ACTION MINUTES OF TULARE
CITY COUNCIL, CITY OF TULARE
January 15, 2019
A special closed session meeting of the City Council, City of Tulare was held
on Monday, January 15, 2019 at 5:30 p.m. in the Tulare Public Library &
Council Chambers, 491 North “M” Street.
COUNCIL PRESENT: Jose Sigala, Dennis A. Mederos, Carlton Jones5:35 p.m., Greg
Nunley5:33 p.m., Terry A. Sayre
STAFF PRESENT: Rob Hunt, Mario Zamora, Janice Avila, Matt Machado, Roxanne
Yoder
I. CALL TO ORDER SPECIAL CLOSED SESSION
Mayor Sigala called the special closed session to order at 5:30 p.m. and indicated
that two of the Council Members were running behind and that the meeting would
begin in approximately 5 minutes. Following the brief break, Mayor Sigala called
the special closed session to order at 5:35 p.m.

CODE SECTION(S):
Mayor Sigala adjourned to special closed session at 5:35 p.m., for items as noted
on the agenda.
(a) 54956.9(d)(1) Conference with Legal Counsel – Existing Litigation (1)
Name of Case: Hensley v. City of Tulare, TCSC Case No. 273730
V. RECONVENE SPECIAL CLOSED SESSION
Mayor Sigala reconvened from special closed session at 6:50 p.m.
VI. SPECIAL CLOSED SESSION REPORT (if any)

Interim City Attorney advised that a global settlement has been reached in the
matter of Hensley vs. City of Tulare as stated for the record $275,000 payable to
Mr. Hensley; a three-year contract to return to work, effective immediately, until
June of 2022, with a 30-day resignation notice from Mr. Hensley and the City
cannot terminate unless for cause; the balances of sick leave, management leave,
vacation, and floating holidays will be restored as noted; attorney’s fees and
mediator fees to be paid by the City; the City to prepare a letter to be distributed to
the Public; this settlement will release all claims. It was moved by Vice Mayor
Mederos, seconded by Council Member Nunley and carried 4 to 1 (Council
Member Jones voting no) to approve the settlement.
VII. ADJOURN SPECIAL CLOSED SESSION
Mayor Sigala adjourned the special closed session at 6:54 p.m.
