Ms. Orihood is very excited for what is to come and she has great hope for Trotwood. VII. Special Presentations and Recognitions PR22-23 Dayton Metro Library, Trotwood Branch Update Presented by Yoonmee Hampson, Branch Manager Ms. Yoonmee Hampson, Dayton Metro Library's Trotwood Branch Manager, shared details about the library's activities in 2023 and thanked the City for their support. PR23-23 Annual Storm Water Education Presented by Johnny McCluskey, Operations Supervisor Operations Supervisor Johnny McCluskey shared a video entitled "Managing Stormwater Runoff" as part of the annual reporting requirements for the Municipal Separate Storm Sewer Systems (MS4s) permit renewal. Finance Director Peeples added that reappropriations are done to cover the expense of unexpected expenditures and increased costs while keeping a balanced budget. Attachments: OR40-23 OR40-23 Exhibit A City Manager Pope shared that the purpose of this ordinance is to ensure access to fire hydrants that are on private property. Chief Haacke stated that this provides a remedy for when fire hydrants are not accessible due to overgrowth. He explained that the City will first notify a property owner that they are in violation and if the area is not cleared within a certain amount of time, the City has the authority to enter the property and remedy the issue, which is contained to a three-foot circumference around the hydrant. R21-30 ON JULY 6, 2021, AND SUBSEQUENTLY AMENDED BY RESOLUTION NOS. R21-50 ON NOVEMBER 1, 2021 AND R22-14 ON MARCH 7, 2022. R21-29 ON JULY 6, 2021, AND SUBSEQUENTLY AMENDED BY RESOLUTION NO. R21-49 ON NOVEMBER 1, 2021. Attachments: R23-78 R23-78 Exhibit A City Manager Pope shared that this Resolution opens the Collective Bargaining Agreement with Public Works, similar to the Agreement with Police back in October 2023 and the previous legislation for Firefighters, in order to keep parity within the organization. City Manager Pope added that the City has great relationships with the unions and he appreciates the ability to work together and that this issue began with the Police Department and Chief Wilson's concerns regarding the department's inability to attract and/or recruit candidates due to low wages. City Manager Pope shared that he met with Council and reviewed data that supported the need to increase wages in order to attract the best candidates and, because the City has a history of treating all employees the same, any time a benefit is provided to any one bargaining unit, all other employees receive the same benefit. Mayor McDonald asked Chief Wilson to speak and he reiterated the same concerns and needs. Mayor McDonald requested a Motion to approve Resolution No. R23-78. Attachments: R23-79 City Manager Pope stated that this legislation would allow the City to place a 12-month moratorium on newly proposed storage facilities due to an abundance of applications. City Manager Pope believes there may be better locations for such businesses and he would like some time to review this in conjunction with the comprehensive land use plan. A Motion was made by Councilmember Brown, seconded by Vice Mayor Page, and the Motion CARRIED by the following vote: Aye: 6- Mayor McDonald, Council Member Kelley Jr., Council Member Gales, Council Member Brown, Council Member Vaughn and Vice Mayor Page Excused: 1- Council Member Finley City of Trotwood Page 10 City Council Meeting Minutes - Final December 4, 2023 R23-80 A RESOLUTION BY THE TROTWOOD CITY COUNCIL IMPOSING A MORATORIUM UP THROUGH AND INCLUDING DECEMBER 31, 2024, ON THE ACCEPTANCE OF APPLICATIONS FOR, AND THE ISSUANCE AND PROCESSING OF, PERMITS ALLOWING ADULT USE CANNABIS OPERATORS WITHIN THE CITY OF TROTWOOD. Attachments: R23-80 City Manager Pope explained that this would allow for a 12-month moratorium on permits for businesses related to recreational marijuana. He added that the state is working on H.B. 341 in hopes of adding more regulations before the new law goes in to effect on December 7. He believes this issue has revolved rather quickly and that the City needs more time to evaluate the specifics in order to make adjustments and determine appropriate regulations and personnel policies. City Manager Pope stated that for him, the fact that the state doesn't know what they are doing is the biggest influence on this ask for time to work with the law department in order to do what is best for this community. Mayor McDonald asked City Manager Pope if there will be an opportunity for input from residents. City Manager Pope suggested the City may schedule a Workshop and other forums in order to hear from the community. Vice Mayor Page asked City Manager Pope if the 12-month moratorium closes the door completely to recreational marijuana, including cultivation. City Manager Pope explained that no, this request does not close the door permanently, it simply gives the City time to review the law and determine what is best for the community as a whole and that although the issue was voted on by the