Special Presentations and Recognitions PR09-21 Presentation: Overview and Update on the Central State Extension Incubator Farm Program Presented by: Marc Amante, Extension Educator, Central State University Seth Swallow, Regional Extension Associate, Agriculture and Natural Resources, Central State University Attachments: PR09-21 CSU Mayor McDonald greeted Marc Amante, Extension Educator, and Seth Swallow, Regional Extension Associate, from Central State University. Mr. Swallow thanked the City of Trotwood for working with Central State University and then introduced Mr. Amante. Mr. Amante reiterated their appreciation to the City, as well as to Ciara Lewis and Cheryl Wheeler, for their help in starting the Incubator Farms program. Mr. Amante then reviewed the attached presentation. Mayor McDonald asked Cheryl Wheeler, Assistant to the City Manager, to speak about her experience with the program. Ms. Wheeler expressed her excitement about the interest and enthusiasm from the students and believes this quality program is a great benefit to the City. City of Trotwood Page 2 City Council Meeting Minutes - Final July 6, 2021 PR10-21 Presentation: Trotwood Community Improvement Corporation Annual Update Presented by: Chad Downing, Executive Director, TCIC Attachments: PR10-21 TCIC Presentation Mayor McDonald welcomed Chad Downing, TCIC Executive Director, who presented an Annual Report of the Trotwood Community Improvement Corporation. Director Downing explained that his report is a little more comprehensive than one year due to COVID. Director Downing thanked Council for their support and then reviewed the attached presentation. Council Member Gales commented that it is good to see the community moving forward and thanked Director Downing. Mayor McDonald stated that while there used to be a lot of homes to run through the CIC, they aren't needing to do that anymore, which makes it very challenging financially because that was the lifeblood of the organization. Mayor McDonald advised there will need to be future discussions about other ways to help the CIC as they are the economic development arm of the City. Director Downing agreed and shared that the success of running out of abandoned homes is a great day for the City and that he is proud of the impact and long term success of this program, as well the return of tax dollars. City Manager Pope commented that there have been over 108 homes sold, putting them back on the tax roll. He further stated that now that the City is stable, the CIC can transition from housing to commercial development and the tax base it brings to the Community. Mayor McDonald thanked Director Downing for his hard work and expressed her appreciation for the exceptional job he is doing to serve the City of Trotwood. IX. Attachments: OR21-21 OR21-21 Exhibit A City Manager Pope explained that every five (5) years Council appoints a Charter Review Commission to review the Charter. He then turned the floor over to Law Director McHugh. Mayor McDonald asked Law Director McHugh to review the entire document for clarification. Law Director McHugh directed Council to the ordinance, which provides a summary of each section in the Charter that contains recommended changes. He then reviewed each section in detail. Council comments were as follows: Section 3-4(C): Mayor McDonald asked if this is for the appointment of Council Members; Law Director McHugh confirmed that is correct. Section 3-5(B): Mayor McDonald wanted clarification that the Compensation Board would not meet for the next four (4) years; Law Director McHugh confirmed that is correct, they would not meet until 2025. Mayor McDonald asked what the reasoning was behind them not meeting for four (4) years. Law Director McHugh explained this was proposed by the Charter Review Commission and that they wanted to refine the process, but not do away with it. Mayor McDonald commented that for a Council who meets to oversee a budget for a City every single year, to have its Compensation Board not be able to meet for four (4) years; she doesn't understand. Council Member Gales stated she was under the impression that people would have to run for two (2) terms before they would qualify; she was told she misunderstood. She also wanted to clarify that they would meet in 2025, four (4) years from now, then the next meeting would be in 2030; Law Director McHugh confirmed that is correct and further explained that part of the recommendation is that there would be no change in compensation during a term. Council Member Kelley commented that he commends the Charter Review Commission for their recommendations. Each Council Member selected a member and many, if not all, of their decisions were approved unanimously. He feels if there was a problem with what they did it should have been addressed sooner and believes the Commission was very genuine and spirited in getting the job done and they worked very hard. Council Member Kelley has concerns that if Council doesn't approve their recommendations it will affect Council's ability to attract future