8103 ACTION MINUTES OF TULARE CITY COUNCIL, CITY OF TULARE January 7, 2020 A closed session of the City Council, City of Tulare was held on Tuesday, January 7, 2020, at 6:00 p.m., in the Tulare Public Library & Council Chambers, 491 North “M” Street. COUNCIL PRESENT: Jose Sigala, Dennis A. Mederos, Terry A. CALL TO ORDER REGULAR SESSION Mayor Sigala called the regular session to order at 7:02 p.m. VIII. PLEDGE OF ALLEGIANCE AND INVOCATION Deputy City Manager Josh McDonnell led the Pledge of Allegiance and an invocation was given by City Manager Rob Hunt. IX. CITIZEN COMMENTS Mayor Sigala requested those who wish to speak on matters not on the agenda within the jurisdiction of the Council, or to address or request a matter be pulled from the consent calendar to do so at this time. He further stated comments related to general business matters would be heard at the time that matter is addressed on the agenda. 8105 Bo Liu of the Cherry Street Pharmacy addressed the Council regarding a fully funded medication program for seniors. Alberto Ramos of CASA addressed the Council regarding their 4th Annual Super Hero Run at Live Oak Park on March 28. X. COMMUNICATIONS There were no items for this section of the agenda. XI. CONSENT CALENDAR: It was moved by Vice Mayor Mederos, seconded by Council Member Sayre and carried 3 to 0 (Council Members Jones and Nunley absent) that the items on the Consent Calendar be approved as presented. (1) Authorization to read ordinances by title only. (2) Approve minutes of December 17, 2019 special/regular meeting. [Submitted by: R. Yoder] (3) Approve the reappointment of Aviation Committee Member Robert Smith and appoint new member Ryan Wilson for terms ending December 31, 2023. [Submitted by: R. Yoder] (4) Declare seat on the Housing & Building Appeals Board vacant, term ending December 31, 2019, and direct staff to post the vacancy and solicit applications. [Submitted by: R. Yoder] (5) Adopt Resolution 2020-01 approving submittal of an application to the California Department of Housing and Community Development (HCD) to participate in the 2019 CalHome Program for an allocation of funds not to exceed Seven Hundred Thousand ($700,000) for a First-Time Homebuyer Mortgage Assistance, and/or Owner Occupied Rehabilitation Assistance Program to eligible low-income families within the City of Tulare; and to authorize the City Manager or his designee(s) to execute a standard agreement, any amendments thereto, and any and all other documents or instruments necessary or required by HCD for participation in the CalHome Program. Myers] (6) Adopt Resolution 2020-02 approving submittal of an application to the California Department of Housing and Community Development (HCD) to participate in the 2019 HOME Program for an allocation of funds not to exceed Five Hundred Thousand Dollars ($500,000) for a First-Time Homebuyer (with or without Rehabilitation) Program that will supply down payment and closing cost assistance, and/or Owner Occupied Housing 8106 Rehabilitation Program to eligible low-income families within the City of Tulare; and to authorize the City Manager or his/her designee(s) to execute a standard agreement, any amendments thereto, and any and all other documents or instruments necessary or required by HCD for participation in the HOME program. [Submitted by: T. Myers] (7) Adopt Ordinance 19-13 repealing and replacing Sections 9.48.080 and 9.48.140 of existing Chapter 9.48 (Standing, Stopping, Parking) of the Tulare Municipal Code. [Submitted by: M. Miller] (8) Authorize the City Manager to execute a preliminary oversized construction reimbursement agreement with MFT- Bardsley, LLC for construction costs associated with the Jack-In-The-Box commercial development that are eligible for reimbursement in accordance with Chapter 8.64 of the Municipal Code, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager. [Submitted by: M. Miller] (9) Receive, review, and file the Monthly Investment Report for November 2019. [Submitted by: D. Thompson] (10) Award a contract in the amount of $71, 981.61 for Design Build Services RFP #20-693 to Miracle Play Systems, Oakland for the supply and installation of new playground equipment with associated improvements at Bender Park