City of Trotwood Page 2 City Council Meeting Minutes - Final December 6, 2021 IX. COMMENTS BY COUNCIL MEMBERS: Each Council Member will have three (3) minutes to speak about topics relating to the City of Trotwood that are not on the Meeting Agenda. Councilmember Page thanked constituents for hanging with Council this year and commented that Trotwood is tenacious and keeps moving forward regardless. Councilmember Page discussed the Retreet Program and how they plant trees for free but in order to be eligible, you had to have been affected by the 2019 tornado. She further explained that due to COVID, the program is still available to Trotwood residents and that Retreet will be planting on two occasions in 2022, Arbor Day in April and Make a Difference Day in October. Councilmember Page directed residents who had trees damaged from the tornado to visit the City’s website to sign up for the program. Councilmember Vaughn commented that a lot of improvements have occurred in the community over the last two years under very difficult conditions. He plans to continue to sponsor everything positive and thanked everyone for the re-election of the four council members; it is a message that Council is doing something right. Councilmember Vaughn stated he wants to work better together and that Council serves one purpose and that is to be a servant to the community members; a servant to the Lord and a servant to the people. Vice Mayor Brown thanked constitutes and community of Trotwood; also City Staff, and City Manager and Deputy City Manager, as they have leadership roles and work tirelessly for Council and the City. She stated Council does what they do because they love the City and reiterated that they are servants and do what they do with a sincere heart want to grow collectively. Vice Mayor Brown shared that Council works hard as a team to get things done. Councilmember Gales thanked Mayor McDonald for completing the leadership program as it brought a lot of light to the City and that is what Trotwood is about. Councilmember Gales also shared that through the program, Mayor McDonald secured a gift of $50,000 for an agricultural program at the school, which is an intricate part of the City. Councilmember Kelley thanked those responsible for getting the Council Comments back on the Agenda and feels they should not have been removed in the first place as it is important for the constituents to know the views of their representatives. Councilmember Kelley commended and thanked the staff for keeping the City financially sound and reminded City employees that Council values the work they do. In addition, Councilmember Kelley thanked the citizens for their vote to approve the Charter amendments in order to aid the staff with greater latitude and confidence to get the job done. He explained that he personally campaigned for the amendments as he thought about the seven citizens who volunteered to serve on the Charter Review Commission and recommended the revisions; he did not want to let them down. Councilmember Kelley appreciates that Trotwood voters were not tricked by those he believes instigated a negative campaign. Special Presentations and Recognitions PR14-21 Presentation: The City of Trotwood earned the Ohio Auditor of State Award with Distinction upon completion of the 2020 financial audit. Mr. Joe Braden, the Western Regional Liaison for the Ohio Auditor of State’s Office, will present the award to City Manager Quincy Pope and Finance Director Chris Peeples . Attachments: PR14-21 Attachment Mr. Joe Braden, the Wester Regional Liaison for the Ohio Auditor of State's Office, shared that the Auditor of State Award with Distinction is awarded to a very select group with only 4% of the entities they audit even being eligible. He then reviewed the criteria to be eligible for the award. Mr. Braden then asked FInance Director Chris Peeples and Assistant Finance Director Julie Kilbarger to come forward in order to recognize their hard work and commitment to the fiscal integrity of the City of Trotwood. PR17-21 Recognition: The K1 Trotwood Wee Rams finished their season with a record of 12-2. They played in the Southwest Ohio Football League’s Super Bowl, losing by only two points. They went on to play in the Battle in Rocky Top, a national youth football tournament held in Tennessee, and won the national championship in the 6U American Division. The 6th Grade Trotwood Wee Rams finished their season with a record of 10-1. They also played in the Southwest Ohio Football League’s Super Bowl and are the 6th Grade Super Bowl champions. Mayor McDonald recognized the K1 and 6th grade Trotwood Wee Rams youth football teams. Coach Lumpkin thanked Council for recognizing the teams; the K1 team last week at the tree lighting and the 6th grade team before Council tonight. He discussed the success of the teams and that the players and coaches enjoyed representing the City of Trotwood. Mayor McDonald presented Certificates of Achievement for both teams to Coach Lumpkin. Attachments: OR28-21 OR28-21 Exhibit A City Manager Pope shared that the City prepared a balanced budget for the 2022 fiscal year, which will allow the City to continue delivering quality services to citizens. Finance Director Peeples stated that the