Titterington ~ SUBJECT: UNIFORM DEPOSITORY ACT - AUTHORIZING DEPOSIT OF PUBLIC FUNDS RECOMMENDATION: That Council approves legislation authorizing the deposit of public funds as recommended by the Auditor. BACKGROUND: The Ohio Revised Code requires that the City Auditor must advertise for the deposit of public funds every five years. The current depository agreements expire in August. In June, Council approved the legislation estimating the amount of funds to be deposited. The Auditor then contacted local financial institutions requesting their submittal of bank depository agreements for Active, Interim and Inactive Funds. Mr. Frigge has evaluated the responses of the financial institutions and has recommended the central depository continue to be U.S. Bank National Association and that the City's payroll account continue to be with First Financial Bank. To provide the Auditor with flexibility, and has been the practice, it is recommended that all the responding financial institutions be authorized to be depositories for the active, inactive and interim funds. The financial institutions in addition to U.S. Bank National Association and First Financial Bank, are Fifth Third Bank, National Association; Park National Bank; Minster Bank; and Greenville Federal. REQUESTED ACTION: It would be appreciated if you would assign to a Committee of Council authorizing the deposit of public funds for the coming five-year period. Titterington, Director of Public Service and Safe! ~ DATE: July 22, 2026 SUBJECT: CDBG REVOLVING LOAN FUND APPLICATION - SYNERGY POINT LLC dba RUDY'S SMOKEHOUSE RECOMMENDATION: That Troy City Council accepts the recommendation of the Loan Review Committee for a new loan from the CDBG Economic Development Revolving Loan Fund (ED RLF) to Synergy Point LLC dba Rudy's Smokehouse to finance the purchase of restaurant equipment for a new location at 111 W. Water Street and to authorize a CDBG ED RLF application to be filed with the Ohio Department of Development (ODOD). BACKGROUND: Rudy's Smokehouse is a locally owned barbecue restaurant established in Springfield, Ohio, in 2005 by Rudy Mosketti, a Vietnam veteran with more than 40 years of experience in the restaurant industry. Prior to opening Rudy's Smokehouse, Mr. Mosketti owned and operated several Perkins Restaurant locations throughout the Springfield area. His vision was to bring authentic Southern-style barbecue to west-central Ohio while maintaining a strong commitment to community involvement and charitable giving. In 2023, the company expanded through franchising, granting Kris and Tabatha Rowland the opportunity to open a Rudy's Smokehouse location in Columbus, Ohio. Mr. Rowland has maintained a longstanding professional relationship with Mr. Mosketti, beginning his career as a busboy at Perkins Restaurant before advancing to restaurant manager for Rudy's Smokehouse in Springfield. During that time, he played a significant role in refining the restaurant's operational procedures and contributing to the continued development of the Rudy's Smokehouse brand. The proposed loan will help establish a new Rudy's Smokehouse restaurant at 111 W. Water Street. The total project investment is approximately $414,161 and includes tenant improvements, equipment purchases, working capital, and other startup expenses. The project is anticipated to create approximately 25 new full-time and part-time positions during the first year of operation. Financial information demonstrates continued business growth, including a 112 percent increase in net income between 2023 and 2025. Financial projections prepared for the Troy location estimate gross sales of approximately $2.5 million during the first year of operation and $2.875 million during the second year. The applicant is requesting loan assistance to address a financing gap that remains after conventional financing has been secured. Rayner has also requested that the current city SBD loan be restructured into one new loan spread out over ten years. Restructuring the existing loan and creating a new loan amount of $197,666.95 will lead to monthly payments of $1,943.09. The current monthly payment is $1,816. The U.S. prime rate currently stands at 6.75%, which will result with an interest rate of 3.375% for the loan at the requested term of 10 years. The new loan terms will be approximately $127 more per month than the current monthly payment. BACKGROUND: In January of 2022, City Council authorized a CDBG Economic Development Revolving Loan for $300,000 to finance equipment for a restaurant at 101 W. Main Street, originally named Speakeasy Miso, with terms of a seven-year loan at 2% APR, which amounted to approximately $4, 100 monthly payments. Speakeasy Ra men, LLC has not missed a loan payment and has paid down the debt, which currently stands at $170,191.91. In January of 2026, the restaurant transitioned to a different concept with a new name of 41 Grill and Draft House. To make the transition, new equipment was added to accommodate the new menu items. The applicant requested interest only payments for the first six months, which were approved by City Council by R-65-2025. In June 2026, the applicant requested a four-month extension of interest-only loan payments. The owner reported that the transition to a new restaurant has resulted in increased sales, reduced labor expenses, and lower food costs. Despite these operational improvements, ongoing inflation pressures continue to impact the business's financial performance, prompting the request for temporary relief. Additionally, the owner indicated that the sale of the company's Ramen restaurant in Springfield, Ohio has been completed and the proceeds from that sale are expected to improve the company's cash flow, enabling the business to resume full principal and interest payments at the conclusion of the four-month interest-only period. Information reviewed by the Loan Review Committee is attached. The Loan Review Committee approved a motion to recommend to Council approval of the request to amend the CDBG Economic Development Loan to Speakeasy Ramen, LLC for the property at 101 W. Main Street to permit interest-only payments for four months commencing September 1, 2026. Titterington, Director of Public Service and Safet 1/ r DATE: July 22, 2026 SUBJECT: AUTHORIZING APPLICATION FOR THE U.S. ECONOMIC DEVELOPMENT ADMINISTRATION (EDA) FY 2025 DISASTER SUPPLEMENTAL GRANT - TROY INDUSTRIAL PARK NORTH IMPROVEMENTS RECOMMENDATION: That Council authorizes the Director of Public Service and Safety to execute and file grant applications with the U.S. Economic Development Administration (EDA) under the FY 2025 Disaster Supplemental Grant Program. Funding will support utility improvements on Experiment Farm Road to unlock future opportunities at the Industrial Park North site. BACKGROUND: