Resolution Amending Proposed 2020 Troy City Budget (Council President Mantello)  ORD116 ORDINANCE APPROPRIATING THE VARIOUS AMOUNTS OF FUNDS IN THE CITY OF TROY BUDGET FOR FISCAL YEAR 2020 AND LEVYING TAXES ON ALL TAXABLE PROPERTY WITHIN THE CITY OF TROY IN THE AMOUNT REQUIRED TO BE RAISED BY PROPERTY TAXES IN THE CITY OF TROY FOR THE FISCAL YEAR 2020 BUDGET ____________________________________________________________________________ The City of Troy, in City Council convened, ordains as follows: Section 1. Pursuant to the City of Troy Charter § 47-K, the City Council is required to adopt an ordinance appropriating the various amounts of money as set forth in the fiscal year 2020 City Budget necessary for the operation of the City government. Section 2. The City Council hereby appropriates the various amounts of money set forth in the 2020 budget as approved for the several departments, bureaus, divisions, offices, courts, boards and commissions of the City and for the several purposes specified in the fiscal year 2020 City Budget. Section 3. Pursuant to the Troy City Charter, § 47-N, the City Council is required to levy taxes on all taxable property in the City of Troy as shown on the annual tax assessment rolls to raise the amount of revenue required by the City Budget for fiscal year 2020, through the collection of property taxes. Section 4. The amount of $25,716,297 as set forth and specified in the City Budget for Fiscal Year 2020 is hereby determined to be the amount of revenue required to be raised from real property taxes for fiscal year 2020. Section 5. The said amount of $26,116,297 is hereby levied, assessed and raised by property tax on all taxable property within the City of Troy as shown on the annual assessment rolls for the City of Troy. Caruso, Corporation Counsel  ORD116 Memo In Support Pursuant City Charter §47-N, the final legislative task imposed on the City Council at the Special Meeting is to pass an ordinance setting the tax levy for the City for all taxable property on the assessment roll of the City. The purpose of this ordinance is to obtain the actual revenues necessary to support those expenditures contained in the approved City Budget that are funded via property taxes collected by the City.  RES83 RESOLUTION ADOPTING THE MAYOR’S RECOMMENDED BUDGET FOR THE CITY OF TROY FOR FISCAL YEAR 2020 OR ADOPTING AN AMENDED BUDGET FOR THE CITY OF TROY FOR FISCAL YEAR 2020 ____________________________________________________________________________ WHEREAS, pursuant to City Charter § 47-E, the Mayor filed with the City Clerk a budget message and recommended budget for the City of Troy for Fiscal Year 2020 on10/10/2019; and WHEREAS, pursuant to City Charter § 47-F, the City Council conducted a special meeting on 10/15/2019 at which it referred the recommended budget to the City Council Finance Committee which in turn referred the recommended budget to the respective Standing Committees of the City Council; and WHEREAS, pursuant to City Charter § 47-H, the Finance Committee and respective Standing Committees of the City Council conducted preliminary public hearings between 10/17/2019 and 11/12/2019; and WHEREAS, pursuant to City Charter § 47-H, the Finance Committee and respective Standing Committees of the City Council, on 11/15/2019, filed reports with the City Clerk regarding the preliminary public hearings; and WHEREAS, pursuant to City Charter § 47-I, a meeting of the Mayor and the City Council was held on 11/19/2019 to review suggested changes to the recommended budget; and WHEREAS, pursuant to City Charter § 47-J, a final public hearing was conducted on 11/21/2019 at which all persons desiring to be heard in relation to the budget estimates in the recommended budget were given an opportunity to do so; and WHEREAS, pursuant to City Charter § 47-K, the City Council is conducting a special meeting on 11/26/2019 to adopt the Mayor’s recommended budget or to amend and adopt a budget for the City of Troy for Fiscal Year 2020 and to submit same to the Mayor for approval. NOW, THEREFORE, BE IT RESOLVED, the