Mr. Kolber indicated that there will be a Public Hearing about a proposed acquisition of a
major structure in the City; Capital Health acquiring St. Francis Medical Center. There was
someone from the public present to advise the Public and the Planning Board of the limited
information that has been made available about the plans for this acquisition and the
services that it currently provides. Iana, introduced herself and described what information
has been made available to the public. She noted that Trinity Health will maintain the
ownership of the land and Capital Health will purchase the building and then demolish it in
order to avoid the concerns with an abandoned site that they have experienced in the past.
The Heart Center will be relocated to the Helene Fuld Campus. She strongly encouraged
everyone to attend the in-person Public Hearing planned for Monday, September 12, 2022
or send in written comments by September 19th. The Board asked the Planning Staff to
promote the hearing on its social media channels.
Mr. Kolber also noted that the Resiliency Planning will be held in-person in order to
perform interactive mapping exercises starting with the Vulnerability Assessment. The
Public is encouraged to come out and participate on Thursday, November 3rd at 6pm.

21-P-208PH: 208 Phillips Avenue- TRENTON NJ
Applicant/Owner seeks preliminary and final minor subdivision and (c) bulk variance for
minimum front yard and minimum side yard size, to consolidate five existing parcels into
two new parcels with redrawn boundaries. The site is split between Residential B (RB) and
Residential B2 (RB2) Zoning Districts; Location 208 Phillips Avenue; City Tax Map:

Block(s) 9001, Lot(s) 5, 6, 7,8, & 9; Applicant: Berb Realty, LLC, 18 Wiltshire Drive, East
Windsor, NJ 08520.
Mr. Martin Jennings, Esq. introduced the project. Mr. Craig Stratton, Engineer from
Trenton Engineering, and Mr. Bruce, LaFrozia, Managing Member of Berb Realty, were
sworn in and accepted as experts before this Board.
Mr. Stratton, explained the nature of the project proposed. He explained that they did the
site survey for the existing lots in order to create 2 lots out of 5 and subsequently have 2
homes on those lots.
There will be no construction on this site so nothing will be added to any non-conformities.
He described how they will comply with the recommendations cited in the Board’s
professional’s comments, as they will comply with all comments. The setbacks will be
conforming. There are 2 front yards and the average for Phillips Ave is zero and the
frontage on Dexter is also next to zero. The Applicant will provide Mr. McGill the exact
measurement of the frontage on Dexter for variance notation in the resolution. Additionally,
part of the black top area will remain on lots as it will be able to be used for tenants’
staging or parking. There is not an issue meeting the requirements for impervious
coverage so the black top does not have to be removed. He noted that upon approval of
the Board this applicant will make an application to Mercer County’s Planning Board.
Mr. Kolber noted that there were several references to this being a minor subdivision. He
shared the definitions and noted that this application appears to meet the definition of a
Major subdivision instead of Minor, however, the application does meet all the of standards
to submit and proceed with the application. Mr. McGill confirmed that the application does
meet the definition of Major Subdivision so the Resolution will be reflective of that change.
Mr. Fatton asked if there was anyone from the Public who wanted to speak for or against
this application. Hearing none the following vote was set forth:
Approval of the application for 21-P-208PH: 208 Phillips Avenue inclusive of the needed
variance relief and the submission of the details previously testified to.
