Minutes of the Regular Meeting of The Troy City Council February 5, 2015 The meeting was called to order at 7:04 PM by City Council President Wiltshire. Pledge of allegiance was led by Lenny Welcome. The roll being called the following answered to their names Council Members, Doherty, Zalewski, Kopka, Gordon, Bodnar, Teta, and Wiltshire. Also present were Mayor Lou Rosamilia, Kelly Cramer Esq. Adam Sanzone and several Department Heads. The meeting was attended by approximately 40 members of the public. Public Comment: None Consideration of Ordinance: 5. Ordinance Authorizing and Directing the Reconveyance of City-Owned Real Property (188 Hill Street). Ordinance passed by unanimous vote 6. Ordinance Authorizing and Directing the Reconveyance of City-Owned Real Property (21 120th Street). Ordinance passed by unanimous vote 7. Ordinance Authorizing and Directing the Reconveyance of City-Owned Real Property (1035 Sixth Avenue). Ordinance passed by unanimous vote 8. Ordinance Authorizing and Directing the Reconveyance of City-Owned Real Property (2829 Sixth Avenue). Ordinance passed by unanimous vote 9. Ordinance Authorizing and Directing the Reconveyance of City-Owned Real Property (731 River Street). Ordinance passed by unanimous vote 10. Ordinance Amending the Code of Troy, Chapter 71 Planning Commission, Section 71-2 “Establishment; Appointments Ordinance passed by a vote of 6 yes to 1 no (Gordon) 11. Ordinance Approving Settlement of Tax Certiorari Proceedings Instituted by Gail Spiak on the Assessment Roll of the City of Troy. Ordinance passed by unanimous vote 12. Ordinance Authorizing and Directing Sale of City Owned Real Property by the Proposal Method Gordon spoke about the Federal St. property; he asked for an explanation on the advertising process for this property and the difference of surplus and rite of way. Gordon had concerns it was not advertised the correct way. Silverman explained the difference and stated there was only on proposal on this property. Gordon motioned to strike this property from the list and re-advertise to make sure it was done correctly. Wiltshire asked Sharon Martin to describe the actual location of the property and the easement agreement. Martin stated there was an easement, now the city took ownership of the parcel. She stated that advertising is very costly so they lumped all properties together to save money. Doherty stated to promote business in Troy it make sense to sell it to the bidder. .He stated it is already in use; it is to small to be used any other way. He felt if some one else was to purchased the property they may try to extort money from the business to buy it from them. Zalewski asked if Kings St. properties LLC was Boyajian. Martin stated yes. Zalewski asked if the owner of Boomer’s business bid on the property. Martin said no this was the only bid. Wiltshire asked when the easement ended. Martin stated she thinks it was for 1 year but she’s not sure. Wiltshire asked if the City receives any money for its use. Silverman stated there is no compensation or rental fee. Zalewski asked if there is any liability on the City. Silverman stated yes it is city owned property; this would move it out of the City’s hands. Motion to Amend by Gordon 2nd by Bodnar; to strike the Federal St. property from the ordinance. Amended Ordinance failed by a vote of 4 no to 3 yes (Gordon, Bodnar, Wiltshire) Ordinance passed by unanimous vote 13. Ordinance Authorizing and Directing Settlement of Claim 2014-69 to wit Anthony Busone v. City of Troy. Ordinance passed by unanimous vote 14. Ordinance to Amend the FY 2015 Budget to Receive Federal Revenue in the Amount of $17,600 from the “Police Traffic Services Program,” Grant Administered Through the NYS Governor’s Traffic Safety Committee and Appropriate the Funds to the Troy Police Department Accounts in the same Amount for Expenditure Gordon stated he would abstain from voting. Ordinance passed by a vote of 6 yes to 1 abstain (Gordon) 15. Ordinance to Amend the FY 2015 Budget to Receive Federal Revenue in the Amount of $7,300 from the “Bicycle Helmet Safety and Child Safety Program,” Grant Administered Through the NYS Governor’s Traffic Safety Committee and Appropriate the Funds to the Troy Police Department Accounts in the same Amount for Expenditure Gordon stated he would abstain from voting. Ordinance passed by a vote of 6 yes to 1 abstain (Gordon) 16. Ordinance Authorizing and Directing Sale of City Owned Real Property by the Proposal Method Ordinance passed by a vote of 6 yes to 1 no (Gordon) Consideration of Resolutions: 5. Bond Resolution of the City of Troy, New York Authorizing the Issuance of $3,537,411 in Serial Bonds to Finance a Capital Project Described in the Combined Sewer Overflow Long Term Control Plan. Gordon asked Chris Wheland if the rate increase amount funds in budget to help fund this. Wheland stated only the first quarter but funds are in there at this point. Resolution passed by unanimous vote 12. Resolution Appointing Commissioners of Deeds for the City of Troy Resolution passed by unanimous vote 13. Resolution Confirming David Martin’s Appointment to the Troy Community Land Bank Zalewski spoke in support of Mr. Martin being appointed to the Land Bank. Kopka stated she still did not receive a copy of his resume. Gordon also stated the same. Resolution passed by a vote of 4 yes to 3 no (Gordon, Bodnar, and Kopka) 14. Resolution Authorizing the Mayor to Execute a Memorandum of Understanding with the City of Cohoes for the Purpose of Providing the use of an Unused Radio Frequency Gordon stated he would support this but thought we should be getting more than a dollar for the fee. Wiltshire stated he hope that maybe they will participate in mutual aid now. Gordon stated we do send people over there. Doherty stated the Mayor explained the reason for this and that it was a good faith offer. Bodnar stated that Cohoes does not participate but if they had it might have helped us with all the fires we had in Lansingburgh. He stated he doesn’t mind supporting this but it bewilders him as to why they don’t participate in mutual aid. Resolution passed by unanimous vote 16. A Resolution Authorizing the Implementation, and Funding in the First Instance 100% of the Federal-Aid and State “Marchiselli” Program-Aid Eligible Costs, of a Transportation Federal-Aid Project, and Appropriating Funds Therefore Resolution passed by unanimous vote Public Comment: None ADJOURNMENT Council Member Gordon moved for adjournment, 2nd by Zalewski And the meeting was adjourned at 8:27 pm.
