The meeting was called to order at 7:19 PM by Mr. Romanow. The Open Public Meetings
Act was announced and a quorum was verified.
The Board thanked Ms. Patricia Ni’ma-Mohammed for her years of dedicated service to this
Board and the people of Trenton.

Mr. Dino Spadaccini introduced the settlement agreement before the Board tonight. Ms.
Smith, the Board’s Attorney, advised the Board of the ‘Whispering Woods’ hearing by
providing a history of what is under review, what their responsibilities and purview are
tonight, and the path that led to the reconsideration of the project tonight. She noted that
tonight the Board is reviewing the settlement and holding a Public Hearing about the
settlement in order to put forth a vote on whether to grant approval of the settlement. If
there is an affirmative vote after the review, the litigation that has been filed will go away.
Tonight the Board will hear what has changed relative to this application. The Board can
make recommendations on the settlement that can be reviewed by the Applicant, and it will
only be in effect if the Applicant agrees to the recommendations. If there is not an
affirmative vote tonight, then the litigation that is underway will continue to go forward. Ms.
Smith noted that in 2023 this original application recommended 75 units, and the
application presented tonight has a reduction of 5 units on the top floor.
Mr. Spadaccini noted that he was not the attorney in the original application. The variances
pursued in the original application of March 6, 2023 were for lot coverage which was to be
60%; with this project reducing the existing lot coverage of 100% to 90%. Parking spaces
provided should have been 99 and 56 were to be provided. Minimum front yard setback
was an existing condition of 0 ft. and this project will provide 20 ft.. On the alley and rear
yard 4.16 ft provided where 0 exists currently. There was also a waiver of the loading area
and the lighting foot candles exceeded what is allowed. Additionally, Ms. Taylor noted that
the Open Space requirement was 9,000 sq. ft. and this project provides less than that.
They agreed there would be no left turn out of the parking lot.
Mr. Romanow asked if there was anyone from the Public who wanted to speak for or
against this proposed settlement agreement. With no answer from the gallery the following
vote was set forth:
