Gales Clerk of Council Kara B. Landis City Council Meeting Minutes - Final May 18, 2021 I. Call to Order: Mayor Mary A. McDonald Mayor McDonald called the meeting to Order at 5:30 p.m. II. Pledge of Allegiance Mayor McDonald led the Pledge of Allegiance. III. Roll Call: Clerk of Council Clerk Landis took Roll Call. Present: 7 - Mayor Mary A. McDonald, Councilmember Charles Ron Vaughn, Councilmember Rhonda C. Finley, Councilmember Robert L. Kelley Jr., Councilmember Yvette Page, Councilmember Bettye L. Gales and Vice Mayor Tyna R. Brown IV. Motion to Approve the Agenda Mayor McDonald requested a Motion on this Item. Council Members Gales made a Motion, seconded by Vice Mayor Brown, to Approve the Agenda. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown V. Special Presentation PR08-21 Presentation: Recommendations from the Charter Review Commission on Revisions to the City Charter Presented by Rap Hankins, Chair, Charter Review Commission (15 minutes) Mayor McDonald introduced Rap Hankins, Chair of the 2021 Charter Review Commission. Mr. Hankins thanked Council for allowing him to serve on the Commission. He also thanked members of the Commission for their efforts and hard work and advised they were able to review the Charter in its entirety in four meetings. Mr. Hankins offered to answer any questions Council may have. Council had no questions. VI. Motions City of Trotwood Page 1 City Council Meeting Minutes - Final May 18, 2021 21-12 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 3-4. REMOVAL AND VACANCIES of the City Charter. Law Director McHugh reviewed the recommended revision. Mayor McDonald requested a Motion on this item. A Motion was made by Vice Mayor Brown, seconded by Council Member Vaughn, to accept the recommendation from the Charter Review Commission amending Section 3-4 of the City Charter. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown 21-13 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 3-5. SALARIES of the City Charter. Law Director McHugh reviewed the recommended revisions and advised he believes these changes need to go into effect as they might address some potential issues. Mayor McDonald requested a Motion on this item. A Motion was made by Council Member Gales, seconded by Vice Mayor Brown, to accept the recommendation from the Charter Review Commission amending Section 3-5 of the City Charter. The Motion FAILED by the following vote: Aye: 3- Councilmember Finley, Councilmember Kelley Jr. and Councilmember Page Nay: 4- Mayor McDonald, Councilmember Vaughn, Councilmember Gales and Vice Mayor Brown 21-14 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 3-10. CLERK OF COUNCIL of the City Charter. Law Director McHugh reviewed the recommended revision. Mayor McDonald requested a Motion on this item. A Motion was made by Council Member Finley, seconded by Council Member Gales, to accept the recommendation from the Charter Review Commission amending Section 3-10 of the City Charter. The Motion CARRIED by the following vote (Council Member Finley's virtual connection was temporarily disconnected and she was unable to vote): Aye: 6- Mayor McDonald, Councilmember Vaughn, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown Excused: 1- Councilmember Finley City of Trotwood Page 2 City Council Meeting Minutes - Final May 18, 2021 21-15 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 4-4. ENACTMENT OF ORDINANCES of the City Charter. Law Director McHugh reviewed the recommended revisions. Mayor McDonald requested a Motion on this item. A Motion was made by Vice Mayor Brown, seconded by Council Member Gales, to accept the recommendation from the Charter Review Commission amending Section 4-4 of the City Charter. The Motion CARRIED by the following vote: Aye: 6- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page and Vice Mayor Brown Nay: 1- Councilmember Gales 21-16 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 4-6. EMERGENCY ORDINANCES of the City Charter. Law Director McHugh reviewed the recommended revisions. Mayor McDonald requested a Motion on this item. A Motion was made by Council Member Finley, seconded by Council Member Gales, to accept the recommendation from the Charter Review Commission amending Section 4-6 of the City Charter. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown 21-17 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 4-7. EMERGENCY APPROPRIATIONS of the City Charter. Law Director McHugh reviewed the recommended revisions. Mayor McDonald requested a Motion on this item. A Motion was made by Council Member Vaughn, seconded by Vice Mayor Brown, to accept the recommendation from the Charter Review Commission amending Section 4-7 of the City Charter. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown 21-18 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 5-6. APPEALS FROM BOARDS AND COMMISSIONS of the City Charter. Law Director McHugh reviewed the recommended revisions. Mayor McDonald requested a Motion on this item. A Motion was made by Vice Mayor Brown, seconded by Council Member Vaughn, to accept the recommendation from the Charter Review Commission amending Section 7-2 of the City Charter. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown 21-21 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission amending Section 7-3. POWERS AND DUTIES OF PLANNING COMMISSION of the City Charter. Law Director McHugh reviewed the recommended revisions. Mayor McDonald requested a Motion on this item. A Motion was made by Vice Mayor Brown, seconded by Council Member Vaughn, to accept the recommendation from the Charter Review Commission amending Section 7-3 of the City Charter. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown City of Trotwood Page 4 City Council Meeting Minutes - Final May 18, 2021 21-22 A Motion by the Trotwood City Council to accept the recommendation from the Charter Review Commission creating new Section 10-8. PUBLICATION within the City Charter. Law Director McHugh advised that in regards to Publications, there are certain circumstances when the Ohio Revised Code requires publication in a newspaper of general circulation; otherwise, this new process would be applicable. Mayor McDonald requested a Motion on this item. A Motion was made by Vice Mayor Brown, seconded by Council Member Page, to accept the recommendation from the Charter Review Commission adding Section 10-8 within the City Charter. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown 21-23 A Motion by the Trotwood City Council to schedule a Public Hearing and to authorize the Law Director to draft an Ordinance for the submission to the electorate, approved amendments to sections of the City Charter, and place the same on the ballot at the General Election to be held on November 2, 2021. Sections being presented for consideration are: 3-4 REMOVAL AND VACANCIES 3-5 SALARIES 3-10 CLERK OF COUNCIL 4-4 ENACTMENT OF ORDINANCES 4-6 EMERGENCY ORDINANCES 4-7 EMERGENCY APPROPRIATIONS 5-6 REMOVAL 6-7 MUNICIPAL CLERK 7-2 APPEALS FROM BOARDS AND COMMISSIONS 7-3 POWERS AND DUTIES OF PLANNING COMMISSION 10-8 PUBLICATION Mayor McDonald requested a Motion on this item. A Motion was made by Vice Mayor Brown, seconded by Council Member Page, to schedule a Public Hearing and authorize the Law Director to draft an Ordinance for the submission to the electorate, amendments to sections of the City Charter as voted on and approved by Council: 3-4, 3-10, 4-4, 4-6, 4-7, 5-6, 6-7, 7-2, 7-3, and 10-8. The Motion CARRIED by the following vote: Aye: 7- Mayor McDonald, Councilmember Vaughn, Councilmember Finley, Councilmember Kelley Jr., Councilmember Page, Councilmember Gales and Vice Mayor Brown VII.