and authorize the City Manager to execute the agreement. SCHEDULED CITIZEN OR GROUP PRESENTATIONS (1) Resolution of Commendation recognizing Rick and Nanette Allison for their commitment to serving the community and local youth through the annual American Thunder Motorcycle Run and Toy Delivery. Mayor Sigala presented Rick and Nanette Allison with a Resolution of Commendation. (2) Proclamation declaring January 11, 2020, as Tulare Patriots’ Day in recognition of winning the World Youth Football Championship at the Pro Football Hall of Fame on December 14, 2019. Mayor Sigala presented the Tulare Patriots Team and Coaches a Proclamation and Certificates of Recognition for their accomplishment. XIII. MAYOR’S REPORT Mayor Sigala advised by consensus of the three Council Members present, that a special meeting to continue discussions regarding homelessness, will be scheduled for Thursday, January 16, 2020 at 6 p.m. 8107 XIV. STUDENT REPORTS Teens on Board City Council representatives Araceli Espinoza, Tulare Western, Jr.; Amber Munoz, Tulare Western Sr. and Sebastian Pires, Tulare Western, Jr.; provided student reports. XV. GENERAL BUSINESS Comments related to General Business Items are limited to three minutes per speaker, for a maximum of 30 minutes per item, unless otherwise extended by the Council. (1) Public Hearing: a. Public Hearing to pass-to-print Ordinance 2020-01 amending Title 2, Chapter 2.04 (Parks & Recreation Commission), Section 2.04.020 (Definitions), 2.04.030 (Appointments and Qualifications), 2.04.060 (Forfeiture of Office) and 2.04.070 (General Powers & Duties) of the Tulare Municipal Code. [Submitted by: R. Hunt] City Manager Rob Hunt provided a report for the Council’s review and consideration. Mayor Sigala opened the public hearing at 7:36 p.m.; receiving no public comment, he closed the public hearing at 7:36 p.m. With no further discussion, it was moved by Vice Mayor Mederos, seconded by Council Member Sayre and carried 3 to 0 (Council Members Jones and Nunley absent) to pass-to-print Ordinance 2020-01 as presented. (2) Community Development: a. Receive an update on the activities of the 2020 Census Complete Count Committee, provide further direction to staff on outreach to be conducted by the City of Tulare and identify a possible funding source. [Submitted by: T. Myers] Community Development Director Traci Myers provided an update for the Council’s review and consideration. Following discussion, it was moved by Mayor Sigala, seconded by Vice Mayor Mederos and carried 3 to 0 (Council Members Jones & Nunley absent) to direct staff to identify a funding source in order to do more outreach to support the 2020 Census. (3) City Manager: a. Authorize the Mayor to execute a Memorandum of Understanding Agreement with the International Agri-Center (Agri-Center) for the ongoing provision and reimbursement of public safety services for the annual World Ag Expo (Ag Expo). [Submitted by: J. McDonnell] City Manager Rob Hunt provided a report for the Council’s review and consideration. Following brief comments, it was moved by Vice Mayor 8108 Mederos, seconded by Council Member Sayre and carried 3 to 0 (Council Members Jones & Nunley absent) to approve the item as presented. b. Selection of attendee(s) to represent the City of Tulare at the ICSC Monterey Conference and Deal Making, Tuesday, March 10, 2020 through Wednesday, March 11, 2020, in Monterey, California and ICSC RECon, Sunday, May 17, 2020 through Tuesday, May 19, 2020, Las Vegas, Nevada and direct staff to coordinate travel plans. [Submitted by: R. Hunt/R. Yoder] Mayor Sigala introduced the item. Following comments, it was moved by Mayor Sigala, seconded by Vice Mayor Mederos and carried 3 to 0 (Council Member Jones & Nunley absent) to send Mayor Sigala to the ICSC Monterey Conference; it was further moved by Vice Mayor Mederos, seconded by Council Member Sayre and carried 3 to 0 (Council Members Jones & Nunley absent) to send Council Member Jones to the ICSC Monterey Conference. Lastly, it was moved by Vice Mayor Mederos, seconded by Council Member Sayre and carried 3 to 0 (Council Members Jones & Nunley absent) to send both Mayor Sigala and Council Member Jones to ICSC Las Vegas, staff to coordinate travel plans.