slight increase over 2021 includes some funding for the CIC and an increase of 2.5% in wages in order to remain competitive with other organizations. Mayor McDonald expressed Council's appreciation for the work that Finance Director Peeples and Assistant Finance Director Kilbarger do in order to make the community shine; so much that the state has recognized their work. Attachments: OR29-21 OR29-21 Exhibit A City Manager Pope shared that this Ordinance establishes the 2022 Wage Scales, reflecting a 2.5% increase for all full-time and part-time non-union employees. Deputy City Manager Kellum explained this is simply a cost of living adjustment and that every year the legislation is presented as an emergency in order for the new rates to be effective on January 1. Attachments: OR32-21 OR32-21 Map Director Downing explained that OR32-21 through OR43-21 address properties that have gone through the Neighborhood Improvement Program administered by the Montgomery County Land Bank. The program demolished vacant and abandoned properties that were tax delinquent and the remaining lots were transferred to the City of Trotwood. In the future, the Land Bank will transfer these vacant lots directly to the Community Improvement Corporation so they can work with residents to transfer the property in the Side Lot and Land Utilization Program or on possible redevelopment opportunities. Director Downing explained that the parcels included in these ordinances had previously been transferred by the Land Bank directly to the City; therefore, need to now be transferred to the Community Improvement Corporation so they can also be part of the Side Lot and Land Utilization Program. Attachments: OR44-21 OR44-21 Exhibit A City Manager Pope explained it is part of the City's long-term strategy to address the deteriorating roadways in the City. He reminded Council that there was lengthy discussion during November's Regular Meeting regarding this matter going before the voters in order to allow them to decide on this issue at the May 2022 election. City Manager Pope reiterated that this would be a 0.5% increase to the City's income tax. Deputy City Manager shared that the current street levy generates roughly $200,000 and that does not cover the cost to pave an entire lane mile in the City. She stated the City has applied for grant funds to help with the major collectors, but these programs do not help with residential streets. Deputy City Manager Kellum stated the levy would be for a five year period and would increase the City's income tax by 0.5% for those who are required to pay City of Trotwood income taxes, generating approximately one million dollars for each of those five years; funds would be designated to road reconstruction, resurfacing, and repairs. Mayor McDonald asked if the funds would be dedicated to residential roads. Deputy City Manager Kellum stated that yes and that includes rural areas. Councilmember Page asked how the City will determine which roads will be addressed. Deputy City Manager Kellum shared the study that was conducted listing pavement condition ratings and stated they will start with the roads that are rated the worst. City of Trotwood Page 16 City Council Meeting Minutes - Final December 6, 2021 Councilmember Vaughn commented that the legislation is extremely lengthy and asked how the ballot language will read in order to be understood. Law Director McHugh explained to process to put the levy on the ballot in May 2022. Further, he stated the Ohio Revised Code has specific language that must be used and the specific purpose for the funds must be stated. Coucilmember Vaughn commented that the City will need to educate citizens on the purpose of the income tax levy. Deputy City Manager Kellum explained that City staff are prohibited from taking certain actions when it comes to levies so that they are not seen as undue influencers; therefore, they are limited to simply sharing education information. Councilmember Vaughn stated he understands that education is the only acceptable message from City staff. Mayor McDonald stated she is sure there will be community support because of the good comments already being heard around the work that has been done and that residents are excited to see the work throughout the community. Further, she stated this is what people have been asking for and while previous discussions included more aggressive action, Council considered the current climate and believes this option to be most fair and equitable. He further stated the reason this legislation is being presented to Council as an emergency is due to the timely approval of a specific economic development project. Director Downing shared that this is simply taking away a limitation placed upon the City itself and explained increasing the tax abatement period from 10 years to 15 years as allowed by the Ohio Revised Code. He further explained this will allow the City to be more competitive with peer communities on industrial and other special projects and that Council will still have full authority to review and approve any agreements to this regard; it does not change anything with the current residential CRA work with tornado residents and those building new homes in the community. Attachments: R21-62 