BOARD OF ALDERMEN CITY OF TOWN AND COUNTRY OCTOBER 10, 2016 WORK SESSION The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:15 PM on Monday, October 10, 2016. Present were: Aldermen Benigas, Butler, Frautschi, Mange, Meyland-Smith, Rallo and Wright. Alderman Crawford was absent. Mayor Dalton presided. City Attorney Steve Garrett represented the City. 1. Discussion-Neighborhood Preservation Initiatives regarding zoning changes Alderman Meyland-Smith and Planning & Zoning Commission members Will McKnight and Dennis Bolazina were present to explain the Neighborhood Preservation Initiatives’ history, timeline and proposed zoning changes. Utilizing a PowerPoint presentation, Mr. McKnight detailed the proposed changes for construction setbacks, sidewall construction offsets, floor area percentage calculation, outdoor game courts and the composition of green space. 2. Discussion-Regular meeting agenda items No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Monday, October 10, 2016 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE Al Gerber, Ward 2 resident, led the Pledge of Allegiance. ROLL CALL The 7:05 PM roll call indicated Aldermen Benigas, Butler, Frautschi, Mange, Meyland-Smith, Rallo and Wright to be present. Alderman Crawford was absent. Mayor Dalton presided. City Attorney Steve Garrett represented the City. MINUTES – 09/26/16 Alderman Mange moved for approval, seconded by Alderman Wright. Mayor Dalton called for any corrections or amendments. Hearing none, the minutes of 09/26/16 were unanimously approved by voice vote. HEARING FROM CITIZENS Matt Peters, 47 Brookmill Lane, stated he is a trustee of Old Woods Mill Manor Subdivision. He referenced Ordinance 3370 that prohibits Westminster from having a permanent public address system and displayed photos of affixed loudspeakers at both the baseball and football stadium. He urged the Board to enforce the aforementioned prohibition as well as the City’s noise ordinance. Kim Michel, 17 Brookmill Lane, stated she is also a trustee of Old Woods Mill Manor Subdivision. She stated that the PA systems in place are in violation of the site plan B o a rd o f A ld e rm e n Page 2 of 7 October 10, 2016 ordinance. She explained that after repeated contacts with Westminster, it is clear the PA system was being used without regard for the ordinances. She concluded by stating that the residents of Old Woods Mill Manor and Arlington Oaks urge the City to enforce the rules that are in place. Al Gerber, 13482 Masson Village Court, stated that he has been designated as a liaison for Senator Jill Schupp and distributed a letter that contained contact information for both himself and the Senator. Jeff Chaney, 5 Arlington Oaks, spoke in reference to the ongoing noise issue at Westminster. He stated that the speakers were not just being utilized at games, but also practices and other events. Discussion was held about enforcement of the site plan and noise ordinances, as well as greater attention to the enforcement of the agreed upon conditions in Conditional Use Permits. PUBLIC HEARING(S)  A public hearing on the application of Mercy Hospitals East Communities, owner, for variances from Chapter 420, the Sign Regulations of the Municipal Code, for two wall signs at 777 S. New Ballas Road, in the Office (O) Zoning District. A court reporter with Midwest Litigation was present to record the hearing. Mayor Dalton opened the public hearing. The City Clerk entered the following exhibits: 1. Typewritten notice of hearing posted at the Municipal Center and on the subject property, and mailed to property owners within 300 ft. of subject property, with a list of property owners attached. 2. Resolution No. 16-2016 Nikki Viner, VP of Operations, was present on behalf of the request. She described the signage to include standard channel letters with a colored logo. In response to Alderman Meyland-Smith, she confirmed that there was presently no other signage on the building. Mayor Dalton called for public comments. Craig Wilde, Planning & Public Works Director, responded to an inquiry from Alderman Mange about comparable signage in the area. He stated that the Missouri Baptist sign across the highway is significantly larger. Alderman Benigas stated that the City’s signage code should be reviewed so that unnecessary variance requests can be avoided. Hearing no public comment, the public hearing was closed.  