people, even the state is not ready to proceed with legalization. He is simply asking that the City be prudent, not reactionary to the issue. City Manager Pope added that small retail stores only employ one or two employees and do not generate much in tax dollars for the City; therefore, this moratorium would not have much short-term effect. He did state that a processing plant with 200 employees is a different conversation which is why it is important to understand that what is good for one community may be difference than what is good for this community, and further, if H.B. 341 is approved those changes would most likely affect any premature decisions. Law Director Conard added that the current law contains many interesting provisions and local control mechanisms and he agrees, just like medical marijuana, with the recommendation to wait and see what legislators decide because we simply don't know. He added that he fully expects the moratorium will not be for the entire year and expects to come back to Council late summer or early fall with a better idea of what is best for this City. Vice Mayor Page clarified the distinction between a dispensary, which employees just a few people, and a cultivating business that employees around 200 people making $40.00 to $50.00 per hour, generating large tax dollars for the City; she simply doesn't want the City to lose out on such opportunities and further, it is what the citizens voted for and she believes it is important for them to know the City is listening. Attachments: R23-81 Operations Supervisor McCluskey explained that the Newfields Dam is inspected by ONDR every five (5) years. and this year ODNR is recommending that the dam's outlets be protected from erosion so they don't wash away. Comments A. Clerk of Council: Announcements Clerk Landis approached the podium and presented a Key to the City of Trotwood to the outgoing Mayor, Mary McDonald, and outgoing Council Member, Robert Kelley, Jr., for their years of service on the Trotwood City Council. City of Trotwood Page 13 City Council Meeting Minutes - Final December 4, 2023 B. Council Members: Each Council Member will have three (3) minutes to speak about topics relating to the City of Trotwood that are not on the Meeting Agenda. Councilmember Kelley, Jr. expressed his appreciation to the community and congratulated Mayor-Elect Page. He feels she will do a excellent job as she is very genuine, spiritual, and focused. Councilmember Gales expressed her pleasure in working with Councilmember Kelley, Jr. and Mayor McDonald and thanked Mayor McDonald for all her hard work in bringing Trotwood back to the top. She shared that she is glad to be on City Council and that she intends to do all that she can to keep the City moving forward. Vice Mayor Page promised that the City will continue as it has been because it's not I or me, it's we - seven equal votes. She thanked Mayor McDonald for the time she gave to the City, for her tenacity and insight, and to those people who held her up. She let residents know not expect anything less in 2024 and added that she looks forward to Mayor McDonald being a part of what Council has built. Vice Mayor Page thanked Councilmember Kelley, Jr. for his service and added that while she may be a new mayor, she is not new to the City and she plans to further elevate Trotwood. Councilmember Vaughn shared that over his 22 years on Council, he has worked with several mayors, but none as persistent, self-giving, and wise as Mayor McDonald; she is the exception. He explained how everyone sees things differently and discussed how important it is to agree to disagree and gave the example of legalized marijuana. Councilmember Vaughn commented that he means no disrespect to residents, but due to his many years in public service, he sees this issue from a different prospective, one of great concern for issues relating to mental health, graduation rates, crime, etc. Councilmember Brown commented that she attended one of the Focus Groups on community engagement and she looks forward to the next steps in the process. She also thanked Councilmember Kelley, Jr. and Mayor McDonald for her for vision, patience, push, and all that she's done and will continue to do. C. City Manager City Manager Pope thanked Mayor McDonald and Councilmember Kelley, Jr. for their service and commented that he has enjoyed fighting alongside of them for issues important to the City of Trotwood. D. Mayor Mayor McDonald thanked the City of Trotwood for 18 years of service and stated that she has learned a lot. Over the first 10 years, she watched businesses come and go and over the last 8 years, she has witnesses growth beyond what she could have ever imagined. She believes the community is alive again because she learned to work together and with others because this Community represents all parties. She added that leadership must understand that the goal is to bring good to all citizens. Mayor McDonald reviewed the many accomplishments during her tenure.
