ABC MEETING MINUTES February 17, 2009 Conference Room 5:00 p.m. An ABC Meeting/Hearing was held by the City Council of the City of Trenton on the above date at 5:22 p.m., in the City Council Conference Room, 319 East State Street, Trenton, New Jersey. The meeting was called to order by President Paul M. Pintella, who announced that adequate public notice had been provided to the public specifying the time and place for this meeting in accordance with the Open Public Meetings Act. This ABC Meeting/Hearing was advertised on February 13, 2009. ROLL CALL: Present: Mr. Coston, Ms. Lartigue, Messrs. Melone and Segura, Ms. Staton, Mr. Pintella Absent: Mr. Bethea ABC HEARINGS: Appearance: JDNS, Inc., t/a Maxine’s, 120 So. Warren Street Owners introduced as Jennifer LaGore, 3 Ronit Dr., Ewing, NJ Sekhou Cummings, 3 Ronit Dr., Ewing, NJ Mr. Samuel Reale, Jr., Esq. represented JDNS, Inc. Special Counsel Joseph Alacqua made a recommendation that a 10 day suspension be imposed, with 40 days being held in abeyance for a period of one year. If there are no additional violations during that period, the 40 days would be set aside. After much discussion, a motion was made by Ms. Lartigue, seconded by Ms. Staton, that JDNS, Inc. will be closed the following days: March 2, 9, 16, 23, 30, April 6, 13, 20, 27, and May 4, 2009; and when a private event is held, the ABC Officer will be notified. Said motion was carried with the unanimous vote of those Council members present. ABC Meeting Minutes February 17, 2009 1  Appearance: R and T Tavern, Inc., t/a Neuvo Anbiente Mango, 28 Elm Street, Trenton, NJ Owner introduced as Marino Manzanillo, 8 Uxbridge Drive, Robbinsville, New Jersey Mr. John F. Vassalo, Jr., Esq., represented R and T Tavern, Inc. Special Counsel Joseph Alacqua made a recommendation that a 10 day suspension be imposed. After much discussion, a motion was made by Mr. Coston, seconded by Mr. Segura, that R and T Tavern, Inc. will be closed the following days: February 24, 25, March 3, 4, 10, 11, 17, 18, 24, 25, 2009; and any other violations will be considered their second offense. Said motion was carried with the unanimous vote of those Council members present. Appearance: MSOC, LLC, t/a Flamingo Bar, 905 Anderson Street Owner introduced as Mashkoor Ahmad Mr. John F. Vassalo, Jr., Esq. represented MSOC, LLC. After much discussion, a motion was made by Mr. Coston, seconded by Mr. Segura, to consider the suspension as time served, and should this violation occur again, they will be brought in for fulfillment of the suspension, plus any additional charges. Said motion was carried with the unanimous vote of those Council members present. Appearance: Oz Juan, Inc., t/a Passions Restaurant & Night Club 801-803 E. State Street, Trenton, New Jersey Owner introduced as Juan Martinez, 3 Bradford Avenue, Hamilton, New Jersey Mr. Samuel Reale, Jr., Esq. represented JDNS, Inc. Special Counsel Joseph Alacqua informed City Council that there is a Municipal Court matter pending with regard to some of the charges that are the subject of this hearing. Therefore, it was determined that action against Oz Juan, Inc. be postponed until April 20, 2009. Special Counsel Joseph Alacqua informed City Council that the State Division of Alcoholic Beverage Control has upheld the special conditions imposed on the license. After much discussion, it was determined that the hearing for MEM Bar & Liquors, Inc. be postponed until March 16, 2009.