A public hearing to consider a request by Larry Walker, owner, for approval of a Conditional Use Permit for a detached garage / studio, located at 412 Cheshire Farm Court, in the Suburban Estate (SE) Zoning District. 1. Bill No. 16-64 Larry Walker, owner, and Mike Shay, architect, were present on behalf of the request. Mr. Walker distributed a rendering of the addition to the Board of Aldermen. He stated that the subdivision trustees, the Architectural Review Board, and the Planning & Zoning Commission have unanimously approved the project. In response to Alderman Meyland-Smith, Mr. Shay stated that the site of the home is 52 feet 6 inches from the property line and as such, will not impose on the adjacent neighbor. Mr. Walker stated that with winter approaching, the timeliness of approval was important. Mayor Dalton called for public comments. Hearing none, the public hearing was closed. APPOINTMENTS COMMUNICATIONS AND REPORTS Alderman Rallo Alderman Rallo announced that the Ways & Means Commission would meet at 7:30 AM on Friday, October 21, at the Municipal Center. Alderman Wright Alderman Wright reported that Fall Festival will be held from 4-7 PM on Saturday, October 15, at Longview Farm Park. She added that the Discovery Sculpture dedication would take place at 4:30 PM. Alderman Frautschi Alderman Frautschi stated that the October meeting of the Public Works Commission has been cancelled for lack of agenda items. Alderman Mange Alderman Mange reported and publicly thanked The Principia for honoring City staff, the Town & Country Police Department, and the West County Fire Department on Saturday, October 8. He also stated that the Plein Air Art Competition would begin at 7:30 AM with painters throughout the City and conclude with a reception in the Longview Farm House where art could be purchased. Alderman Benigas Alderman Benigas commended Alderman Wright, staff, and the Public Art Commission for all of the hard work that was done to accomplish the Discovery Sculpture. *A member of the public wishing to speak was recognized at this time. Tom Bruno, 15 Brookmill Lane, described the noise disruption that has been occurring in the evening because of the Westminster PA system. He urged the Board to protect the interests of residents by enforcing ordinances. Mayor Dalton stated that City staff will be reviewing the situation for compliance. UNFINISHED BUSINESS B o a rd o f A ld e rm e n Page 4 of 7 October 10, 2016 ARCHITECTURAL REVIEW- BONAN TOWERS (continued from 09/12/16) John Mueller, JEMA, was present to describe the project. He stated that the Architectural review Board (ARB) had expressed concern about the building’s paint scheme. Utilizing a PowerPoint presentation, he displayed photos of the building with both existing and proposed colors shown. Paint samples were distributed to the Board of Aldermen. Alderman Benigas reported that ARB unanimously approved the project after seeing the paint color changes. He called attention to the entrance curtain and reported that it would only be completed, as shown, on the east side of the building. He concluded by stating that ARB has encouraged the applicants to replicate the work on the west side of the building. Aldermen Wright and Rallo commented on the building’s enhanced appearance and commended the applicants. Alderman Meyland-Smith echoed ARB’s encouragement to replicate the entrance curtain on the west side. He also stated for the record that he would like to see substantial re- landscaping done, with particular attention to the dead trees that line Woodsmill Road. Jason Riegelsberger, owner’s representative, assured the Board that the enhanced landscaping plan is currently out to bid and will be underway soon. Alderman Benigas moved for approval of the architectural review of Bonan Towers at 14323 S. Outer 40 Drive. Alderman Rallo seconded the motion and a voice vote carried. BILL NO. 16-54, AN ORDINANCE APPROVING AN AMENDED FINAL SITE DEVELOPMENT PLAN FOR MARYVILLE UNIVERSITY – FORMER BALL PROPERTY, CITY OF TOWN AND COUNTRY, MISSOURI, WITH CONDITIONS TO BE COMPLIED WITH AND AUTHORIZING CERTIFICATION OF THE AMENDED FINAL SITE DEVELOPMENT PLAN (sponsored by Aldermen Benigas & Rallo) (1st reading 09/26/16) Mayor Dalton called for a second reading, without objection. Hearing none, a voice vote was taken and the warrant list of October 10, 2016, in the amount of $651,039.07 was unanimously approved.