volunteers. Vice Mayor Brown asked Law Director McHugh to clarify that in regards to a possible increase in 2025, it would be for all of Council. Law Director McHugh stated that technically that is correct, but to recognize that in Section D, the City of Trotwood Page 6 City Council Meeting Minutes - Final July 6, 2021 recommendation is that there are no in-term increases. This would mean that those who are re-elected after 2025 would receive the increase, but not until they would be re-elected; increases would not start on the same date for everyone. Council Member Gales commented that she does not disagree that Council appreciates that the Charter Review Commission met, but they have always met every five (5) years and it is up to Council to decide as to whether or not their recommendations are approved. Further, she means no disparage to the Charter Review Commission but feels Council is able to ask questions without repercussion. Council Member Page wanted clarification on the definition of in-term. Law Director McHugh explained that everyone is currently in-term and if those on the ballot are reelected, their new term would begin on 01/01/2022; they would be considered to be in-term after that date. Mayor McDonald questioned if that means even those running now would not receive any change in compensation until after they run again. Law Director McHugh confirmed that is correct. Council Member Finley reassured citizens that none of them are on Council for the money, they are here to serve, and that their compensation could go several ways - the Compensation Board could decide to decrease Council's pay. Further, it's up to the citizens to decide. If citizens feel a member is not dong a good job, then don't hire (reelect) them. If citizens feel a Council Member is doing a good job, then continuing to serve by being reelected is their reward. Mayor McDonald asked Law Director McHugh if citizens will be answering one question on the ballot for all of these recommended changes. Law Director McHugh confirmed that is correct. Mayor McDonald asked what if people are not in agreement with some of the items and why this can't be broken out. Law Director McHugh explained that this is how the Charter Review Commission proposed the information and in theory it could be broken out; however, not at this time due to submission deadlines. Mayor McDonald expressed that it is unfortunate because there are things people may or may not agree with and with only one vote it doesn't seem fair; she doesn't feel the process has represented itself as clearly as it could have. Vice Mayor Brown shared that she learned of a question from Council about her Motion to Amend Section 3-5 during the June 7, 2021 meeting. Therefore, she wanted to clarify her intent regarding her suggested changes to Section 3-5 and she is prepared to make a Motion for the record to be sure it is clear. Vice Mayor Brown explained that all of the changes - regardless of how they were marked-up: bold, strikethrough, color, etc. - in the third column of the document she distributed at the previous meeting were included in her Motion to Amend. Law Director McHugh explained that he reviewed the recording and it was clear to him that it was Vice Mayor Brown's intent to include in her Motion to Amend, all of the changes indicated in the third column of her chart, regardless of how they were indicated. Attachments: R21-29 R21-29 CBA Public Works City Manager Pope explained that the Collective Bargaining Unit for Public Works and the City's negotiations team met and came to an agreement for the period of January 1, 2022 through December 31, 2024. The agreement is fair and equitable and City Manager Pope thanked both sides on a great job. Mayor McDonald expressed her appreciation as well and then requested a Motion on this item. Mayor McDonald expressed appreciation for the hard work of the City's Fire Department and is very happy to move this forward. She further thanked Chief Haacke and Chief Wilson and let them know how much Council appreciates them and the consideration shown during negotiations with the City. Old and New Business City of Trotwood Page 10 City Council Meeting Minutes - Final July 6, 2021 Mayor McDonald opened the floor for citizen comments. Ms. Joanne Orihood, who resides at 14 Oak Street in Trotwood, began by thanking Council for opening up the Council Meetings as this is where she learns of what is happening in the City. Ms. Orihood wanted to inform Council of a volunteer group in Olde Town. This came about when she was walking her dog and saw a home that wasn't being taken care of as it had been in the past. She shared her concerns with her neighbor, Sandy Bench, and they approached the homeowner, who expressed to them other ideas on taking care of their property. However, they consulted with another homeowner who had been in an accident and they were able to help take care of their flower beds and helped with flower boxes for another homeowner on Main Street. Their thought was to then move to Madison Park, but they decided they needed to make