R21-62 Exhibit A R21-62 Presentation City Manager Pope shared that this is the final step in the CRA tax abatement approval process for the developers along Main Street. Director Downing stated Council has already seen and approved this planned unit development; this is the senior, high-quality senior housing within the community. Further, he shared that the boards of the Trotwood Madison School District and the Miami Valley Career Technology Center have both approved this agreement and Council's approval is the final step, noting that the abatement is important in supporting this project. After reviewing the details in a presentation (attached), Director Downing explained that after the 15 year abatement period, the ownership will begin paying taxes in full, meaning between years 16 and 20 the City will see a full recoupment of the costs. Attachments: R21-63 R21-63 CBA Police Sergeants City Manager Pope commented that the agreement with Police Sergeants is the last bargaining unit to come to an agreement with the City. He thanked the negotiating teams and commented on the great relationships the City has with the unions. City Manager Pope explained this agreement includes wage increases that are 16% above the top pay for police officers for each of the first two years, with a 16.5% difference in pay for the third year of the contract. City Manager Pope commented that open communication begins with Council and that contributes to the success the City has experienced over the years in working with the unions. Deputy City Manager Kellum reiterated that building a climate of open communication, being transparent with the financial status of the City, and sharing the economic development goals to be accomplished and how the City can reward staff for their work, are all factors that help maintain a positive relationship with the unions as it provides them with an understanding of what the City can and cannot do. Discussion Items SR21-37 Discuss three (3) public places for posting items to be published per new Section 10-8: Publication of the City Charter. Attachments: SR21-37 Attachment Clerk of Council Landis set context by stating that one of the amendments to the Charter created Section 10-8: Publications. She explained said section allows the City to meet the publication requirements for certain items by using two of three methods: 1. Post on the City's website 2. Post in not less than three (3) public places, to be determined by Council 3. Publish in a newspaper of general circulation Clerk Landis requested feedback from Council as to the three public places. She stated she discussed with the Law Director those places being the Government Center, the Library, and the Post Office. Clerk Landis shared the high cost associated with advertising in a newspaper of general circulation and this change allows the City to save money by using the methods of posting on the website and in three (3) public places, when appropriate. Councilmember Vaughn commented that while he understands the reasoning behind the change, he feels it may be underserving the community by not posting at places like the grocery store, dollar store, and other locations frequented by residents. Mayor McDonald stated she is comfortable with the three (3) public places stated and to possibly look into Councilmember Vaughn's suggestions as additional locations. Clerk Landis advised Council that legislation naming these three (3) public places will be presented at the January 2022 Regular Council Meeting. XVIII. Old and New Business a. Mayor: To schedule an appointment with the Mayor, please contact the Clerk of Council at 937-854-7212, between the hours of 8 a.m. - 5 p.m. Mayor McDonald shared that she is a proud alumni of Leadership Ohio. She explained she and others worked on a project regarding food insecurity due to the challenges in the City of Trotwood and as a result, an unexpected $50,000 gift will be going to the Trotwood school district for a fully-funded program to help kids learn how to grow food. Mayor McDonald mentioned the upcoming Gala sponsored by the Greater Dayton Realtist Association, commenting that the City should pay for a table as this group has worked really hard for the City by helping citizens who were impacted by the tornado. Mayor McDonald announced that she has been named one of the 2022 Women of Influence by the YWCA and awards like this are things that bring a significant level of attention the community and it is important in growing the City. Mayor McDonald stated the Christmas Tree Lighting event will air this Sunday at 3:00 p.m. on the City of Trotwood's Facebook page. Mayor McDonald announced that the Library is looking for an Executive Director for the Trotwood location. Further, the architect's of the Trotwood Library were recognized nationally for their design. In addition, Tim Kambitsch, retired executive director, received an award for Advocacy for his efforts to ensure each branch was designed to represent their respective community. c. Clerk of Council: Announcements Clerk Landis shared the following: On Tuesday, December 7th, the Trotwood Branch of the Dayton Metro Library will host a special Christmas program featuring a reading of The Polar Express, singing, and photos with Santa.