Mayor’s recommended budget be adopted; or in the alternative, the City Council’s amended budget and the estimates contained therein be adopted; with such adopted budget to be in the amount of $74,740,743. Caruso, Corporation Counsel  RES83 Memo In Support City Charter § 47-K provides that the City Council shall hold a special meeting, after the final public hearing to accomplish certain specific tasks related to the budget and the funding of City operations in the upcoming fiscal year. That special meeting has been scheduled for 11/26/2019. One legislative task to be accomplished at the meeting by the City Council is to approve the Mayor’s recommended budget or to amend and adopt an amended budget. In the event that the Council does neither, the Mayor’s recommended budget takes effect. The Mayor’s proposed budget, submitted to the City Clerk on October 10, 2019, included appropriations in the General Fund totaling $74,740,743, Garbage Fund appropriations totaling $4,339,671, Water Fund appropriations totaling $14,675,024 and Sewer Fund appropriations of $4,945,852. This resolution adopts, or amends and adopts, the Mayor’s proposed budget. This resolution reflects the appropriations in each of the City’s four operating funds as proposed by the Mayor for the 2020 fiscal year and does not include any potential amendments by the Troy City Council.  RES84 RESOLUTION APPOINTING DANIEL P. MCCARTHY TO THE BOARD OF ASSESSMENT REVIEW OF THE CITY OF TROY WHEREAS, Daniel P. McCarthy, residing at177 River Street 3 East, Troy, New York, desires to serve the City of Troy and its property owners as a member of the Board of Assessment Review and possesses the credentials to serve with competence, diligence and dedication; and WHEREAS, Mr. McCarthy will serve a five (5) year term in office and will fill the vacancy created by Janice Cohen who has resigned due to the fact that she no longer lives in the City of Troy. It is the sense of this Legislative Body that Mr. McCarthy should be appointed to fill this vacancy; and NOW, THEREFORE, BE IT RESOLVED, that, pursuant to Section 523 of the Real Property Tax Law; Mr. McCarthy is hereby appointed to the Board of Assessment Review for the uncompleted term of five (5) years, to commence immediately and will expire September 30, 2019. A requirement of the members is they must live in the City. Board Member, Janice Cohen has moved out of the City and has resigned from the Board. Janice's term expires 9/30/19. Janice was originally chosen for the board because she is a local Realtor. Having a Realtor on the Board with access to the Multiple Listing Service has been beneficial to the Board. I contacted Michael Flynn, also a local Realtor, to ask for a recommendation for a Realtor replacement for the Board. Michael recommended Daniel P. McCarthy. Daniel forwarded his resume and is interested in serving on the Board. I have attached Daniel's resume with this memo. Please consider appointing Daniel to finish Janice Cohen's term through 9/30/19. Alma Industries, Boston, MA 1989-1991 Northeast Regional Sales Manager • Wood manufacturer of high quality office furniture. • Responsibilities included sales through dealers throughout Boston, ME, VT, NH and upstate NY in non-represented areas direct sales. • Company was hurt with downturned economy and was liquidated.  RES85 RESOLUTION AMENDING PROPOSED 2020 TROY CITY BUDGET WHEREAS, the City of Troy adopted a 1 year temporary garbage fee of $161 per unit in 2018; and WHEREAS, the temporary garbage fee was made permanent at $164 per unit in 2019; and WHEREAS, the proposed 2020 city budget is increasing the garbage fee to $180 per unit; and WHEREAS, the garbage fee has not substantially increased services or reduced the waste stream to date; and WHEREAS, the increase in the garbage fee to $180 per unit and a 2019 bulk rate charge puts an undue burden on Troy taxpayers. NOW, THEREFORE, BE IT RESOLVED, the proposed 2020 budget is amended to cap the garbage fee at $164 per unit for the years 2020 and 2021. This resolution shall take effect immediately.
