Minutes of the TROY CITY COUNCIL PUBLIC HEARING Local Law #1 Thursday, April 29, 2021, 5:45 p.m. Due to the COVID-19 crisis, this meeting was held remotely via videoconference. The meeting was called to order at 5:47 p.m. by Council President Mantello. Pledge of Allegiance Roll Call: The roll being called, the following answered to their names: Council Member Gulli, Council Member Ashe-McPherson, Council Member Steele, Council Member Cummings, Council Member Zalewski, Council Member McDermott, Council President Mantello, Chair. Public Forum: No one came forward. Adjournment The meeting adjourned at 5:51 p.m. A video recording of this meeting is on file at the City Clerk's office.

A Local Law Amending §C-48(H)(3) Of The Charter Of The City Of Troy To Authorize Installment Agreements For The Payment Of Eligible Delinquent Taxes Over A Term Of Thirty Six Months *PUBLIC FORUM Due to the current COVID-19 crisis and pursuant to Governor Andrew Cuomo’s Executive Order No. 202.1, this meeting shall be held remotely via videoconference and live-streamed on the City Council’s YouTube channel. Troy residents who wish to comment during the public hearing must have the ability to join the Zoom meeting via computer or phone and will be required to pre-register for the meeting. The link to register for the meeting will be posted at least 24 hours before the meeting on the Council Agenda and Minutes page and sent out through the City Clerk’s public notices email list. You must register for the hearing by 3 pm on the day of the hearing. Per the City Council, written comments will not be read aloud at this hearing but will be added to the hearing minutes. Written comments should be sent to mara.drogan@troyny.gov and must be received by 3 pm on the day of the hearing. You must include your full name and residential address, as required by Council rules. Written comments received after 3 pm shall be treated as correspondence and forwarded to the Council for their review. LL1 A LOCAL LAW AMENDING § C-48 (H) (3) OF THE CHARTER OF THE CITY OF TROY TO AUTHORIZE INSTALLMENT AGREEMENTS FOR THE PAYMENT OF ELIGIBLE DELINQUENT TAXES OVER A TERM OF THIRTY SIX MONTHS Be It Enacted by the City Council of the City of Troy, as follows: Section 1. Subsection C-48 (H) (3) of the Charter of the City of Troy is amended as follows: H. Installment Payment Plans for Delinquent Taxes. 3. The term of the installment agreement shall be for twenty-four thirty six months, the payment schedule shall be monthly, quarterly, or semi-annually. The required initial down payment shall consist of the amount due on the current City and County property tax bill; the amount due on any current school district tax in collection by the City; and ten percent (10%) of the eligible delinquent taxes and eligible properties shall include all properties within the City of Troy. Should an eligible owner pay off the amount owed under the agreement early, there shall be no adjustment of the amount of the payments. Section 2. This Local Law shall apply retroactively to all current installment agreements, so that upon application by an Eligible Owner, the Enforcing Officer shall adjust the term and schedule of payments to conform to this amendment. Section 3. The City Council hereby enacts the foregoing amendment to Troy City Charter § C-48 (H) (3), and authorizes the codification of this amendment, with the elimination of the words herein struck out and the addition of the underlined words, as delineated in Section 1 of this Local Law. Section 4. This Local Law shall take effect immediately upon its adoption and filing in accordance with State Law. Approved as to form, ____________________________ ____ Richard T. Morrissey, Corporation Counsel LL1 Memo in Support The purpose of this amendment is to conform the City Charter to Real Property Tax Law § 1184(3)(a), which now allows installment agreements for the payment of delinquent taxes over a 36 month term. It is hoped that the longer term will enable more taxpayers to successfully enter into and complete installment agreements for the payment of their delinquent taxes.
