CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Rocha led us in the flag salute.

COMMISSIONER COMMENTS:
Commissioner Herrera announced that there is an event taking place at the Tulare County
Fairgrounds called “Burn Out” where they will be handing out free blunts to the first 500 people
attending this event. She said it is all over social media and she is very concerned that this type
of event is being held in our city.
Director McDonnell stated that he would look into this and asked Commissioner Herrera to
forward her the information.
CONSENT CALENDAR:
(1) Minutes of the December 11, 2017 regular meeting
It was motioned by Commissioner Rocha and seconded by Commissioner Herrera to
approve the Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Mitigated Negative Declaration/Tentative Subdivision Map 2017-08- Hidden Ridge
and Zone Amendment No. 721:
Consideration of Tentative Subdivision Map 2017-08; a request to subdivide 9.73 acres into
a 43 lot single-family residential subdivision to be zoned R-1-5 (Single Family
Residential—5,000 square foot minimum lot area) density in two phases. The Zone
Amendment is to change the existing zone from R-1-6 (Single Family Residential—6,000
sq. ft. minimum lot area) to R-1-5 (single Family Residential – 5,000 sq. ft. minimum lot
area. This project is located approximately 350 feet west of Morrison Street near the
northwest corner of Morrison Street and Bardsley Avenue. A Mitigated Negative was
prepared for this project for public review pursuant to provisions of the Public Resources
Code, State of California, Section 210000 to 21177 of the California Environmental Quality
Act (CEQA). This project was continued from the November 27, 2017 meeting.
Chairman Miguel noted that he has been advised that the applicant wishes to withdraw this
application.
Director McDonnell read to the Commission a letter from the applicant stating that he
wishes to withdraw the application for Mitigated Negative Declaration/Tentative

Subdivision Map 2017-08- Hidden Ridge and Zone Amendment No. 721. He noted that he
will be moving forward with the previously approved 32 lot single family residential
Tentative Subdivision map that was approved by the City of Tulare Planning Commission
on May 15, 2006.
Chairman Miguel clarified that there is no action to be taken on this application.
(2) Conditional Use Permit No. 2017-28:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Jesus
Arambula to operate a stationary mobile vending vehicle on the property located at 440
North “J” Street. The property is zoned Retail Commercial (C-3). This project is exempt
pursuant to Section 15304 (e) of the California Environmental Quality Act of 1970, as
amended.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was closed.
Following Commission discussion it was motioned by Commissioner Rocha and seconded
by Commissioner Herrera to adopt Resolution 5270, approving Conditional Use Permit No.
2017-28 based upon the findings and subject to the conditions as listed in the staff report.

(3) Conditional Use Permit No. 2017-29:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Juan Andrade
to operate a stationary mobile vending vehicle on the property located at 536 E. Cross Ave.
The property is zoned Service Commercial (C-4). This project is exempt pursuant to
Section 15304 (e) of the California Environmental Quality Act of 1970, as amended.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was closed.
Following Commission discussion it was motioned by Commissioner Rocha and seconded
by Commissioner Herrera to adopt Resolution 5271, approving Conditional Use Permit No.
2017-29 based upon the findings and subject to the conditions as listed in the staff report.

(4) Conditional Use Permit No. 2017-30:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Raquel
Sanchez to operate a large family day care home (nine or more children, not to exceed
fourteen children). The project is located at 980 N. Terrace Park Street. The property is
zoned R-1-8 (Single Family Residential- 8,000 sq. ft. minimum lot area). This project is
exempt pursuant to Section 15274 of the California Environmental Quality Act of 1970, as
amended.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was closed.
Following Commission discussion it was motioned by Commissioner Rocha and seconded
by Commissioner Herrera to adopt Resolution 5272, approving Conditional Use Permit No.
2017-30 based upon the findings and subject to the conditions as listed in the staff report.

DIRECTORS REPORT:
Director McDonnell congratulated Chairman Miguel on his first Planning Commission meeting
and notified him that there will be many more this year.
Chairman Miguel asked if there would be some type of plaque presentation for the former
Planning Chairman, Jeff Killion and Commissioner Linda Crase and asked that Planning
Commission be notified when this would be.
Director McDonnel stated that he would notify the Commission of such presentation.

There being no other items to come before the Commission, the meeting was adjourned at 7:21
p.m.

Map 2017-08—Hidden Ridge and adopting a Mitigated Negative Declaration for
Tentative Subdivision Map 2017-08—Hidden Ridge and Zone Amendment No. 721.
Recommended Motion: Adopt Resolution 5266, recommending approval of Zone
Amendment No. 721 to the City Council for adoption.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-
080, decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located
at 411 E. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision
was made. The appeal shall state the name of the person making the appeal, the decision that is being
appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not
supported by the evidence in the record.
