CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Rocha led us in the flag salute.
CITIZEN COMMENTS:
None.
COMMISSIONER COMMENTS:
Commissioner Herrera stated that she is pleased to see the old Fosters Freeze on
Tulare Avenue being cleaned up. She also noted that on Tulare Avenue between
Mooney and Blackstone there were a lot of pine needles blown into the gutter and
asked if the City was responsible for cleaning them out.

Director McDonnel stated that Tulare Avenue is a State Highway and Caltrans is
responsible for all maintenance, but he would forward her concern to them.
Chairman Miguel stated that he was pleased to see the landscaping around Walgreens
cleaned up. He asked staff about the article in the paper regarding the letters sent to
residents regarding possible water contamination and asked which well was
contaminated.
Director McDonnell stated that he believes it was Water Well #37 but that our water
system is on a looped system so it affects all the wells. He stated the city is working
diligently to rectify the issue and that if the Commission would like additional information
he is sure the Board of Public Utilities will be discussing this further at their next
meeting.
CONSENT CALENDAR:
(1) Minutes of the May 14, 2018 regular meeting
It was motioned by Commissioner Rocha and seconded by Commissioner Herrera to
approve the consent calendar as presented and carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2018-02/ Variance No. 459:
Steven Sopp, Associate Planner, reviewed with the Commission a request by
Verizon Wireless to construct a 92-foot tall camouflaged monopole cellular
communications tower with antennas to be located on the east side of Cherry Street
between Merritt Avenue and Prosperity Avenue.
Chairman Miguel opened the public hearing.
Gerri Johnson, Complete Wireless Consulting representative for Verizon Wireless,
spoke in favor of the project and made herself available to answer any questions.
There being no one else to speak in favor of or against the project the public
hearing was closed.
Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Miller to adopt Resolution 5285, approving Conditional
Use Permit No. 2018-02 and Variance No. 459 based on the findings and subject to
the conditions as listed in the staff report.

DIRECTORS REPORT:
Director McDonnell made several announcements to the Commission. He announced
Commissioner Herrera’s resignation and stated that the City Clerk is moving forward
with the publication of the vacancy. He noted that the City budget is continuing to move
forward and that City Council may approve the budget at their next week. He further
noted that there are two ordinances (Annexation and Accessory Dwelling Units) that will
be coming to the Commission very soon.
Chairman Miguel stated that he would like staff to provide some clarification on what is
entailed in the Accessory Dwelling Units. He noted that the he and the Commissioners
will more than likely be receiving several questions regarding this new ordinance.
AJOURNMENT:
There being no other items to come before the Commission, the meeting was adjourned
at 7:21 p.m.

VI. GENERAL BUSINESS- PUBLIC HEARING
(1) Tentative Subdivision Oak Creek 3:
Consider a request by Great Valley Land Builders to divide approximately 4 acres
into a 15-lot multi-family residential subdivision including development consisting of
one or two duplex units to be developed on each proposed parcel (38 units total).
Property is located east of Mooney Blvd. and south of Seminole Avenue (APN 172-
100-001). This project is exempt pursuant to Section 15332 (Infill Development
Projects) of the California Environmental Quality Act of 1970, as amended.
Project Planner: Steven Sopp, Associate Planner
Recommended Motion: Adopt Resolution 5286, approving Tentative Subdivision
Map Oak Creek 3 based on the findings and subject to the conditions as listed in
the staff report.
(2) Conditional Use Permit No. 2018-12:
Consider a request by Veronica Ortiz to operate a stationary mobile vending vehicle
on the property located at 1414 W. Tulare Avenue. The property is zoned Light
Industrial (M-1). This project is exempt pursuant to Section 15304 (e) of the
California Environmental Quality Act of 1970, as amended.

Recommended Motion: Adopt Resolution 5287, approving Conditional Use
Permit No. 2018-12 based on the findings and subject to the conditions as listed in
the staff report.
(3) Conditional Use Permit No. 2018-15:
Consider a request by City of Tulare to construct and operate a new municipal
groundwater well and 1.5 million gallon water storage tank with associated
equipment and improvements to be located on the northwest corner of Cartmill
Avenue and Mooney Blvd. (APN 149-060-013). This project is exempt pursuant to
Section 15332 of the California Environmental Quality Act of 1970, as amended.

Recommended Motion: Adopt Resolution 5290, approving Conditional Use
Permit No. 2018-15 based on the findings and subject to the conditions as listed in
the staff report.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-
080, decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located
at 411 E. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision
was made. The appeal shall state the name of the person making the appeal, the decision that is being
appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not
supported by the evidence in the record.
