Call to Order The meeting was called to order at 6:30 p.m. II. Invocation Mayor Page gave the Invocation. III. Pledge of Allegiance Mayor Page led the Pledge of Allegiance. IV. Roll Call Clerk Landis took Roll Call and announced that Council Member Clark was unable to attend the meeting. Further, Council Member Clark provided proper notice of her qualifying reason pursuant to Council Rule 4.5; therefore, her absence is excused. City of Trotwood Page 3 City Council Meeting Minutes - Final January 6, 2025 R25-09 A RESOLUTION BY THE TROTWOOD CITY COUNCIL AUTHORIZING THE CITY-SPONSORED ANNUAL CHRISTMAS TREE LIGHTING EVENT TO SERVE THE PUBLIC PURPOSE OF PROMOTING STRONG COMMUNITY RELATIONS, WITH EXPENDITURES NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00). Attachments: R25-09 This Resolution was approved. 25-01 A Motion by the Trotwood City Council to schedule a Public Hearing and to authorize the Law Director to prepare legislation authorizing the City Manager to transfer 5.148 acres located within the Sherwood Park tract by Quit Claim Deed to Five Rivers MetroParks to extend the Wolf Creek Recreational Trail for the public’s benefit and declaring the property surplus. Resolutions R25-03 A RESOLUTION BY THE TROTWOOD CITY COUNCIL AUTHORIZING THE CITY MANAGER TO PURCHASE A 2025 MEDIC UNIT (MEDIX MODEL MSV-II 170 WITH A FORD F550 XLT GAS CHASSIS) FROM PENN CARE, INC. THROUGH THE SOURCEWELL GOVERNMENT PURCHASING PROGRAM, CONTRACT #122123-MDX, BY UTILIZING CAPITAL IMPROVEMENT FUNDS IN AN AMOUNT NOT TO EXCEED $276,837.00. Attachments: R25-03 Deputy City Manager Kellum explained that this new medic unit will allow the department to replace their current medic unit, a 2010 model. She stated that when the new medic is received, the 2010 unit will be taken out of service, but kept as a backup unit. She added that the life span of a medic unit is 10-12 years and that the City does a great job of maintaining equipment to ensure its useful life. Vice Mayor Brown asked about the status of the new medic unit purchased a few years ago. Chief Haacke shared that the new unit was actually to be delivered today; however, due to the poor road conditions because of the weather, the unit slid off the road on its way to Trotwood. He stated that he was told there is only minor cosmetic damage, but that they will have the unit inspected by a Ford dealer to ensure there is no other damage. Council Member Finley asked if it would be possible to return the medic unit for another vehicle. Chief Haacke explained that because units are only built when they are ordered there is no inventory available to buy, which means it would be another three (3) year wait. He went on to explain that the reason the City purchases a new unit so far in advance is because they have to plan ahead to ensure they receive the new unit before the older unit reaches its end of life. Council Member Finley asked if they plan to ask for any type of compensation to remedy the situation. Chief Haacke stated that they most definitely will hold the company responsible for any issues as a result of the incident. He added that should there only be cosmetic damage, once it is repaired, the unit will be wrapped and any cosmetic repairs will then be hidden. Mayor Page requested a Motion to approve Resolution No. R25-03. A Motion was made by Vice Mayor Brown, seconded by Council Member Finley, and the Motion CARRIED by the following vote: Aye: 5- Council Member Gales, Council Member Moore, Council Member Finley, Vice Mayor Brown and Mayor Page Excused: 1- Council Member Clark City of Trotwood Page 5 City Council Meeting Minutes - Final January 6, 2025 R25-04 A RESOLUTION BY THE TROTWOOD CITY COUNCIL ACCEPTING THE BID FROM AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH ADVANTAGE EQUIPMENT, INC. FOR THE PURCHASE OF THREE (3) TURNOUT GEAR DRYING SYSTEMS, FOR THE TOTAL SUM OF $30,000.00, TO BE PAID FOR WITH GRANT FUNDS IN THE AMOUNT OF $27,000.00 FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY ASSISTANCE TO FIREFIGHTERS GRANT, AND THE MINIMUM REQUIRED MATCH OF 10% FROM THE CITY OF TROTWOOD. Attachments: R25-04 Deputy City Manager Kellum shared that these drying units will efficiently dry the Fire and Recue Department's turnout gear to ensure it is ready for the next call. She added that the dryers will also help ensure the useful life of the gear. Deputy City Manager Kellum stated that a drying unit will be placed at each station. A Motion was made by Council Member Gales, seconded by Vice Mayor Brown, and the Motion CARRIED by the following vote: Aye: 5- Council Member Gales, Council Member Moore, Council Member Finley, Vice Mayor Brown and Mayor Page Excused: 1- Council Member Clark City of Trotwood Page 6 City Council Meeting Minutes - Final January 6, 2025 R25-10 A RESOLUTION BY THE TROTWOOD CITY COUNCIL STRONGLY OPPOSING THE PROPOSED PAPER RECYCLING PLANT TO BE LOCATED IN THE CITY OF DAYTON AT THE INTERSECTION OF OLIVE ROAD AND LITTLE RICHMOND ROAD. Attachments: R25-10 Law Director Conard announced that because his law firm has an interest in this matter, he is removing himself from the dais and that he will wait in the hallway until Council has voted on the legislation. Deputy City Manager Kellum explained that although this issue has been previously discussed with Council, it was determined that a resolution from City Council documenting the many concerns would be helpful to communicate their level of opposition. She stated that PFAS and added truck traffic are just a couple of the major concerns with building the factory so close