a bigger impact so they went to the Depot. Ms. Orihood is taking steps to get additional help in hopes that people will begin to feel a sense of responsibility because the City cannot, and should not be expected to, do it all. She also shared that by doing her part, she feels closer to the City. Mayor McDonald explained that the Progressive Citizens group is available to help as well. Ms. Orihood stated they will be at the Depot again on Tuesday; they do this once a week. Mayor McDonald discussed a new Beautification Committee she mentioned to City Manager and shared that City staff are contacting residents to get it started. She expressed her gratitude to Ms. Orihood for helping the City to care for the Community, as well as how much she appreciates Ms. Orihood's enthusiasm. Ms. Orihood stated that her hope is to encourage other Wards to the do the same thing as there is work to be done throughout the City, not just in Olde Town. City of Trotwood Page 11 City Council Meeting Minutes - Final July 6, 2021 a. Motion to ACCEPT the Plan regarding the Fifth Amended Joint Chapter 11 Plan of Reorganization of Purdue Pharma L.P. Law Director McHugh summarized this Plan, which involves Purdue Pharma, the primary maker of oxicotin - the drug responsible for many injuries, deaths, etc. There have been numerous lawsuits, which has forced Purdue Pharma into bankruptcy, and this case has been in Bankruptcy Court for over 26 months. Ultimately, a fund has been established to assist those states who are victims (claimants). The State of Ohio is the sixth largest claimant as it relates to other states; the worse the drug issue is, the higher the rank. Approximately $215 million will be awarded to the State of Ohio and divided between the participating governmental entities; however, the distribution process is yet to be determined. Ohio is slated to receive 4.3% of the award. The award money must be used for drug education and/or other issues related to the problem this drug created. City Manager Pope recommends Council accept the plan so that the funding can be determined and distributed to the municipalities. Mayor McDonald requested a Motion on this item. Staff Reports There were no Staff Reports. City of Trotwood Page 12 City Council Meeting Minutes - Final July 6, 2021 c. City Manager: Reminder to visit the City of Trotwood's website at www.trotwood.org for updated information and events in our City. City Manager Pope discussed the Keep Trotwood Beautiful campaign, which involves litter prevention within the City of Trotwood. The Police Department has a zero tolerance policy and surveillance cameras are being used; they will issue tickets. Billboards are also being used to relay the message. In addition, the Montgomery County Environmental Task Force is helping to address dumping in the western part of the City. City Manager Pope said they intend to hold people accountable and hope to change the mindset of the community. City Manger Pope also shared that he received numerous noise complaints over the Fourth of July holiday and explained how difficult it is to address this problem because the Police Department is busy taking calls for service. The statistics from the Montgomery County Regional Dispatch Center show there were 490 fireworks complaints, of which Trotwood had only 55. Of those 55 complaints, police officers responded to 16. While City Manager Pope understands the frustration, he feels we have to educate people and learn to respect one another. It is not realistic to expect the police department to protect a 30-square-mile City and handle the numerous holiday fireworks complaints. One issue the City did encounter was having to clean up after residents who left the remaining parts of their fireworks and other trash in the middle of the street. Council Member Gales shared that she experienced the loud noises as well, but did not call the police, believing that people were excited to be out after months of isolation from the pandemic. d. Clerk of Council: Announcements Clerk Landis shared the following: On Wednesday, July 7, from 3-5 p.m., there will be an Ice Cream Social at the Trotwood Library to celebrate their one year anniversary. On Saturday, July 31, from 2-7 p.m., a FamFest will be held in the parking lot of the former Salem Mall. There will be shopping, free health screenings, and a fitness and wellness seminar. The City will be holding a Community Beautification Contest with cash prizes for first, second, and third place. The judging period will begin on Monday, August 9th, and will focus on front and side yards. The City will be sponsoring an Electronic Waste Week beginning Monday, August 16, to include a shred day on Saturday, August 21, in the parking lot of the former Sears building. City Council has cancelled their August meeting; therefore, the next Regular City Council Meeting will be held on Tuesday, September 7. Citizens were instructed to check the City's website and Facebook page for more information, or to contact Ms. Ciara Lewis, the City’s Parks and Recreation Program Manager. XIV.