In 2024, Arcadis U.S. Inc. was hired to evaluate infrastructure improvements required to support future development growth northwest of the City of Troy's current corporation limits (situated between Washington Road on the west and Experiment Farm Road on the east). The Arcadis study determined the available capacity of existing water and sewer infrastructure to serve the industrial site, and infrastructure improvements that would be needed, including installation of lift and pump stations, to serve the area. The estimated total construction cost for the utility improvements is approximately $10.5 Million. The City became aware of the FY 2025 Disaster Supplemental Grant Program under the U.S. Economic Development Administration (EDA) that may apply to infrastructure improvements. This grant funding required a 20% local funding match. The City's application would be for $8.5 Million to offset 80% of the costs associated with the improvements to Washington Road and Experiment Farm Road to extend the water and sanitary sewer systems along Experiment Farm Road. This would provide utilities to the Troy Industrial Park North to allow for future development and job growth, which aligns with the City's Comprehensive Plan and Future Land Use. Anticipated benefits of this project include attracting new businesses and industries; creating jobs; allowing for new and future expansion of current industries. REQUESTED ACTION: It would be appreciated if you would assign a Committee of Council for consideration authorizing the Director of Public Service and Safety to execute and file grant applications to the U.S. Economic Development Administration FY 2025 EDA Disaster Supplemental Grant funding for the utility work for the Industrial Park North Improvements. Titterington, Director of Public Service and Safety DATE: July 20, 2026 SUBJECT: AMEND SECTION 505.15 OF THE CODIFIED ORDINANCES REGARDING RABIES VACCINATIONS RECOMMENDATION: That Troy City Council amends Section 505.15 of the Codified Ordinances regarding rabies vaccinations to reflect current veterinary practice and improve its enforceability. BACKGROUND: The current ordinance requirement that all dogs receive a rabies vaccination every year is no longer consistent with accepted veterinary standards. Chief McKinney spoke with a local veterinarian who confirmed that, depending on the vaccine administered, a rabies vaccination may be valid for up to three years. As a recent example, the Miami County Animal Shelter's vaccination clinic on July 15, 2026, administered three-year rabies vaccinations. As written, the ordinance places responsible pet owners with valid three-year vaccinations in technical violation of City law, despite complying with current veterinary standards. Updating the ordinance would eliminate this inconsistency while continuing to ensure that all dogs maintained within the City have a current rabies vaccination. Chief McKinney also recommends removing the requirement that a dog wear its rabies vaccination tag on its collar. While owners are routinely provided a tag when their dog is vaccinated, many choose not to attach it to the collar or the tag is lost over time. The Troy Police Department does not enforce this provision because the presence or absence of a tag does not determine whether a dog is properly vaccinated. Instead, officers require owners to provide proof of a current rabies vaccination when appropriate. The Troy Police Department does not conduct random checks of rabies vaccinations. Officers typically verify vaccination status when investigating dog bite incidents and, when appropriate, during other animal-related investigations such as dogs running at large or animal abuse complaints. Requiring proof of a current vaccination, rather than requiring the dog to wear a tag, better reflects how the ordinance is enforced in practice and provides a more reliable method of establishing compliance. The proposed amendment would maintain the ordinance's public health purpose while aligning it with current veterinary practice, making it easier to enforce, and ensuring that responsible pet owners are not subject to citation solely because they have received a valid three-year rabies vaccination or their dog is not wearing the vaccination tag . REQUESTED ACTION: It would be appreciated if you would assign to a Committee of Council amending Section 505.15 of the Codified Ordnances to read as follows: (a) No owner or keeper of any dog shall keep or harbor the dog within the City unless the dog has a current rabies vaccination administered by a licensed veterinarian in accordance with Ohio law and the manufacturer's approved vaccination schedule. A rabies vaccination shall be considered current for the period specified on the vaccination certificate issued by the administering veterinarian. Titterington, Director of Public Service and Safety- ( DATE: July 21, 2026 SUBJECT: 2026 Sidewalk Replacement and Missing Gap Program (Phase 17) Resolution of Necessity RECOMMENDATION: That Council authorizes the Resolution of Necessity regarding the repair and/or installation of certain sidewalks in a 2026 Sidewalk Replacement and Missing Gap Program (Phase 17). BACKGROUND: Attached is a map of the areas identified regarding the next phase, 2026 Sidewalk Replacement and Missing Gap Program (Phase 17). That information indicates there are 14 parcels that have been identified where the sidewalks are required to be installed/repaired/replaced. This year's program generally includes 2525 & 2569 W. Main Street, 597 & 603 Dellwood Drive, parcels along Stony Creek Road and South Lane, and various properties and ADA ramps throughout the City. The first step in this process is the Resolution of Necessity. If Council approves the Resolution of Necessity, the City will notify property owners by letter identifying the sidewalks to be installed/repaired/replaced, and the date in which a permit to complete the sidewalk work is to be obtained for the work. Staff plans to give the property owners a minimum of six weeks, from the date of the certified mailing, to obtain the permit for the sidewalk work. Those permits are good for six months so the property owners who choose to complete their own work will have time to complete the work. The property owners can coordinate with City staff if additional time is needed. Included with the notice will be a packet of information including the list of licensed concrete/sidewalk contractors, a program area map, and a set of engineered drawings with elevations of the sidewalks to be installed/repaired/replaced for that particular property. Properties for which permits are not obtained will then be included in a sidewalk project bid by the City, with the property owners later paying the City for that work or having the cost assessed to the property tax.