to residential areas. She added that concerns have been voiced by both Trotwood and Dayton citizens and local businesses. She stated that City Manager Pope and she have reached out to various departments in Dayton and learned that they are unable to speak out against one another. Deputy City Manager Kellum shared that the owners of the recycling business were not pleased to learn the magnitude of opposition expressed. Council Member Finley asked if Mayor Page has spoken with Dayton Mayor Jeff Mims about the issue. Deputy City Manager Kellum stated that Mayor Mims has chosen to not speak about the matter. Council Member Finley commented that because Mayor Page has a personal relationship with Mayor Mims, maybe he would speak with her. Mayor Page confirmed that Mayor Mims has chosen to not discuss the issue. Council Member Gales asked if this was the same type of factory that used to be in West Carrollton. Mayor Page answered that it is, as well as in Chillicothe, Wapakoneta, and Lima. Council Member Gales expressed her concerns knowing that Trotwood receives their water supply from the City of Dayton and she couldn't understand why Dayton officials would think this is a good idea. Deputy City Manager Kellum agreed, and added that Dayton has been in a lawsuit with Wright Patterson Air Force Base over water quality. Council Member Moore asked if Trotwood allows for such use in the Zoning Code. Deputy City Manager Kellum advised that this type of use is prohibited in the City of Trotwood, as well as in the City of Dayton. She explained that the business presented their proposal to the Dayton Plan Board, who tabled the discussion. Council Member Moore asked about how many residents this might affect. Deputy City Manager Kellum stated that at least 500 homes would be affected if this plant were to locate at the corner of Olive Road and Little Richmond Road. She added that these types of factories are typically placed in rural areas away from residential areas. Council Member Moore asked what the gain would be for the City of Dayton. Deputy City Manager Kellum shared that they speculate it could bring around 200 jobs to the City; however, she personally does not feel the jobs would pay enough for it to be a substantial gain. Council Member Finley asked about counsel representation since Law Director City of Trotwood Page 7 City Council Meeting Minutes - Final January 6, 2025 Conard has a conflict. Deputy City Manager Kellum explained that the City has other law firms available to handle specific matters such as this should the need arise. Council Member Finley asked if any other locations have been discussed. Deputy City Manager Kellum advised that there have been three (3) other locations suggested, but to her knowledge, no action has been taken to consider the alternate sites. Deputy City Manager Kellum shared that she hopes that ultimately the City of Dayton does not change their allowable uses, which would mean that the proposed factory would not be permitted. Mayor Page expressed her appreciation for all of the questions and discussion. She reminded council members that the purpose of the legislation is to show that the City of Trotwood is in agreement with its residents and businesses in opposing the recyling factory, and then requested a Motion to approve Resolution No. R25-10. Staff Reports SR25-03 Trotwood City Council 2025 Appointments to Boards/Commissions Attachments: SR25-03 Appointments Clerk Landis explained that every year, Council Members are appointed to certain boards and commissions to serve on behalf of the Trotwood City Council. She then read the appointments for calendar year 2025. Mayor Page requested a Motion to approve Staff Report SR25-03. Old and New Business City of Trotwood Page 8 City Council Meeting Minutes - Final January 6, 2025 XI. Comments A. Clerk of Council Clerk Landis thanked Operations Supervisor Johnny McCluskey and his staff for their hard work to clear the roadways and the parking lot. C. City Manager Deputy City Manager Kellum stated that she is excited for what is to come in 2025. She announced that she and City Manager Pope will be attending the NLC City Conference to be held in D.C. in March and that she looks forward to learning more information on upcoming infrastructure projects that will help to improve the City. D. Council Members Council Member Gales shared that she administered the Oath of Office to Mary McDonald, the newly elected Montgomery County Commissioner, and that she is very excited to see the former Trotwood Mayor and a Trotwood resident serving at the county level. Council Member Denise Moore stated that she attended Commissioner McDonald's Oath of Office ceremony and that it was a very eloquent event, which was held in the City of Trotwood. Vice Mayor Brown shared that she too will be attending the City Conference sponsored by the National League of Cities in March with Mayor Page, City Manager Pope, and Deputy City Manager Kellum. She added that she too attended the Oath of Office Ceremony for Commissioner McDonald and agreed that it was a very nice occasion. E. Mayor Mayor Page shared the same sentiments about attending Commissioner McDonald's Oath of Office Ceremony and asked the Commissioner's Chief of Staff David Young, who was in attendance, to stand. She also recognized Marcus Davidson, the Commissioner's Administrative Aide. Mayor Page shared that she understands the Trotwood Community was built by its past leaders and she expressed her appreciation for City staff and all they have done to make this past year so successful.
