo and Wright; NAY, none; ABSTAIN, none; ABSENT, Frautschi and Meyland-Smith. The motion carried unanimously and Bill No. 16-42 became Ordinance No. 4005. ARCHITECTURAL REVIEW Alderman Mange moved to approve the Architectural Review for Dayspring Baptist Church. Alderman Rallo seconded the motion and a voice vote carried. Board of Aldermen Page 3 of 4 July 25, 2016 NEW BUSINESS BILL NO. 16-43, AN ORDINANCE AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH HR GREEN, INC. FOR CONSULTANT SERVICES RELATED TO THE 2016 STORM WATER PROGRAM IDENTIFICATION AND DESIGN (sponsored by Alderman Crawford) Mayor Dalton called for a first reading, without objection. Without objection, Bill No. 16-43 was read for the first time by title only. Mayor Dalton declared Bill No. 16-43 continued to the meeting of Monday, August 8, 2016 for the second reading and consideration. BILL NO. 16-44, AN ORDINANCE AUTHORIZING SUPPLEMENTAL AGREEMENT NO. 2 WITH EDM, INC. IN RELATION TO THE 1843 MANOR HILL DRAINAGE IMPROVEMENTS PROJECT (sponsored by Alderman Butler) Mayor Dalton called for a first reading, without objection. Without objection, Bill No. 16-44 was read for the first time by title only. Mayor Dalton declared Bill No. 16-44 continued to the meeting of Monday, August 8, 2016 for the second reading and consideration. BILL NO. 16-45, AN ORDINANCE AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH LANDMARK CONTRACT MANAGEMENT, INC. FOR CONSULTING SERVICES RELATED TO THE TOWN SQUARE PROJECT AND AMENDING THE 2016 BUDGET BY INCREASING A CAPITAL IMPROVEMENTS FUND EXPENDITURE ACCOUNT AND APPROPRIATING FUNDS TO COVER THE INCREASE (sponsored by Aldermen Mange & Wright) Mayor Dalton called for a first reading, without objection. Without objection, Bill No. 16-45 was read for the first time by title only. Alderman Mange moved to suspend the agenda rules in order to hear the second reading and consider the Bill. Alderman Wright seconded the suspension motion and a voice vote carried. Mayor Dalton consented. Mayor Dalton called for a second reading, without objection. Without objection, Bill No. 16- 45 was read for the second time and placed upon its final passage. Alderman Mange moved for approval, seconded by Alderman Wright. The roll call vote was as follows: AYE, Aldermen Benigas, Butler, Crawford, Mange, Rallo and Wright; NAY, none; ABSTAIN, none; ABSENT, Frautschi and Meyland-Smith. The motion carried unanimously and Bill No. 16-45 became Ordinance No. 4006. WARRANT LIST-07/25/16 Alderman Mange moved for approval, seconded by Alderman Crawford. Mayor Dalton called for any amendments. Board of Aldermen Page 4 of 4 July 25, 2016 Hearing none, a voice vote was taken and the warrant list of July 25, 2016, in the amount of $369,465.83 was unanimously approved by voice vote. OTHER ADJOURN Motion was made by Alderman Rallo and seconded by Alderman Crawford, to move to closed session pursuant to Section 610.021 (1), (2), (3) and (13) RSMO 2000 to discuss legal actions, litigation, real estate and attorney/client privileged communication and to discuss personnel matters. The roll call vote was as follows: AYE, Aldermen Benigas, Butler, Crawford, Mange, Rallo and Wright; NAY, none; ABSTAIN, none; ABSENT, Frautschi and Meyland-Smith.
