CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Rocha led us in the flag salute.
CITIZEN COMMENTS:
None.
COMMISSIONER COMMENTS:
Commissioner Miller noted that she attended a one day trip put on by the Historical
Society to tour the USS Zumwalt and that it was an amazing experience. She noted
that if you are a resident of Tulare you can call and schedule a tour free of charge.

CONSENT CALENDAR:
(1) Minutes of the September 24, 2018 regular meeting
Commissioner Cox noted an error on page one where it lists him as the Community
& Economic Development Director. Correction was noted.
It was motioned by Commissioner Cox and seconded by Commissioner Olivares to
approve the consent calendar as presented with the above noted correction and
carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2018-23:
Steven Sopp, Associate Planner, reviewed with the Commission a request by
Tiffany Osborne to operate a large family day care home at 1784 Silver Lake
Avenue.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project the public hearing
was closed.
Following Commission discussion it was motioned by Commissioner Cox and
seconded by Commissioner Rocha to adopt Resolution 5297, approving
Conditional Use Permit No. 2018-23 based on the findings and subject to the
conditions as listed in the staff report.

Director McDonnell welcomed and introduced two members of the audience, Sabrina
Cox (Commission Clerk’s daughter and Commissioner Cox’s wife) and Austin Ellis
(Director McDonnell’s Godsister’s son).
AJOURNMENT:
There being no other items to come before the Commission, the meeting was adjourned
at 7:21 p.m.

jurisdiction of the Planning Commission. The Planning Commission cannot legally
discuss or take official action on citizen comments that are introduced tonight. Each
speaker will be allowed three minutes, with a maximum time of 10 minutes per item,
unless otherwise extended by the Planning Commission.

VI. GENERAL BUSINESS- PUBLIC HEARING
(1) Zone Amendment No. 731;
Consider a request by City of Tulare to amend Section 10.188.050 (J) of the
existing Zoning Ordinance revising the Citys’ standards for Non-commercial
Signage.
Project Planner: Mario Anaya, Principal Planner
Recommended Motion: Adopt Resolution 5298, recommending to the City
Council adoption of Zone Amendment No. 731.
(2) Notice of Intent to adopt Final Environmental Impact Report/ Conditional Use
Permit No. 2016-04:
Consider Environmental Impact Report and approval of Conditional Use Permit No.
2016-04,a request by Pilot Travel Center to construct a Pilot Flying J truck
stop/travel center on 13.63 acres fir regional travel serving uses at the southwest
corner of Blackstone Street and Paige Avenue. Property is zoned M-1 (Light
Industrial). An Environmental Impact Report was prepared in accordance with the
California Environmental Quality Act of 1970, as amended.

Recommended Motion: Adopt Resolution 5301, adopting the Environmental
Impact Report and approving Conditional Use Permit No. 2016-04 based on the
findings and subject to the conditions as listed in the staff report.
(3) Conditional Use Permit No. 2018-24:
Consider a request by Juan Carlos (Jaliscos Tacos) to continue to operate a
stationary mobile vending vehicle located at 1510 North J Street. Property is zoned
C-4 (Service Commercial) and is exempt pursuant to Section 15304 (e) of the
California Environmental Quality Act of 1970, as amended.

Recommended Motion: Adopt Resolution 5299, approving Conditional Use Permit
No. 2018-24 based on the findings and subject to the conditions as listed in the staff
report.

(4) Conditional Use Permit No. 2018-25:
Consider a request by AYC Construction to allow the height of a proposed 19,591
sq. ft. commercial building to be 326 ft. rather than 30 ft. The proposed project is
located North of Bardsley Avenue and east of Blackstone Street and is exempt
pursuant to Section 15332 of the California Environmental Quality Act of 1970, as
amended.

Recommended Motion: Adopt Resolution 5300, approving Conditional Use Permit
No. 2018-25 based on the findings and subject to the conditions as listed in the staff
report.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-
080, decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located
at 411 E. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision
was made. The appeal shall state the name of the person making the appeal, the decision that is being
appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not
supported by the evidence in the record.
