Titterington DATE: February 5, 2025 SUBJECT: ANNEXATION FROM CONCORD TOWNSHIP, SMITH ANNEXATION, 57.679 ACRES, MORE OR LESS; LOCATED ON FENNER ROAD AT WILSON ROAD An annexation petition from Concord Township was filed with the Miami County Commissioners on February 5, 2025, and with the Clerk of Council on February 5, 2025, by William M. Harrelson 11, agent on behalf of David Paul Smith. The annexation petition is for a total of 57.679 acres, more or less, located on Fenner Road at Wilson Road. A copy of the annexation plat is attached. This annexation was filed under the Type 2 Expedited Procedure, which has requirements of: 1. Twenty days from the date of filing with the County, the City is required to ,approve a statement of what municipal services will be provided to the area proposed for annexation and a time frame for providing those services. 2. Twenty days from the date of filing with the County, the City is required to approve legislation that the City will require buffering of any incompatible uses developed on the newly annexed territory from existing uses on land remaining in the Township. 3. Twenty-five days from the date of filing with the County, the City is to enact legislation consenting to or objecting to the annexation. Failure to do so shall be considered consent by the City when reviewing the annexation petition. Based on the Statutory time frame, we ask for consideration of emergency legislation. Water Street Troy, Ohio 45373 The Ohio Revised Code requires that a municipal corporation shall adopt, by ordinance or resolution, a statement indicating what services the municipal corporation will provide, and an approximate date by which it will provide them, to the territory proposed for annexation, upon annexation. Under the ORC Section that the Smith Annexation was filed, the statement of services must be approved by Council and filed with the County not later than 20 days after the annexation petition was filed with the County. Such statement is as follows: That immediately upon the effective date of the annexation of the 57.679 acre territory, the City ofTroy, Ohio will provide to the entire annexed territory such services as are otherwise provided to incorporated areas under the Code of Ordinances of the City of Troy, Ohio in accordance with applicable contemporary law, practice, custom, regulation, rates and resources. Such statement is as follows: If the 57.679 acres known as the Smith Annexation is annexed and becomes subject to zoning by the City of Troy and that City of Troy zoning permits uses in the annexed area that the City of Troy determines are clearly incompatible with the uses permitted under current Miami County or Concord Township Zoning Regulations in the adjacent land remaining within Concord Township from which the territory was annexed, the Troy City Council will require, in the zoning ordinance permitting the incompatible uses, the owner of the annexed territory to provide a buffer separating the use of the annexed territory and the adjacent land remaining within the township. Titterington, Director of Public Service and Safet W DATE: February 7, 2025 SUBJECT: CONTRACT FOR SERVICES WITH UPPER VALLEY MEDICAL CENTER RECOMMENDATION: That Troy City Council authorizes the Director of Public Service & Safety to execute two documents related to providing emergency 911 response to the UVMC campus. Those documents include an agreement to accept a $175,000 grant from the Upper Valley Medical Center (UVMC) Community Benefits Fund to offset the purchase of an ambulance van (Sprinter) and an agreement for payment for emergency response services by UVMC. BACKGROUND: As you are aware, the City of Troy has agreements with the townships of Concord, Staunton and parts of Lost Creek to provide Fire and/or EMS response. 1n 2016, Concord Township Trustees and the Troy Fire Chief began reviewing fire and EMS call data to so that the trustees would have a better idea of where their calls for service were being generated. Recognizing that the vast majority of those calls were within the UVMC campus, Concord Township and UVMC signed a 2017 Memorandum of Understanding whereby UVMC committed to use private patient transport services in lieu of being paying a portion of Concord Township's fire contract with the City. Since 2017, the Troy Fire Department (TFD) has served in a backup capacity (as a last resort option) when the private service at UVMC was unavailable or unable to meet time-sensitive critical calls. UVMC has paid the City a fee for each backup EMS response. However, UVMC and the City have recognized that 911 calls dispatching TFD have greatly increased. After several years of experiencing response issues for critical 911 EMS calls by those private services, the City and UVMC have recently discussed entering into a separate contract with the City to provide those services not as a backup but as a primary responder, similar to the years prior to 2017. As a part of responding to the hospital's campus, the UVMC Community Benefits Fund has awarded TFD $175,000 to offset the purchase of a Sprinter ambulance and the associated equipment costs. At this time, the ambulance would be dedicated only to respond to answering 911-generated EMS calls. UVMC will provide their own separate on-campus non-emergency patient transportation service calls. Explicit language to that effect will be included in the agreement. Per the Fire Chief, the additional 50-75 annual calls for service can be handled with existing staff and overtime but will not negatively impact service to the City or townships. There may be an opportunity in the future for this program to serve as additional EMS support in our broader service area. As one of our larger area employers, service to UVMC is and should be considered very important In fact, UVMC employs nearly 300 residents in the City of Troy with a 2024 payroll of approximately $10.3 million and tax withholding of $180,000. UVMC has requested that TFD begin EMS response as soon as possible and had hoped that a new service contract could be in place at the beginning of 2025. In light of that urgency, we are requesting consideration of emergency legislation.
