CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers March 23, 2020 491 North M Street COMMISSIONERS PRESENT: Miller, Cox, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Mario Anaya, Principal Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Cox led us in the flag salute. Chairman Miguel asked if Commissioner Miller would lead us in an invocation amidst of all that is going on in the world today. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: None CONSENT CALENDAR: (1) Minutes of the February 24, 2020 Regular Planning Commission Meeting Planning Commission Minutes 1 March 23, 2020 It was motioned by Commissioner Miller and seconded by Commissioner Cox to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) General Plan Amendment No. 2020-01 and Zone Amendment No. 740: Mario Anaya, Principal Planner, reviewed with the Commission a request by Three River Development to change the existing General Plan designation and Zoning designation of an approximately 0.38 acre portion of an existing parcel located on the South side of Prosperity Avenue between Brentwood and Laspina Streets. The proposed General Plan Amendment would change the existing General Plan designation from Office Commercial to Community Commercial and the proposed Zone Amendment would change the existing Zoning designation from C-2 (Office Commercial) to the C-3 (Retail Commercial) zone district. The City has prepared an addendum to an initial study/ mitigated negative declaration which was previously adopted by the City of Tulare City Council on July 16, 2019. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Cox to adopt Resolution 5363, recommending to the City Council adoption of General Plan Amendment No. 2020-01 and Zone Amendment No. 740 based on the findings and conditions as listed in the staff report. COMMISSIONERS AYES: Miller, Cox, Miguel ABSENT: Rocha, Olivares NOES: None ABSTAIN: None Planning Commission Minutes 2 March 23, 2020 GENERAL BUSINESS—NON PUBLIC HEARING ITEMS (1) Housing Element Annual Progress Report 2019: Mario Anaya, Principal Planner, reviewed with the Commission the Annual Progress Report (APR) for the Commission to accept and recommend to the City Council approval of the APR and forward it to the State Department of Housing and Community Development. Following Commission discussion the Housing Element Annual Report 2019 was accepted and recommended to City Council for approval. TEENS ON BOARD: None present DIRECTORS REPORT: Mario Anaya, Principal Planner, noted that Director Myers was sorry that she could not attend the meeting tonight and thanked the Commissioners for their attendance amidst the current COVID 19 situation. The Planning Commission cannot legally discuss or take official action on citizen comments that are introduced tonight. GENERAL BUSINESS- PUBLIC HEARING: (1) Conditional Use Permit No. 2020-04 and Variance No. 463 Consider a request by Ilan Golchech to construct a service station and convenience store. The application also includes a request to obtain an ABC license (Type 20: Off Sale beer and wine). The service station and convenience store are proposed to be located on the southwest corner of Tulare Avenue and Mooney Boulevard and is zoned C-4 (Service Commercial). This project is exempt pursuant to Section 15332 (In-fill Development Projects) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5366, approving Conditional Use Permit No. 2020-04 and Variance 463 based on the findings and subject to the conditions as listed in the staff report. (2) Conditional Use Permit No. 2020-07: Consider a request by Flor Guevara and Francisco Osorio to operate a stationary mobile vending vehicle on the property located at 1301 E. Paige Avenue. The property is zoned RM-3 (Multi-Family Residential). This project is exempt pursuant to Section 15304 (e) of the California Environmental Quality Act of 197, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5364, approving Conditional Use Permit No. 2020-07, based on the findings and subject to the conditions as listed in the staff report. (3) Conditional Use Permit No. 2020-09: Consider a request by Varinder Singh to operate a stationary mobile vending vehicle on the property located at 2811 S. Blackstone Street. The property is zoned M-1 (Light Industrial). This project is exempt pursuant to Section 15304 (e) of the California Environmental Quality Act of 1970, as amended. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
